Mustadrak al-Hakim — Hadith 5905

حدثنا علي بن حَمْشَاذَ العَدْلُ، حدثنا عُبيد بن شَريك، حدثنا سعيد بن أبي مريم، أخبرنا يحيى بن أيوب، عن عُقَيل، عن ابن شِهاب، قال: أخبرني عمرُ بن عبد الرحمن بن يعلى بن أُميّة، أنَّ أباه أخبَره، أنَّ يَعلى قال: كلَّمتُ رسولَ الله ﷺ في أبي أُميّةَ يومَ الفتح فقلتُ: يا رسول الله، بايعْ أبي على الهِجْرة، فقال رسولُ الله ﷺ: "أُبايِعُه على الجهاد؛ فقد انقَطَعتِ الهِجْرةُ" (3).

It is narrated from Sayyiduna Ya'la bin Umayyah (may Allah be pleased with him) that he said: On the day of the Conquest of Makkah I spoke to the Messenger of Allah (peace and blessings be upon him) about my father Umayyah and said: O Messenger of Allah! Take the pledge of allegiance from my father for emigration (hijrah). The Messenger of Allah (peace and blessings be upon him) said: "I will take his pledge for jihad, for (after the Conquest of Makkah) emigration has now come to an end."

(3) حديث جيد بطرقه، وهذا إسناد محتمل للتحسين من أجل عمرو بن عبد الرحمن - وهو ابن أميَّة، ابن أخي يعلى بن أُميَّة، كما جاء مقيدًا في بعض أسانيد هذا الخبر، وليس هو حفيدَ يعلى بن أُميَّة، والصواب في اسمه عمر و بواو، لا عُمر - فهو تابعيٌّ ذكره ابن حبان في "الثقات"، وخرَّج حديثه في "صحيحه"، وأبوه عبد الرحمن بن أُميَّة إن لم يكن صحابيًا فهو تابعي كبير مخضرم، له رواية عن عمر بن الخطاب، وقد ذكره ابن فتحون في الصحابة كما قال الحافظ ابن حجر في "الإصابة" 4/ 288، قال ابن حجر: قدّمنا غير مرةٍ أنَّ مَن أدرك النبيَّ ﷺ وبقي بعده، وكان قرشيًا أو حليفًا لهم فقد شهد مع النبي ﷺ حجة الوداع. وقد روي هذا الحديث من طريقين أُخريين.
Grading: This hadith is "jayyid" (good) by virtue of its routes. The present chain may be graded hasan on account of Amr bin Abd al-Rahman, who is "Ibn Umayyah", the nephew of Ya'la bin Umayyah, as is specified in some chains of this report; he is not the grandson of Ya'la bin Umayyah. The correct form of his name is "Amr" (with a waw), not "Umar". He is a Tabi'i whom Ibn Hibban mentioned in "al-Thiqat" and whose hadith he recorded in his "Sahih". His father Abd al-Rahman bin Umayyah, if not a Companion, is at least a senior mukhadram Tabi'i, and he narrates from Umar bin al-Khattab. Ibn Fathun counted him among the Companions (as Ibn Hajar said in "al-Isabah" 4/288). Ibn Hajar said: We have stated more than once that whoever lived in the time of the Prophet (peace and blessings be upon him) and survived after him, and was from Quraysh or an ally of theirs, attended the Farewell Pilgrimage with the Prophet (peace and blessings be upon him). This hadith has also been narrated through two other routes.
يحيى بن أيوب: هو الغافقي، وعُقيل: هو ابن خالد الأَيلي، وابن شهاب: هو محمد بن مسلم الزهري.
Technical note / Defect ('illah): Yahya bin Ayyub is al-Ghafiqi, Uqayl is Ibn Khalid al-Ayli, and Ibn Shihab is Muhammad bin Muslim al-Zuhri.
وأخرجه أحمد 29/ (17958) عن حجاج بن محمد المِصِّيصي، والنسائي (7743) و (8642) من طريق شعيب بن الليث بن سعد، كلاهما عن الليث بن سعد، عن عُقيل بن خالد، عن ابن شهاب الزهري، عن عمرو بن عبد الرحمن بن أمية، عن أبيه، عن أخيه يعلى بن أميّة.
Reference / Source: Ahmad (29/17958) narrated it from Hajjaj bin Muhammad al-Missisi; and al-Nasa'i (7743 and 8642) through the route of Shu'ayb bin al-Layth bin Sa'd. Both of them narrate it from al-Layth bin Sa'd, from Uqayl bin Khalid, from Ibn Shihab al-Zuhri, from Amr bin Abd al-Rahman bin Umayyah, from his father, from his brother Ya'la bin Umayyah.
وأخرجه أحمد (17962)، والنسائي (7734) و (8652)، وابن حبان (4864) من طريق عمرو بن الحارث المصري، وأحمد (17963) من طريق فُليح بن سليمان، كلاهما عن ابن شهاب الزهري، عن عمرو بن عبد الرحمن بن أميّة ابن أخي يعلى بن أميّة (هكذا قيَّده عمرو بن الحارث) عن أبيه، عن أخيه يعلى.
Reference / Source: Ahmad (17962), al-Nasa'i (7734 and 8652) and Ibn Hibban (4864) narrated it through the route of Amr bin al-Harith al-Misri; and Ahmad (17963) through the route of Fulayh bin Sulayman. Both of them narrate it from Ibn Shihab al-Zuhri, from Amr bin Abd al-Rahman bin Umayyah, the nephew of Ya'la bin Umayyah (as Amr bin al-Harith specified), from his father, from his brother Ya'la.
وله طريق أخرى عند ابن أبي شيبة 14/ 499، وأبي القاسم البغوي في "معجم الصحابة" (2172)، والطحاوي في "مشكل الآثار" (2621)، وابن قانع في "معجم الصحابة" 3/ 319 عن أم يحيى بنت يعلى، عن أبيها، لكن لفظ المرفوع فيه: "لا هجرة بعد الفتح، لكن جهاد ونيّةٌ". وإسناده حسن في المتابعات والشواهد.
Reference / Source: It has another route with Ibn Abi Shaybah (14/499), Abu al-Qasim al-Baghawi in "Mu'jam al-Sahabah" (2172), al-Tahawi in "Mushkil al-Athar" (2621) and Ibn Qani' in "Mu'jam al-Sahabah" (3/319), from Umm Yahya bint Ya'la, from her father. But the marfu' wording in it is: "There is no emigration (hijrah) after the Conquest, but rather jihad and intention."
Grading: Its chain is "hasan" as a corroborating and supporting report (in the mutaba'at and shawahid).
وله طريق أخرى عند ابن أبي عاصم في "الآحاد والمثاني" (1172) عن مجاهد، قال: أتى يعلى بن أميّة بأبيه إلى النبي ﷺ. ورجاله ثقات لكنه ظاهر الإرسال، ولفظ المرفوع فيه كلفظ حديث أم يحيى.
Reference / Source: It has another route with Ibn Abi Asim in "al-Ahad wa al-Mathani" (1172) from Mujahid, who said: Ya'la bin Umayyah brought his father to the Prophet (peace and blessings be upon him). Its narrators are thiqah (trustworthy), but it is apparently "mursal", and the marfu' wording in it is the same as the wording of the hadith of Umm Yahya.
