أخبرنا أبو بكر بن إسحاق، أخبرنا محمد بن غالب، حدثنا جعفر بن محمد بن جعفر المَدَائني، حدثنا عَبّاد بن العوّام، عن سفيان الثَّوري، عن هشام بن عُرْوة، عن أبيه، عن عائشة قالت: قال رسول الله ﷺ: "ليس (1) على ولدِ الزنى مِن وِزْرِ أبويه شيءٌ ﴿وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى﴾ (2). هذا حديث صحيح الإسناد، ولم يُخرجاه. وقد صحَّ ضِدُّه بإسنادين صحيحين، أما الإسنادُ الأول: [التعليق - من تلخيص الذهبي] ترقيم العلميه 7053 - صحيح وصح ضده
It is narrated from Sayyidah Aishah (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: "There is no burden of his parents' sin upon a child born of zina (a child born out of fornication)," (as the Qur'an says): "And no bearer of burdens will bear the burden of another." [Surah al-An'am: 164]
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it. However, the opposite (of this meaning) is also established through two sahih chains of narration.

(1) مكان "ليس" في (ز) بياض، وسقطت من (ص) و (م)، والمثبت من "تلخيص الذهبي" ومصادر التخريج. Important point: In manuscript (Z) the place of the word "ليس" is blank, while in manuscripts (S) and (M) the word has dropped out. We have recorded it in light of Imam al-Dhahabi's "Talkhis" and the other sources of the takhrij.
(2) صحيح موقوفًا، وقد تفرَّد برفعه جعفر بن محمد المدائني، وهو ليس بذاك المشهور، ولا يحتمل تفرده، وقد ترجمه الخطيب في "تاريخ بغداد" 8/ 59 فلم يذكر فيه جرحًا ولا تعديلًا، وذكره ابن حبان في "ثقاته"، وقد خالفه في رفع هذا الحديث جمع من الثقات، فجعلوه من قول عائشة، لذلك قال البيهقي: رفعه بعض الضعفاء، والصحيح موقوف. وأما ما نقله الشيخ ناصر الألباني ﵀ في "السلسلة الضعيفة" (6115) من جرح الجورقاني في "الأباطيل" له، فهو وهم منه، فإنَّ ذاك المجروح هو جعفر بن محمد بن جعفر بن محمد بن علي بن الحسين القرشي الهاشمي، وأما جعفر الذي روى هذا الحديث فهو ثقفي كما ذكر الخطيب البغدادي. Grading: This report is sahih as "mawquf". Technical note / Defect ('illah): Ja'far bin Muhammad al-Mada'ini is alone in making it "marfu'"; he is not well known, and his solitary narration cannot be accepted. Al-Khatib mentioned him in "Tarikh Baghdad" (8/59) but recorded no criticism or commendation of him, and Ibn Hibban mentioned him in "al-Thiqat". A group of thiqah (trustworthy) narrators contradicted him and made it the statement of A'ishah (may Allah be pleased with her) (mawquf). Imam al-Bayhaqi says that some weak narrators made it marfu', while the correct version is that it is mawquf. Note / Clarification: The criticism of him that Shaykh al-Albani (may Allah have mercy on him) transmitted in "al-Silsilah al-Da'ifah" (6115) on the authority of al-Jawraqani is a "mistake", because the narrator criticised by al-Jawraqani is "Ja'far bin Muhammad al-Qurashi al-Hashimi", while the narrator of this hadith is "Ja'far al-Thaqafi", as al-Khatib al-Baghdadi stated explicitly. وأخرجه أبو بكر قاضي المارستان في "مشيخته" (422) من طريق عثمان بن أحمد الدقاق، عن محمد بن غالب بن حرب، بهذا الإسناد. Reference / Source: Abu Bakr Qadi al-Maristan narrated it in his "Mashyakhah" (422) by way of Uthman bin Ahmad al-Daqqaq, from Muhammad bin Ghalib bin Harb, with this same chain. وأخرجه الطبراني في "الأوسط" (4165) عن علي بن سعيد، عن جعفر بن محمد المدائني، به. Reference / Source: Al-Tabarani narrated it in "al-Mu'jam al-Awsat" (4165) by way of Ali bin Sa'id, from Ja'far bin Muhammad al-Mada'ini. وقال: لم يرفع هذا الحديث عن سفيان الثَّوري إلّا عباد بن العوام تفرَّد به جعفر بن محمد المدائني. Technical note / Defect ('illah): Imam al-Tabarani says that no one other than Abbad bin al-Awwam made this hadith marfu' from Sufyan al-Thawri, and Ja'far bin Muhammad al-Mada'ini is alone in this narration. وأخرجه عبد الرزاق (13861)، وأخرجه ابن المنذر في "الأوسط" (1938) من طريق عبد الله بن المبارك، والبيهقي 10/ 58 من طريق أبي نعيم، ثلاثتهم (عبد الرزاق وابن المبارك وأبو نعيم) عن سفيان الثوري به موقوفًا على عائشة. Details of the narration: Abd al-Razzaq (13861), Ibn al-Mundhir in "al-Awsat" (1938) by way of Abdullah bin al-Mubarak, and al-Bayhaqi (10/58) by way of Abu Nu'aym narrated it. All three of them (Abd al-Razzaq, Ibn al-Mubarak and Abu Nu'aym) narrate it from Sufyan al-Thawri as "mawquf" on A'ishah (may Allah be pleased with her). وأخرجه عبد الرزاق (13860) عن معمر، وابن أبي شيبة 2/ 216 و 3/ 455 عن وكيع، وابن أبي داود في "مسند عائشة" (53)، وابن أبي حاتم في "تفسيره" 5/ 1435 من طريق عبدة بن سليمان، ثلاثتهم عن عروة، به موقوفًا على عائشة. Details of the narration: Abd al-Razzaq (13860) narrated it from Ma'mar, Ibn Abi Shaybah (2/216 and 3/455) from Waki', and Ibn Abi Dawud in "Musnad A'ishah" (53) and Ibn Abi Hatim in his "Tafsir" (5/1435) by way of Abdah bin Sulayman. All three of them narrate it from Urwah as "mawquf" on A'ishah (may Allah be pleased with her). وانظر ما سلف عن عائشة ﵂ برقم (2891).
