Mustadrak al-Hakim — Hadith 7399

أخبرنا أبو عبد الله محمد بن يعقوب الحافظ، حدثني يحيى بن محمد بن يحيى، حدثنا مسدَّد، حدثنا إسماعيل، أخبرنا أيوب، عن عِكْرمة، عن أبي هريرة: أن رسولَ الله ﷺ نَهَى أن يُشرَبَ من فِي السِّقاء. قال: أيوب فأُنبِئتُ: أَنَّ رجلًا شَرِبَ من فِي السِّقاء، فخرجت حَيَّةٌ (1). صحيح على شرط البخاري، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) forbade drinking water (directly) from the mouth of a waterskin. Ayyub (the narrator) says: I was informed that a man drank from the mouth of a waterskin and a snake came out of it.
This hadith is sahih (authentic) on the condition of Bukhari, but the two Shaykhs did not record it.

Grading: Its chain is "sahih".
Technical note / Defect ('illah): Isma'il in the chain is Isma'il bin 'Ulayyah, and Ayyub is Ayyub al-Sakhtiyani.
وأخرجه البخاري (5628) عن مسدد بن مسرهد، بهذا الإسناد.
Reference / Source: Al-Bukhari narrated it in (5628) from Musaddad bin Musarhad, with this same chain.
وأخرجه أحمد (12 (7153) عن إسماعيل ابن علية به.
Reference / Source: Ahmad narrated it in (12/ 7153) through the route of Isma'il bin 'Ulayyah.
وأخرجه البخاري (5627) من طريق سفيان بن عيينة، وابن ماجه (3420) من طريق عبد الوارث بن سعيد، كلاهما عن أيوب به وليس عند البخاري ولا ابن ماجه قصة الحيّة.
Reference / Source: Al-Bukhari narrated it in (5627) through the route of Sufyan bin 'Uyaynah and Ibn Majah in (3420) through the route of 'Abd al-Warith bin Sa'id; both of them narrate from Ayyub al-Sakhtiyani.
Note / Clarification: The story of the snake is not in the narrations of al-Bukhari and Ibn Majah.
قال الحافظ ابن حجر في "فتح الباري" 17/ 331: وهم الحاكم فاخرج الحديث في "المستدرك" بزيادته، والزيادة المذكورة (يعني قصة الحية) ليست على شرط الصحيح، لأنَّ راويَها لم يُسمَّ، وليست موصولة.
Technical note / Defect ('illah): Ibn Hajar stated clearly in "Fath al-Bari" 17/ 331 that al-Hakim erred in mentioning this narration in his book "al-Mustadrak" with this addition (i.e. the story of the snake), because this addition is not on the condition of the Sahih: its narrator is unnamed (mubham), and it is not connected (mawsul) in its chain either.
