فحدَّثَناه أبو عَون محمد بن أحمد بن ماهان الجزار بمكة حرسها الله تعالى، حدثنا علي بن عبد العزيز، حدثنا محمد بن سعيد الأصبهاني، حدثنا يحيى ابن (2) زكريا بن أبي زائدة، عن ليث، عن أبي زُرعة، عن ثَوْبان (3)، عن النبي ﷺ، قال: "لُعِنَ الراشي والمُرتَشي والرائشُ الذي يمشي بينهما" (4). إنما ذكرتُ عمرَ بنَ أبي سَلَمة وليث بنَ أبي سُليم في الشواهد لا في الأصول. Sayyiduna Thawban (may Allah be pleased with him) narrates from the Prophet (peace and blessings be upon him) that he said: "Cursed are the one who gives a bribe, the one who takes a bribe, and the ra'ish, that is, the one who runs about between the two (to arrange the deal)." I have mentioned Umar bin Abi Salamah and Layth bin Abi Sulaym as supporting reports (shawahid), not as primary narrations.

(2) أقحم في نسخة (ز) لفظة "أبي" قبل زكريا، وجاء على الصواب في باقي النسخ. Important point: In manuscript (Z) the word "أبي" (Abu) was wrongly inserted before the name Zakariyya, whereas in all the other manuscripts the name is recorded correctly.
(3) وقع في نسخنا الخطية بدل "عن ثوبان": عن أبي هريرة، وهو خطأ. Important point: In our manuscripts "عن أبي هريرة" (from Abu Hurayrah) is written in place of "عن ثوبان", which is a clear mistake.
(4) صحيح لغيره، دون قوله: "والرائش"، وهذا إسناد ضعيف ليث - وهو ابن أبي سليم - ضعيف، كما أنه قد اضطرب في رواية هذا الحديث، وسقط شيخه في رواية الحاكم هنا، وهو أبو خطاب غير منسوب، ولم يرو عنه غير ليث وهو مجهول، وأبو زرعة - وهو يحيى بن أبي عمرو السيباني فيما يغلب على ظننا - روايته عن ثوبان مرسلة، بينهما أبو إدريس الخولاني كما فصلناه في "مسند أحمد". Grading: This hadith is "sahih li-ghayrihi", except for the words "والرائش" (the one who arranges the bribe). Technical note / Defect ('illah): This particular chain is weak; Layth bin Abi Sulaym is a weak narrator, and he was inconsistent (idtirab) in narrating this hadith. In al-Hakim's narration here, the name of his teacher has also dropped out, who is "Abu Khattab" (whose lineage is not mentioned); only Layth narrated from him, so he is "majhul" (unknown). Moreover, the narration of Abu Zur'ah (who, in our strong opinion, is Yahya bin Abi Amr al-Saybani) from Thawban is "mursal"; between them is the intermediary Abu Idris al-Khawlani, as we have explained in "Musnad Ahmad". فقد أخرجه أحمد 37 / (22399) من طريق أبي بكر بن عياش، عن ليث، عن أبي خطاب، عن أبي زرعة، بهذا الإسناد. Reference / Source: Imam Ahmad (37/22399) narrated it by way of Abu Bakr bin Ayyash, from Layth, from Abu Khattab, from Abu Zur'ah, with this same chain. وانظر الحديثين قبله.
