Mustadrak al-Hakim — Hadith 7100

حدَّثنا أبو الفضل محمد بن إبراهيم المُزكِّي، حدَّثنا إبراهيم بن أبي طالب، حدَّثنا أبو كُريب، حدَّثنا بكر بن عبد الرحمن، حدَّثنا عيسى بن المختار، عن ابن أبي ليلى، عن الحَكَم، عن عبد الله بن شدَّاد - وهو أخو أمامة بنت حمزة لأمِّها - عن أخته أُمامةَ بنت حمزة: أنَّ مولًى لها تُوفِّي ولم يترُكْ إِلَّا ابنةً واحدة، فقضَى رسولُ الله ﷺ أن لابنته النِّصفَ، ولابنة حمزةَ النِّصفَ (1). ذكرُ [أمِّ] رِمْثَةَ، وقيل: رُمَيْثةُ، ﵂
Sayyiduna Abdullah bin Shaddad narrates from his sister Sayyidah Umamah bint Hamzah (may Allah be pleased with her) that a freed slave of hers died and left no heir except one daughter. So the Messenger of Allah (peace and blessings be upon him) ruled that half of the estate belonged to his daughter and the remaining half (on the basis of wala', the tie of clientage) to Sayyidah Umamah bint Hamzah.

(1) صحيح لغيره، وهذا إسناد ضعيف؛ ابنُ أبي ليلى - وهو محمد بن عبد الرحمن - سيئ الحفظ، وقد أسند الخبر، وخالفه غيرُ واحد من الثقات، فرووه عن عبد الله بن شداد مرسلًا كما بيَّناه في تعليقنا على "سنن ابن ماجه"، وصحَّح إرسالَه النسائيُّ بإثر الحديث (6366)، والدارقطنيُّ في "العلل" (4099)، وانفرد عيسى بن المختار عن ابن أبي ليلى فسمّى بنت حمزة أمامة، ورواه الثقات عن ابن أبي ليلى وعن غيره، فقالوا: ابنة حمزة، ولم يسمُّوها أمامة. وقال المزي في "تهذيب الكمال" 35/ 397: قيل: اسمها أمامة، وقيل: أَمَة الله، وقيل: أم الفضل.
Grading: This hadith is "sahih li-ghayrihi", but this particular chain is weak.
Technical note / Defect ('illah): Ibn Abi Layla (Muhammad bin 'Abd al-Rahman) had a poor memory. He reported this report as "musnad" (connected), whereas, contrary to him, several thiqah narrators narrated it from Abdullah bin Shaddad as "mursal", as we have made clear in our notes on Sunan Ibn Majah. Imam al-Nasa'i (after 6366) and al-Daraqutni (al-'Ilal 4099) held that its being mursal is correct. 'Isa bin al-Mukhtar, a student of Ibn Abi Layla, alone mentioned the name of Hamzah's daughter as "Umamah", while the other thiqah narrators said only "Ibnat Hamzah" (the daughter of Hamzah).
Important point: According to 'Allamah al-Mizzi, her name has also been given as Umamah, Amat Allah or Umm al-Fadl.
ونُرى أن هذا الإرسال لا يضرُّ إن شاء الله، فبنت حمزة صحابيةُ الحديث هي أختُ عبد الله بن شداد لأمه كما صحَّ من طريق شعبة عن الحكم، عند سعيد بن منصور (174)، وأبي داود في "المراسيل" (364)، وسفيان الثوري عن سلمة بن كهيل عند الطحاوي في "معاني الآثار" 4/ 404، وغالب الظن أنه أخذه عنها، هذا مع ما في الباب ما يشدُّه.
Important point: In our view this "irsal" (break in the chain) is not harmful, because the main narrator of this hadith (the daughter of Hamzah, may Allah be pleased with her) is the maternal half-sister of Abdullah bin Shaddad, as is established through the routes of Shu'bah from al-Hakam and Sufyan al-Thawri from Salamah bin Kuhayl. The most likely supposition is that Abdullah bin Shaddad took this narration from his sister herself; moreover, there are other supporting narrations in this chapter.
أبو كريب: هو محمد بن العلاء، وبكر بن عبد الرحمن: هو ابن عبد الله بن عيسى بن عبد الرحمن ابن أبي ليلى، والحكم: هو ابن عتيبة.
