Mustadrak al-Hakim — Hadith 5850

حدثني محمد بن صالح بن هانئ، حدثنا محمد بن أحمد بن أنَس (2) القرشي، حدثنا أبو عاصم، أخبرنا ابن جُريج، أخبرني عبد الكريم بن أبي المُخارِق، عن الوليد بن مالك (3)، رجل من عبد القَيس، عن محمد بن قيس مولى سهل بن حُنيف، عن سهل بن حُنيف، أنَّ رسول الله ﷺ، حدّثه، قال: قال لي رسولُ الله ﷺ: "أنت رسُولي إلى مكةَ، فأَقْرِهم مني السلامَ، وقُل لهم: إنَّ رسول الله ﷺ يأمرُكم بثلاثٍ: لا تَحلفِوا بآبائكم، وإذا خَلوتُم فلا تَستقبِلوا القِبلةَ ولا تستَدبِروها، ولا تَستَنْجُوا بعَظْم ولا ببَعْر" (4). ذكرُ مناقب خَوّات بن جُبير الأنصاري ﵁ -

It is narrated from Sayyiduna Sahl bin Hunayf (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said to him: "You are my envoy to Makkah. So convey my greeting of peace to the people of Makkah and tell them that the Messenger of Allah (peace and blessings be upon him) commands you with three things: do not swear by your forefathers; when you are alone to relieve yourselves, do not face the qiblah nor turn your backs to it; and do not clean yourselves (istinja) with a bone or with dung."

(2) تحرَّف في نسخنا الخطية هنا إلى: أنيس، وهو خطأ صوّبناه من سائر المواضع التي روى فيها المصنفُ أخبارًا من طريق محمد بن أنس هذا.
Note / Clarification: Here in our manuscripts this name has been corrupted into "Unays"; this is an error, which we corrected from all the places where the author (al-Hakim) transmits narrations via Muhammad bin "Anas".

(3) في نسخنا الخطية و"تلخيص الذهبي": الوليد بن أبي مالك، بزيادة أداة الكُنية، وهي مُقحمة، والتصويب من مصادر تخريج الخبر ومن مصادر ترجمة هذا الراوي، وانظر "تعجيل المنفعة" لابن حجر 2/ 204.
Note / Clarification: In our manuscripts and al-Dhahabi's "al-Talkhis" it is "al-Walid bin Abi Malik" (with the word "Abi" added), which is an interpolation. The correction was made from the sources of the takhrij and the biographical works on this narrator. See Ibn Hajar's "Ta'jil al-Manfa'ah" (2/ 204).

(4) إسناده ضعيف لضعف عبد الكريم بن أبي المُخارِق، وجهالة الوليد بن مالك العَبْدي.
Grading: Its chain is da'if (weak).
Technical note / Defect ('illah): The reason is the weakness of Abd al-Karim bin Abi al-Mukhariq and the unknown status (jahalah) of al-Walid bin Malik al-Abdi.
أبو عاصم: هو الضحّاك بن مخلد النبيل، وابن جُريج: هو عبد الملك بن عبد العزيز بن جُريج المكي. وأخرجه أحمد 25/ (15984) عن روح بن عُبادة وعبد الرزاق، كلاهما عن ابن جُريج، بهذا الإسناد.
Technical note / Defect ('illah): Abu Asim is al-Dahhak bin Makhlad al-Nabil, and Ibn Jurayj is Abd al-Malik bin Abd al-Aziz bin Jurayj al-Makki.
Reference / Source: Ahmad (25/ 15984) narrated it from Rawh bin Ubadah and Abd al-Razzaq, both from Ibn Jurayj, with this same chain.
ويشهد للنهي عن الحلف بالآباء حديث ابن عمر أو أبيه عمر عند البخاري (6646) و (6647)، ومسلم (1646).
Corroborating chains and supporting reports: The prohibition of swearing by one's forefathers is supported by the hadith of Ibn Umar or his father Umar (may Allah be pleased with them), which is in al-Bukhari (6646 and 6647) and Muslim (1646).
وحديثُ عبد الرحمن بن سمُرة عند مسلم (1648).
Corroborating chains and supporting reports: And the hadith of Abd al-Rahman bin Samurah, which is in Muslim (1648).
وحديثُ أبي هريرة عند أبي داود (3248)، والنسائي (4692)، وابن حبان (4357)، وإسناده صحيح.
Corroborating chains and supporting reports: And the hadith of Abu Hurayrah, which is in Abu Dawud (3248), al-Nasa'i (4692) and Ibn Hibban (4357), and its chain is sahih.
ويشهد للنهي عن استقبال القبلة واستدبارها عند التخلي وكذا النهي عن التخلي وكذا النهي عن الاستنجاء بالعظم والبَعْر حديثُ سلمان الفارسي عند أحمد 39/ (23703)، ومسلم (262).
Corroborating chains and supporting reports: The prohibition of facing the qiblah or turning one's back to it while relieving oneself, and the prohibition of cleaning oneself (istinja') with bone or dung, is supported by the hadith of Salman al-Farisi, which is in Ahmad (39/ 23703) and Muslim (262).

Corroborating chains and supporting reports: And the hadith of Abu Hurayrah, which is in Ahmad (12/ 7368) and Muslim (265).
وللنهي عن استقبال القبلة واستدبارها عند التخلّي شاهد من حديث عبد الله بن الحارث بن جَزْء الزُّبيدي عند أحمد 29 (17701)، وابن ماجه (317)، وابن حبان (1419).
Corroborating chains and supporting reports: The prohibition of facing the qiblah or turning one's back to it while relieving oneself is also supported by the hadith of Abdullah bin al-Harith bin Jaz' al-Zubaydi, which is in Ahmad (29/ 17701), Ibn Majah (317) and Ibn Hibban (1419).
ومن حديث أبي أيوب الأنصاري عند أحمد 38/ (23514)، والبخاري (144)، ومسلم (264).
Corroborating chains and supporting reports: And the hadith of Abu Ayyub al-Ansari, which is in Ahmad (38/ 23514), al-Bukhari (144) and Muslim (264).
وللنهي عن الاستنجاء بالعظم والبَعْر شاهدٌ من حديث عبد الله بن مسعود عند أحمد 7/ (4149)،
Corroborating chains and supporting reports: The prohibition of istinja' with bone and dung is supported by the hadith of Abdullah bin Mas'ud, which is in Ahmad (7/ 4149).

وقد جاء في حديثي ابن مسعود وأبي هريرة تعليل النهي عن الاستنجاء بالعظم والروث بأنه طعام الجنّ.
Important point: In the hadiths of Ibn Mas'ud and Abu Hurayrah, the reason given for the prohibition of istinja' with bone and dung is that it is the food of the jinn.
