Mustadrak al-Hakim — Hadith 595

حَدَّثَنَا أبو بكر بن إسحاق، أخبرنا عبد الله بن محمد، حَدَّثَنَا إسحاق بن إبراهيم، أخبرنا جَرِير، عن عطاء بن السائب، عن سعيد بن جُبير، عن ابن عباس رفعه في قوله ﷿: ﴿وَإِنْ كُنْتُمْ مَرْضَى أَوْ عَلَى سَفَرٍ﴾ [النساء: 43] قال: "إذا كان بالرجلِ الجراحةُ في سبيل الله أو القُروحُ أو الجُدَريُّ، فيُجنِبُ فيخافُ إِن اغتسلَ أن يموت، فليتيمَّمْ" (2).
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both), concerning the saying of Allah Almighty: "And if you are ill or on a journey" [An-Nisa: 43], that if a man has a wound received in the path of Allah, or smallpox or the like, and he becomes in need of a ritual bath (ghusl) and fears that he will die if he bathes, then he should perform tayammum.

Grading: This narration is sahih as mawquf on Ibn 'Abbas (may Allah be pleased with them both).
Technical note / Defect ('illah): The narrator 'Ata' bin al-Sa'ib suffered from "ikhtilat" (deterioration of memory) at the end of his life, and Jarir bin 'Abd al-Hamid's narration of this from him is from after the ikhtilat.
وأخرجه البزار (5057)، وابن خزيمة (272)، وابن الجارود في "المنتقى" (129)، والدراقطني (678)، والبيهقي في "السنن" 1/ 22 و "معرفة السنن والآثار" (1648) و "الخلافيات" (829) من طريقين عن جرير، بهذا الإسناد.
Reference / Source: Imam al-Bazzar (5057), Ibn Khuzaymah (272), Ibn al-Jarud (al-Muntaqa 129), al-Daraqutni (678) and al-Bayhaqi in his books "al-Sunan" (1/22), "Ma'rifat al-Sunan wa al-Athar" (1648) and "al-Khilafiyyat" (829) narrated it via two routes from Jarir.
وخالف جريرًا فيه أبو الأحوص سلّام بن سليم عند ابن أبي شيبة 1/ 101، وعلي بن عاصم عند البيهقي في "السنن" 1/ 224، فروياه عن عطاء بن السائب موقوفًا على ابن عباس. وكذلك رواه أبو عوانة وورقاء عن عطاء كما قال أبو حاتم وأبو زرعة الرازيان فيما نقله ابن أبي حاتم في "العلل" (40) وقالا: هو الصحيح، وقال البيهقي: ورواه إبراهيم بن طهمان وغيره أيضًا عن عطاء موقوفًا.
Technical note / Defect ('illah): Jarir bin 'Abd al-Hamid was contradicted by Abu al-Ahwas Sallam bin Sulaym (Ibn Abi Shaybah 1/101) and 'Ali bin 'Asim (al-Bayhaqi 1/224), who narrated it from 'Ata' bin al-Sa'ib as "mawquf" (a statement of Ibn 'Abbas).
Important point: According to Abu Hatim and Abu Zur'ah al-Razi, the mawquf narration of Abu 'Awanah and Warqa' from 'Ata' is the "correct" one, and Imam al-Bayhaqi also reported it as mawquf from Ibrahim bin Tahman and others.
