Mustadrak al-Hakim — Hadith 7328

حدَّثَناه أبو العباس محمد بن يعقوب، حدثنا محمد بن عبد الحَكَم، حدثنا يحيى بن حسان، حدثنا مِسوَر بن الصَّلْت وسليمان بن بلال [عن زيد بن أسلَم] (2) عن عطاء بن يَسَار، عن أبي سعيد الخُدْري: أنَّ رسول الله ﷺ سُئِلَ عن جِبَاب أسنمةِ الإبل وألَيَات الغَنَم، فقال: "ما قُطِعَ من حيٍّ، فهو مَيْتٌ" (3). رواه عبدُ الرحمن بن مهدي عن سليمان بن بلال عن زيد بن أسلم مرسلًا. وقيل: عن زيد بن أسلم عن ابن عمر:
It is narrated from Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) was asked about cutting off the humps of camels and the tails of sheep, and he (peace and blessings be upon him) said: "Whatever limb is cut off from a living animal is carrion."

(2) ما بين المعقوفين سقط من النسخ الخطية، وكلام المصنف يقتضي وجوده، وجاء على الصواب في "إتحاف المهرة" (5497) و"تلخيص الذهبي"، وكذلك عند من أخرج الحديث.
Note / Clarification: The text between the brackets had dropped out of the manuscripts, while the author's discussion requires its presence. This text is found correctly in "Ithaf al-Maharah" (5497) and "Talkhis al-Dhahabi", and with the others who recorded the hadith.

(3) حديث حسن بطرقه كسابقه، وهذا الإسناد فيه إشكال من جهة وصله في رواية سليمان بن بلال، فالمحفوظ عنه أنه أرسله كما سيأتي، ورواية غير المصنف من طريق يحيى بن حسان عنه مرسلة. وأما مِسوَر بن الصلت - وروايته هي المتصلة - فضعيف. فأخرجه البزار (1220 - كشف الأستار) عن محمد بن مسكين، والطحاوي في "شرح المشكل" (1573) عن سليمان بن شعيب، كلاهما عن يحيى بن حسان، عن المسور بن الصلت، عن زيد بن أسلم، عن عطاء بن يسار، عن أبي سعيد موصولًا. قال البزار عقبه: هكذا رواه المسور، وخالفه سليمان بن بلال فلم يصله. وكذلك أشار الطحاوي أنَّ الذي وصله هو المسور، وهو ضعيف.
Grading: This hadith too, like the previous hadith, is "hasan" on account of its routes.
Technical note / Defect ('illah): There is a problem with this chain being "mawsul" (connected): the "mahfuz" (preserved) narration from Sulayman bin Bilal is mursal (as will come below). Al-Miswar bin al-Salt narrated it as mawsul, but he is "da'if" (weak).
Reference / Source: Imam al-Bazzar (1220 - Kashf al-Astar) and Imam al-Tahawi in "Sharh Mushkil al-Athar" (1573) recorded it as "mawsul" through the route of Yahya bin Hassan, from al-Miswar bin al-Salt, from Zayd bin Aslam, from 'Ata' bin Yasar, from Abu Sa'id al-Khudri (may Allah be pleased with him). Both Imam al-Bazzar and al-Tahawi indicated that the one who connected it is al-Miswar, who is weak.
ثم أخرجاه بالسند المذكور من طريق يحيى بن حسان، عن سليمان بن بلال، عن زيد بن أسلم، عن عطاء مرسلًا. وقال البزار: لا نعلم أحدًا أسنده إلّا المسور، وليس هو بالحافظ.
Details of the narration: Then both al-Bazzar and al-Tahawi recorded it as "mursal" through the route of Yahya bin Hassan, from Sulayman bin Bilal, from Zayd bin Aslam, from 'Ata'.
Technical note / Defect ('illah): Imam al-Bazzar said that no one other than al-Miswar narrated it as connected (musnad), and al-Miswar is not a "hafiz".
ورواه عبد الرحمن بنُ مهدي، عن سليمان بن بلال، عن زيد بن أسلم مرسلًا، فيما ذكره المصنف عقبَ هذه الرواية.
Reference / Source: 'Abd al-Rahman bin Mahdi also narrated this narration as "mursal" from Sulayman bin Bilal, from Zayd bin Aslam, as the author (al-Hakim) mentioned after this narration.
وتابع سليمانَ بنَ بلال على إرساله معمرٌ، فأخرجه عبد الرزاق (8611) عنه عن زيد بن أسلم مرسلًا. ورجح الدارقطني في "العلل" (1152) و (2273) و (3037) المرسل على الموصول.
Corroborating chains and supporting reports: Ma'mar corroborated Sulayman bin Bilal in narrating it as "mursal"; thus Imam 'Abd al-Razzaq (8611) recorded it as "mursal" from Ma'mar, from Zayd bin Aslam.
Grading: Imam al-Daraqutni in "al-'Ilal" (1152, 2273, 3037) preferred the "mursal" over the mawsul.
وأخرجه المصنف فيما سيأتي برقم (7790) من طريق عبد العزيز بن عبد الله الأويسي عن سليمان بن بلال، عن زيد بن أسلم، عن عطاء، عن أبي سعيد.
Reference / Source: The author himself recorded it later at number (7790) through the route of 'Abd al-'Aziz bin 'Abd Allah al-Uwaysi, from Sulayman bin Bilal, from Zayd bin Aslam, from 'Ata', from Abu Sa'id (may Allah be pleased with him).
وأخرجه ابن عدي في "الكامل" 3/ 57، وأبو نعيم في "الحلية" 8/ 251 من طريق خارجة بن مصعب، عن زيد بن أسلم، عن عطاء بن يسار، عن أبي سعيد. وخارجة بن مصعب - وهو السرخسي - متروك.
Reference / Source: It was recorded by Ibn 'Adi in "al-Kamil" 3/57 and Abu Nu'aym in "al-Hilyah" 8/251 through the route of Kharijah bin Mus'ab.
Technical note / Defect ('illah): Kharijah bin Mus'ab (al-Sarakhsi) is a "matruk" (abandoned) narrator.
