أخبرنا أبو سعيد أحمد بن محمد الأحْمَسي، أخبرنا الحسين بن حُميد (2)، أخبرنا أبو غسّان، حَدَّثَنَا عبّاد عن الشَّيباني، سمعتُ الشَّعبيَّ يقول: كان القضاءُ في ستَّةِ نَفَرٍ من أصحاب رسول الله ﷺ، ثلاثةٌ بالمدينة وثلاثةٌ بالكوفة، فبالمدينة: عمرُ وأبيٌّ وزيدُ بن ثابت، وبالكوفة: عليٌّ وعبدُ الله وأبو موسى. قال الشَّيباني: فقلت للشَّعبي: أبو موسى يُضاف إليهم؟ قال: كان أحدَ الفقهاء (3).
It is narrated from Imam al-Sha'bi (may Allah have mercy on him) that he said: Legal verdicts and judgeship rested upon six Companions of the Messenger of Allah (peace and blessings be upon him), three in Madinah and three in Kufah. In Madinah were Sayyiduna Umar, Ubayy bin Ka'b and Zayd bin Thabit (may Allah be pleased with them), and in Kufah were Sayyiduna Ali, Abdullah bin Mas'ud and Abu Musa al-Ash'ari (may Allah be pleased with them). The narrator says: I asked al-Sha'bi: Was Abu Musa also counted among them? He said: He was one of the jurists.

(2) في (ص) و (م): عبيد، وهو تحريف صوابه ما أثبتنا، فالحسين بن حميد بن الربيع اللخمي معروف بالرواية عنه أحمد بن محمد بن عمرو الأحمسي، وليس في شيوخ الأحمسي هذا من يقال له: الحسين بن عبيد. ووقع في (ز) و (ب): الحسين بن عبيد الله، وهو خطأ أيضًا. Important point: In manuscripts (S) and (M) it is written "'Ubayd", which is a distortion; the correct name is "Humayd", since Ahmad bin Muhammad al-Ahmasi is well known for narrating from al-Husayn bin Humayd bin al-Rabi' al-Lakhmi, and among his teachers there is no narrator named al-Husayn bin 'Ubayd. In manuscripts (Z) and (B) it is written "al-Husayn bin 'Ubayd Allah", which is also wrong.
(3) أثر الشعبي - وهو عامر بن شراحيل - سلف بنحوه برقم (5897). أبو غسان: هو مالك بن إسماعيل النهدي، وعبّاد: هو ابن العوام، والشيباني هو أبو إسحاق سليمان بن أبي سليمان. Note / Clarification: This athar (report) of Imam al-Sha'bi ('Amir bin Sharahil) has already passed in similar form at number (5897). Important point: Abu Ghassan refers to Malik bin Isma'il al-Nahdi, 'Abbad refers to Ibn al-'Awwam, and al-Shaybani refers to Abu Ishaq Sulayman bin Abi Sulayman.
