حدّثنا أبو العباس محمد بن يعقوب، حدّثنا محمد بن هشام بن مَلَّاس النُّمَيريّ، حدّثنا مروان بن معاوية الفَزَاري. وأخبرنا أحمد بن سلمان الفقيه، حدّثنا الحسن بن مُكرَم، حدّثنا يزيد بن هارون؛ قالا: حدّثنا بَهْز بن حَكيم، عن أبيه، عن جدِّه قال: قلتُ: يا رسولَ الله، عوراتُنا ما نأتي منها، وما نَذَرُ؟ قال: "احفَظ عورتَك إلَّا من زوجتِك، أو ما مَلَكَت يمينُك" قلت: أرأيتَ إنْ كان قومٌ بعضُهم فوق بعض؟ قال: "إن استطعتَ أن لا يراها أحدٌ، فلا يَرَيَنَّها" قلت: أرأيتَ إنْ كان أحدُنا خاليًا؟ قال: "فالله أحقُّ أن يُستحيَى منه" ووضع يدَه على فَرْجِه (1). هذا حديث صحيح الإسناد، ولم يُخرجاه. Bahz bin Hakim narrates from his father, from his grandfather (Sayyiduna Mu'awiyah bin Haydah (may Allah be pleased with him)), who said: I said: "O Messenger of Allah, what is the ruling concerning covering our private parts - what of them must we cover and what may we leave?" He (peace and blessings be upon him) said: "Guard your private parts except from your wife or from what your right hand possesses (a slave-woman)." I said: "Tell me, what if people are (crowded) together with one another?" He (peace and blessings be upon him) said: "If you are able to ensure that no one sees them, then let no one see them at all." I said: "Tell me, what if one of us is alone?" He (peace and blessings be upon him) said: "Allah Almighty is more deserving that one should be modest before Him." And he (peace and blessings be upon him) placed his hand over his private parts.
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.
(1) إسناده حسن. والد حكيم اسمه: معاوية بن حَيدة القُشيري. Grading: (1) Its chain is hasan. Technical note / Defect ('illah): The name of Hakim's father is "Mu'awiyah bin Haydah al-Qushayri". وأخرجه ابن ماجه (1920)، والترمذيّ (2794) من طريق يزيد بن هارون، بهذا الإسناد. وقال الترمذيّ: حديث حسن. Reference / Source: Ibn Majah (1920) and al-Tirmidhi (2794) recorded it via Yazid bin Harun, with this chain. And Imam al-Tirmidhi said: this hadith is hasan. وأخرجه أحمد 33/ (20034) و (20035) و (20040)، وأبو داود (4017)، وابن ماجه (1920)، والترمذيّ (2769) و (2794)، والنسائي (8923) من طرق عن بهز بن حكيم، به. Reference / Source: Ahmad (33/ 20034, 20035, 20040), Abu Dawud (4017), Ibn Majah (1920), al-Tirmidhi (2769, 2794) and al-Nasa'i (8923) recorded it via various routes from Bahz bin Hakim. وعندهم: إن كان القوم بعضهم في بعض، قال في "عون المعبود" 11/ 39: أيّ: مختلطون فيما بينهم مجتمعون في موضع واحد، ولا يقومون من موضعهم، فلا نقدر على ستر العورة وعلى الحِجاب منهم على الوجه الأتم في بعض الأحيان لضيق الإزار أو انحلاله لبعض الضرورة. Details of the narration: Their wording is: "If the people are mingled with one another". "'Awn al-Ma'bud" (11/ 39) explains: that is, they are mixed together, gathered in one place, and do not get up from their place, so that at times we are unable to cover our 'awrah and screen ourselves from them completely, because the waist-wrapper is tight or comes loose out of some necessity.
