Mustadrak al-Hakim — Hadith 7180

حدثنا الشيخ أبو بكر بن إسحاق، أخبرنا محمد بن شاذانَ الجَوْهريُّ، حدثنا عامر بن إبراهيم الأَبناوي (2)، حدثنا فَرَج بن فَضَالة، عن محمد بن عبد الأعلى، عن أبيه، عن عبد الله بن عمرو: أنَّ رجلين اختَصَما إلى النبيِّ ﷺ، فقال لعمرو: "اقضِ بينهما" فقال: أَقضي بينهما وأنت حاضرٌ يا رسول الله؟ قال: "نَعَمْ، على أنَّك إن أصبتَ فلَكَ عَشرُ أجورٍ، وإن اجتهدتَ فأخطأتَ فَلَكَ أجرٌ" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه بهذه السِّياقة.

It is narrated from Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) that two men brought their dispute to the Prophet (peace and blessings be upon him). He (peace and blessings be upon him) said to Sayyiduna Amr bin al-As: "You judge between them." He said: O Messenger of Allah! Shall I judge in your presence? He said: "Yes, on the condition that if you judge correctly, you will have ten rewards, and if you strive (make ijtihad) but err, you will have one reward."
This hadith is sahih al-isnad (authentic in its chain), but the two Shaykhs did not record it with this wording.

(2) المثبت من (ز)، وفي (م) و (ب): الأنباري بالراء، وأما (ص) فيمكن أن تقرأ بالوجهين، وما أثبتناه من (ز) هو الصواب، فقد نصَّ عليه ابن ماكولا في "الإكمال" 1/ 140 - 141، وكذلك وقع في ترجمة شيخه الفرج بن فضالة من "تهذيب الكمال" 23/ 157، ووقع في مطبوع "تاريخ بغداد" - بتحقيق بشار معروف - 14/ 157: الأنباري، بالراء.
Technical note / Defect ('illah): The name established in the text is from manuscript (Z), while (M) and (B) have 'al-Anbari' (with ra'). Manuscript (S) can be read both ways. The correct form is what is in manuscript (Z), because Ibn Makula stated it explicitly in "al-Ikmal" (1/140-141).
Reference / Source: Likewise, this name is mentioned in the biography of his shaykh al-Faraj bin Fadalah in "Tahdhib al-Kamal" (23/157), whereas in "Tarikh Baghdad" (Bashshar Ma'ruf edition 14/157) it is printed as 'al-Anbari'.

