(2) كذا رواه الحاكم، ورواه الناس بلفظ: "تغتسل عند كل طهر"، ورجاله ثقات غير جعفر بن سليمان الضُّبعي، فله أحاديثُ مناكير، وهذا منها، فقد أنكر حديثه هذا غير واحد من أهل العلم، فقد جاء في "العلل ومعرفة الرجال" (4122): سُئل أحمد عن حديث أبي الزبير عن جابر عن فاطمة بنت قيس في المُستحاضة، فقال: ليس بصحيح، أو ليس له أصل، يعني حديث جعفر بن سليمان عن ابن جريج. وقال أبو حاتم الرازي كما في "العلل" لابنه (120): ليس هذا بشيء.
Details of the narration: (2) Al-Hakim narrated it thus, whereas others narrated it with the words "تغتسل عند كل طهر" (she should bathe at every purification).
Technical note / Defect ('illah): Its narrators are thiqah except "Ja'far bin Sulayman al-Dubaʿi", who has some "munkar" hadiths, and this narration is one of them. A number of the people of knowledge rejected this hadith of his. Thus in "al-'Ilal wa Ma'rifat al-Rijal" (4122): Imam Ahmad was asked about the hadith of Abu al-Zubayr, from Jabir, from Fatimah bint Qays concerning the woman with istihadah, and he said: "It is not sahih", or "It has no basis." He meant the hadith of Ja'far bin Sulayman from Ibn Jurayj. And Abu Hatim al-Razi said, as in his son's book "al-'Ilal" (120): "This is nothing (laysa hadha bi-shay')."
والأمر الآخر أنه جعله من مسند فاطمة بنت قيس، وإنما هي فاطمة بنت أبي حبيش، فقد قال الدَّارَقُطْنيّ في "السنن": تفرد به جعفر بن سليمان، ولا يصح عن ابن جريج عن أبي الزبير، وهم فيه، وإنما هي فاطمة بنت أبي حبيش. وقال ابن عبد الهادي في "تعليقة على العلل" ص 106 - 107: إنَّ التي سألت فاطمة بنت أبي حبيش، لا بنت قيس، وهو أشبه؛ فإنَّ بنت قيس لا مدخل لها في حديث الاستحاضة، والحديثُ في الجملة لا أصل له، والله أعلم. قلنا: وقع في "علل" ابن أبي حاتم وحده: فاطمة بنت أبي حبيش، بدل بنت قيس، وهذا يحتمل أحد أمرين: الأول عدله أحد النساخ قديمًا، أو أنَّ الإمام أبا حاتم ذكره على الصواب الذي ينبغي أن يكون، وليس كما رواه الضُّبعي، والله أعلم.
Technical note / Defect ('illah): The second matter is that the narrator made it part of the Musnad (narrations) of "Fatimah bint Qays", whereas she (the questioner) was actually "Fatimah bint Abi Hubaysh". Al-Daraqutni said in "al-Sunan": "Ja'far bin Sulayman is alone in narrating it, and it is not sahih from Ibn Jurayj from Abu al-Zubayr; he erred in it, it is actually Fatimah bint Abi Hubaysh." Ibn 'Abd al-Hadi said in "Ta'liqah 'ala al-'Ilal" (pp. 106-107): "The one who asked was Fatimah bint Abi Hubaysh, not bint Qays, and this is more likely, for bint Qays has no connection with the hadith of istihadah, and this hadith (with this chain) on the whole has no basis. And Allah knows best."
Important point: We say: In the "'Ilal" of Ibn Abi Hatim alone, "Fatimah bint Abi Hubaysh" occurs in place of bint Qays. This allows for one of two possibilities: first, that some early copyist corrected it; or that Imam Abu Hatim mentioned it with the correct name as it should be, not as al-Dubaʿi narrated it. And Allah knows best.