Technical note / Defect ('illah): (Identification of the narrators): Abu Kurayb means Muhammad bin al-'Ala', Bakr bin 'Abd al-Rahman means Bakr bin Abdullah bin 'Isa bin 'Abd al-Rahman bin Abi Layla, and al-Hakam means al-Hakam bin 'Utaybah.
وأخرجه ابن ماجه (2734)، والنسائي (6365) من طريق زائدة بن قدامة، عن محمد بن عبد الرحمن بن أبي ليلى، بهذا الإسناد.
Reference / Source: Ibn Majah (2734) and al-Nasa'i (6365) narrated it via Za'idah bin Qudamah, from Muhammad bin 'Abd al-Rahman bin Abi Layla, with this same chain.
وأخرجه النسائي (6366) من طريق عبد الله بن عون، عن الحكم بن عتيبة، عن عبد الله بن شداد بن الهاد: أن ابنة حمزة بن عبد المطلب أعتقت مملوكًا لها، فمات وترك ابنته ومولاته، فورثته ابنته النصف، وورثته ابنة حمزة النصف. قال النسائي وهذا أولى بالصواب من الذي قبله (يعني المرسل).
Details of the narration: Al-Nasa'i (6366) narrated it with the chain Abdullah bin 'Awn, from al-Hakam bin 'Utaybah, from Abdullah bin Shaddad: that the daughter of Hamzah bin 'Abd al-Muttalib freed a slave of hers; he died and left a daughter and his mistress (the daughter of Hamzah). His daughter received half and the daughter of Hamzah received half.
Technical note / Defect ('illah): Imam al-Nasa'i says that this (mursal) narration is closer to being correct than the previous narration.
وأخرجه ابن أبي شيبة 11/ 268 عن وكيع، عن إسماعيل بن أبي خالد، عن الشعبي مرسلًا: أنَّ مولى لابنة حمزة مات، وترك ابنته وابنة حمزة، فأعطى رسول الله ﷺ ابنة حمزة النصف، وابنتَه النصف. وإسناده صحيح إلى الشعبي.
Reference / Source: Ibn Abi Shaybah narrated it at 11/ 268 through Waki', from Isma'il bin Abi Khalid, from Imam al-Sha'bi as "mursal": that a freed slave of the daughter of Hamzah died and left a daughter and the daughter of Hamzah, so the Messenger of Allah (peace and blessings be upon him) gave each of them half.
Grading: Its chain up to Imam al-Sha'bi is "sahih".
وأخرجه أحمد 45/ (27284) عن عبد الصمد بن عبد الوارث، عن همام بن يحيى، عن قتادة، عن سلمى بنت حمزة: أن مولاها مات وترك ابنة، فورَّث النبيُّ ﷺ ابنتَه النصفَ، وورَّث يعلى النصف، وكان ابن سلمى. فسمّاها قتادة سلمى وانفرد بذلك، ورجاله ثقات لكنه منقطع أو معضل بين قتادة وسلمي.
Reference / Source: Imam Ahmad narrated it at 45/ (27284) with the chain 'Abd al-Samad bin 'Abd al-Warith, from Hammam bin Yahya, from Qatadah, under the name "Salma bint Hamzah". Qatadah is alone in mentioning this name (Salma).
Grading: Its narrators are thiqah, but this chain is "munqati'" or "mu'dal", because the link between Qatadah and Salma is missing.
ويشهد له أيضًا مرسلُ أبي بردة بن أبي موسى الأشعري عند ابن أبي شيبة 11/ 267 - 268، وأبي داود في "المراسيل" (363)، والبيهقي 6/ 241، قال: توفي رجلٌ وترك ابنته ومواليه، فقسم النبيُّ ﷺ المال بينهما نصفين؛ بينَ ابنتِه ومواليه. وإسناده صحيح إلى أبي بردة.
Corroborating chains and supporting reports: It is also supported by the "mursal" narration of Abu Burdah bin Abi Musa al-Ash'ari, which is in Ibn Abi Shaybah (11/ 267-268), Abu Dawud (al-Marasil 363) and al-Bayhaqi (6/ 241): A man died leaving his daughter and the masters who had freed him, and the Prophet (peace and blessings be upon him) divided the wealth between the two of them in halves.
Grading: Its chain up to Abu Burdah is "sahih".
