Mustadrak al-Hakim — Hadith 7244

فأخبرَناه أبو عبد الله محمد بن يعقوب، حدثنا يحيى بن محمد، حدثنا مسدَّد، حدثنا أبو عَوَانة، عن عمر بن أبي سَلَمة، عن أبيه، عن أبي هريرة قال: لَعَنَ رسولُ الله ﷺ الراشيَ والمرتشيَ في الحُكم (1). وأمّا حديثُ ثَوْبان:

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) cursed the one who gives a bribe and the one who takes a bribe in matters of judicial ruling.

(1) صحيح لغيره، وهذا الإسناد تفرَّد به عمر بن أبي سلمة في جعله من حديث أبي هريرة، وهو ضعيف لا يحتمل تفرده، فكيف إذا خالف، فقد خالفه من هو أوثق منه، وهو الحارث بن عبد الرحمن - كما في الحديث السابق - فجعله عن أبي سلمة عن عبد الله بن عمرو، ونقل الترمذيُّ عن الإمام الدارمي: أنَّ حديث أبي سلمة عن عبد الله بن عمرو عن النبي ﷺ أحسن شيء في هذا الباب وأصحُّ.
Grading: This narration is "sahih li-ghayrihi", but this particular chain is da'if (weak).
Technical note / Defect ('illah): Umar bin Abi Salamah is alone in making it a hadith of Abu Hurayrah, and he himself is weak and his solitary narration cannot be accepted. Moreover, he contradicted a narrator more reliable than himself (al-Harith bin Abd al-Rahman), who narrated it through Abu Salamah from Abdullah bin Amr. Imam al-Tirmidhi transmitted from Imam al-Darimi that the marfu' narration of Abu Salamah from Abdullah bin Amr is the best and most authentic in this chapter.
يحيى بن محمد: هو ابن يحيى الذهلي، وأبو عوانة: هو الوضاح بن عبد الله اليشكري.
Note / Clarification: Yahya bin Muhammad is Ibn Yahya al-Dhuhli, and Abu Awanah is al-Waddah bin Abdullah al-Yashkuri.
وأخرجه أحمد 15 / (9023)، والترمذي (1336)، وابن حبان (50761) من طرق عن أبي عوانة، بهذا الإسناد.
Reference / Source: Imam Ahmad (15/9023), al-Tirmidhi (1336) and Ibn Hibban (50761) narrated it through various routes from Abu Awanah, with this same chain.