واجتهد الحافظ ابن حجر في حلِّ هذا الإشكال، فقال في "فتح الباري" 2/ 110: وقع في "سنن أبي داود" (بل النسائي 207) عن فاطمة بنت قيس، فظنّ بعضُهم أنَّها القُرشيّة الفِهْريَّة، والصواب أنَّها بنت أبي حُبَيش، واسم أبي حبيش قيس. قلنا: وعليه فلا إشكال، وقد وقع في حديثي أم سلمة وعائشة التاليين عند المصنف نسبة فاطمة ببنت قيس أيضًا، لكن يُعكر عليه أنَّ المصنف انفرد بنسبتها هكذا في حديثي أم سلمة وعائشة، وروى الحديثين غيره من الناس فنسبوها بنت أبي حبيش كما سيأتي التنبيه عليه هناك. والأمر الآخر أنه يبعد على كلِّ هؤلاء الحفاظ أن لا يتنبهوا لهذا الأمر، والله تعالى أعلم بالصواب.
Note / Clarification: Al-Hafiz Ibn Hajar made an effort (ijtihad) to resolve this difficulty and said in "Fath al-Bari" (2/ 110): "In the Sunan of Abu Dawud (rather, al-Nasa'i: 207) 'Fatimah bint Qays' occurs, so some thought that she was the (well-known female Companion) of Quraysh, of Banu Fihr, whereas the correct view is that she is bint Abi Hubaysh, and the name of Abu Hubaysh is Qays."
Important point: We say: On this explanation no difficulty remains, and with the author (al-Hakim), in the next two hadiths of Umm Salamah and 'A'ishah (may Allah be pleased with them), Fatimah is also named "bint Qays". But the objection to this explanation is that the author is alone in naming her this way in the hadiths of Umm Salamah and 'A'ishah, while the other hadith scholars who narrated these two hadiths named her "bint Abi Hubaysh" (as will be pointed out there). The other point is that it is unlikely that so many great huffaz of hadith would fail to notice this matter (that the name of Abu Hubaysh is Qays). And Allah the Exalted knows best what is correct.
والحديث أخرجه أبو العبّاس السراج في "حديثه" (431)، والطبراني في "الأوسط" (2960) و (7818)، وفي "الصغير" (235)، والبيهقي 1/ 335 من طرق عن وهب بن بقية، بهذا الإسناد. وقع عند بعضهم: عن جابر عن فاطمة بنت قيس، وعند بعضهم الآخر: عن جابر: أنَّ فاطمة سألت النَّبيَّ ﷺ، وهذا من اضطراب جعفر الضبعي، والله أعلم. وقال الطبراني: لم يروه عن ابن جريج إلَّا جعفر بن سليمان. وقال البيهقي: قال أبو بكر بن إسحاق: جعفر بن سليمان فيه نظر، ولا يُعرف هذا الحديث لابن جريج ولا لأبي الزبير من وجهٍ غير هذا، وبمثله لا تقوم حجة، واختلف عليه فيه.
Reference / Source: This hadith was narrated by Abu al-'Abbas al-Sarraj in his "Hadith" (431), al-Tabarani in "al-Awsat" (2960) and (7818) and "al-Saghir" (235), and al-Bayhaqi (1/ 335), via various routes from Wahb bin Baqiyyah, with this same chain. In some of them the wording is "from Jabir, from Fatimah bint Qays", and in others "from Jabir: that Fatimah asked the Prophet (peace and blessings be upon him)".
Technical note / Defect ('illah): This is "idtirab" (inconsistency) on the part of Ja'far al-Dubaʿi, and Allah knows best. Al-Tabarani said: "No one narrated it from Ibn Jurayj except Ja'far bin Sulayman." And al-Bayhaqi said: "Abu Bakr bin Ishaq says: Ja'far bin Sulayman is open to question ('fihi nazar'), and this hadith is not known from Ibn Jurayj or Abu al-Zubayr by any route other than this; such a narration does not establish a proof, and there was disagreement over him (Ja'far) in it."
وأخرجه ابن عدي في "الكامل" 2/ 148 من طريق الحسن بن عمر بن شقيق، والدارقطني في "سننه" (848) - ومن طريقه البيهقي 1/ 355 - من طريق قَطَن بن نُسير الغبري، كلاهما عن جعفر بن سليمان به. وقال ابن عدي: وهذا الحديث لم يحدث به عن ابن جريج بهذا الإسناد غير جعفر بن سليمان، ويقال: إنه أخطأ فيه أراد به إسنادًا آخر عن ابن جريج، لعله يرويه عن الزهري عن عروة عن عائشة، فلعل جعفرًا أراد هذا الحديث فأخطأ عليه، فقال: عن أبي الزبير عن جابر. وقال البيهقي: وهكذا رواه قطن بن نسير عن جعفر بن سليمان، فقال في الحديث: إنَّ فاطمة بنت قيس سألت، ولا يعرف إلَّا من جهة جعفر بن سليمان، والله أعلم.