(1) إسناده ضعيف ومتنه منكر، الفرج بن فضالة ضعيف وبه أعلَّه الذهبي في "تلخيصه"، وقد اضطرب فيه الفرج كما سيأتي بيانه. ومحمد بن عبد الأعلى وأبوه لا يعرفان، ووقع في "سنن الدارقطني": محمد بن عبد الأعلى بن عدي، وليس في الرواة من اسمه عبد الأعلى بن عدي غير البهراني قاضي حمص، ترجمه البخاري في "الكبير" 6/ 72، وابن أبي حاتم 6/ 25، وابن حبان 5/ 129، ولم يذكروا له رواية سوى عن ثوبان، ولم يذكروا في الرواة عنه ابنًا له يُسمى محمدًا.
Grading: Its chain is weak and its text is 'munkar'.
Technical note / Defect ('illah): Al-Faraj bin Fadalah is weak, and for this reason Imam al-Dhahabi declared it defective in "al-Talkhis"; al-Faraj also fell into inconsistency (idtirab) in it. Muhammad bin Abd al-A'la and his father are 'unknown' (majhul). In Sunan al-Daraqutni this name appears as 'Muhammad bin Abd al-A'la bin Adi', whereas among the narrators the only one named 'Abd al-A'la bin Adi' is al-Bahrani (the judge of Hims), who was mentioned by Imam al-Bukhari in "al-Kabir" (6/72), Ibn Abi Hatim (6/25) and Ibn Hibban (5/129); but they all mention his narration only from Thawban (may Allah be pleased with him), and no son named 'Muhammad' is mentioned among his students.
وأخرجه الدارقطني (4457) من طريق يزيد بن هارون عن فرج بن فضالة، بهذا الإسناد.
Reference / Source: Imam al-Daraqutni (4457) narrated it via Yazid bin Harun from al-Faraj bin Fadalah with this same chain.
وأخرجه ابن سعد في "طبقاته" 5/ 57، وأحمد 29 / (17824)، وعبد بن حميد (292) من طرق عن فرج بن فضالة، عن محمد بن عبد الأعلى، عن أبيه، عن عبد الله بن عمرو بن العاص، عن أبيه عمرو. فجعله من مسند عمرو بن العاص. بلفظ: "عشر حسنات".
Details of the narration: Ibn Sa'd in "al-Tabaqat" (5/57), Imam Ahmad (29/17824) and Abd bin Humayd (292) narrated it through various routes from al-Faraj bin Fadalah, in which he made it a narration of the 'Musnad of Amr bin al-As', and its wording is "ten good deeds".
وأخرجه أحمد (17825)، وابن عبد الحكم في "فتوح مصر" ص 228، والدارقطني (4459) من طرق عن فرج بن فضالة، عن ربيعة بن يزيد عن عقبة بن عامر. فجعله من مسند عقبة بن عامر.
Details of the narration: Imam Ahmad (17825), Ibn Abd al-Hakam in "Futuh Misr" (p. 228) and al-Daraqutni (4459) narrated it via al-Faraj bin Fadalah, but here he made it a narration of the 'Musnad of Uqbah bin Amir'.
وأخرجه أحمد 11 / (6755)، وابن عبد الحَكَم ص 228 من طريق عبد الله بن لهيعة، عن الحارث بن يزيد، عن سلمة بن أُكسوم، عن القاسم بن البَرَحي، عن عبد الله بن عمرو. وسنده ضعيف لضعف ابن لهيعة، والقاسم لم يوثقه سوى ابن حبان، وضعَّفه ابن عبد الهادي في "المحرر" (1176).
Grading: Its chain is weak.
Technical note / Defect ('illah): The chain is weak because Ibn Lahi'ah is weak; moreover, al-Qasim bin al-Barahi was declared trustworthy only by Ibn Hibban, while Ibn Abd al-Hadi declared him weak in "al-Muharrar" (1176).
Reference / Source: Imam Ahmad (11/6755) and Ibn Abd al-Hakam (p. 228) narrated it via Ibn Lahi'ah.
وأخرجه الدارقطني (4460) من طريق ابن لهيعة، عن أبي مصعب المعافري، عن محرر بن أبي هريرة، عن أبي هريرة. وفي سنده ابن لهيعة، وهو ضعيف كما سبق، وهذا يخالف ما رواه الشيخان عن أبي هريرة كما سيأتي.
Technical note / Defect ('illah): Al-Daraqutni (4460) narrated it via Ibn Lahi'ah as part of the 'Musnad of Abu Hurayrah', but in its chain Ibn Lahi'ah is weak, and this narration also contradicts the sahih narration from Abu Hurayrah (may Allah be pleased with him) reported by the two Shaykhs (al-Bukhari and Muslim).
والحديث الصحيح الثابت هو حديث أبي قيس مولى عمرو بن العاص عن مولاه عمرو، الذي أخرجه البخاري (7352) ومسلم (1716) وغيرهما بلفظ: "إذا حكم الحاكم فاجتهد ثم أصاب فله أجران، وإذا حكم فاجتهد ثم أخطأ فله أجر".
Grading: Sahih and established hadith.
Important point: The actual sahih hadith is the one narrated by Abu Qays (the freed slave of Amr bin al-As) from his master Amr bin al-As (may Allah be pleased with him), which Imam al-Bukhari (7352) and Imam Muslim (1716) narrated: "When a ruler judges, exercises ijtihad and his judgement is correct, he receives a double reward; and if he exercises ijtihad and errs, he receives one reward."
ومثله حديث أبي سلمة عن أبي هريرة عند البخاري بإثر (7352)، ومسلم بإثر (1716).
Corroborating chains and supporting reports: A similar narration was reported by Abu Salamah from Abu Hurayrah (may Allah be pleased with him), which is in Sahih al-Bukhari (after 7352) and Sahih Muslim (after 1716).