Reference / Source: Ibn 'Adi narrated it in "al-Kamil" (2/ 148) via al-Hasan bin 'Umar bin Shaqiq, and al-Daraqutni in his "Sunan" (848) (and via him al-Bayhaqi, 1/ 355) via Qatan bin Nusayr al-Ghubari; both of them (al-Hasan and Qatan) narrate it from Ja'far bin Sulayman.
Technical note / Defect ('illah): Ibn 'Adi said: "No one other than Ja'far bin Sulayman narrated this hadith from Ibn Jurayj with this chain. It is said that he made a mistake in it; perhaps he intended another chain from Ibn Jurayj, perhaps he narrates it 'from al-Zuhri, from 'Urwah, from 'A'ishah', so perhaps Ja'far intended this hadith but erred and said 'from Abu al-Zubayr, from Jabir'." Al-Bayhaqi says: "Thus Qatan bin Nusayr narrated it from Ja'far bin Sulayman, saying in the hadith: 'Fatimah bint Qays asked', and this hadith is known only through Ja'far bin Sulayman. And Allah knows best."

قال الحافظ في "فتح الباري" 2/ 105: وفي الحديث دليل على أنَّ المرأة إذا مَيَّزت دم الحيض من دم الاستحاضة تَعتبِر دم الحيض وتعمل على إقباله وإدباره، فإذا انقَضَى قَدْره اغتسلت عنه ثم صار حُكْم دم الاستحاضة حُكْم الحَدَث فتتوضأ لكل صلاة، لكنها لا تصلي بذلك الوضوء أكثر من فريضة واحدة مُؤداة أو مَقْضيَّة، لظاهر قوله: "ثمَّ توضَّئي لكلِّ صلاة"، وبهذا قال الجمهور.
General principle: Al-Hafiz Ibn Hajar says in "Fath al-Bari" (2/ 105): This hadith is evidence that when a woman can distinguish the blood of menstruation from the blood of istihadah, she takes the blood of menstruation into account and acts according to its onset and its end. When the duration of menstruation has passed, she bathes from it; then the blood of istihadah takes the ruling of "hadath" (what breaks wudu), so she performs wudu for every prayer. However, she may not pray more than one obligatory prayer (whether performed on time or made up) with that wudu, because of the apparent wording of the hadith: "Then perform wudu for every prayer." This is the position of the majority of scholars.
وعند الحنفيَّة: أنَّ الوضوء مُتعلِّق بوقت الصلاة فلها أن تُصلِّي به الفريضة الحاضرة وما شاءَت من الفوائت ما لم يَخرُج وقت الحاضرة، وعلى قولهم المراد بقوله: "وتوضَّئي لكلٍّ صلاة" أي: لوَقْت كل صلاة، ففيه مَجاز الحذف، ويحتاج إلى دليل.
General principle: According to the Hanafis, wudu is tied to the time of the prayer, so the woman with istihadah may pray with this wudu the current obligatory prayer and as many missed prayers as she wishes, as long as the time of the current prayer has not ended. According to their view, the hadith "Perform wudu for every prayer" means "for the time of every prayer", so an "ellipsis" (the word "time" being implied) is assumed in it, which requires separate evidence.
وعند المالكيَّة: يُستَحب لها الوضوء لكلِّ صلاة، ولا يجبُ إِلَّا بِحَدَثٍ آخر.
General principle: According to the Malikis, it is recommended for the woman with istihadah to perform wudu for every prayer, and this wudu does not become obligatory unless some other "hadath" (cause that breaks wudu) besides istihadah occurs.
وقال أحمد وإسحاق: إن اغتسلت لكلِّ فرض فهو أحوَط.
General principle: Imam Ahmad bin Hanbal and Ishaq bin Rahawayh say: If she (the woman with istihadah) bathes for every obligatory prayer, this is more cautious.
