Mustadrak al-Hakim — Hadith 5721

It is narrated from Mus'ab bin Sa'd that before the Battle of Badr the polytheists seized Sayyiduna Hudhayfah (may Allah be pleased with him) and his father, and they wanted to kill them. Then they took from them a firm covenant and pledge by Allah that they would not help (the Prophet, peace and blessings be upon him) against them. So the two of them swore the oath to them, and they released them. Then the two of them came to the Prophet (peace and blessings be upon him), related the whole incident and said: We have sworn an oath to them; if you wish, we will fight alongside you (despite this covenant). He (peace and blessings be upon him) said: "We will fulfil (the covenant) (nafi), and we will seek Allah's help against them."

Hadith Grading
Explanation & Benefits
Shaykh Adil Murshid et al.
Note / Clarification: (1) In our manuscripts this word has been corrupted into "na'am" (yes), which reverses the meaning. In manuscript (Z) it is marked with a dabbah (a sign of doubt). The correct text is established from Ibn Sa'd's "al-Tabaqat al-Kubra" 4/ 249 (where he recorded this hadith from 'Abd Allah bin Numayr with this same chain), and also from the author's earlier narration of the hadith at number (4969).

Grading: (2) The hadith is sahih; the narrators of this chain are thiqah (trustworthy), but it is mursal, since Mus'ab bin Sa'd (Ibn Abi Waqqas) is a Successor (tabi'i).
Technical note / Defect ('illah): There is disagreement from Abu Ishaq ('Amr bin 'Abd Allah al-Sabi'i) over the naming of his shaykh in this hadith. Al-A'mash narrated it from Abu Ishaq and mentioned Mus'ab bin Sa'd, as in this narration of the author.
Reference / Source: Ibn Sa'd narrated it in "al-Tabaqat" 4/ 249, and likewise al-Tabarani in "al-Kabir" (3001) via the route of Muhammad bin 'Abd Allah bin Numayr. Both of them (Ibn Sa'd and Muhammad bin 'Abd Allah bin Numayr) narrate it from 'Abd Allah bin Numayr, with this same chain.
Reference / Source: Ahmad 38/ (3372) narrated it via the route of Sufyan al-Thawri, he from Abu Ishaq, who said: "Some of our companions narrated to me", from Hudhayfah.
Technical note / Defect ('illah): So he narrated it as connected (mawsul), but with Abu Ishaq leaving (his intermediary) unnamed (mubham).
Reference / Source: Al-Bazzar (2930), Abu al-Qasim al-Baghawi in "Mu'jam al-Sahabah" (413), Ibn al-Mundhir in "al-Awsat" (6241) and al-Tabarani (3012) narrated it via the route of Hammad bin Salamah, he from al-Hajjaj bin Artah, he from Abu Ishaq, he from Silah bin Zufar, and he from Hudhayfah.
Technical note / Defect ('illah): So he too narrated it as connected (mawsul), but mentioned Silah bin Zufar (as the intermediary).
Reference / Source: Al-Tabarani (3002) narrated it via the route of Yusuf bin Ishaq bin Abi Ishaq, he from his grandfather Abu Ishaq, he from 'Amir bin Sa'd bin Abi Waqqas in mursal form, like the narration of his brother Mus'ab bin Sa'd!
Note / Clarification: This hadith has passed at number (4969) via the route of Abu al-Tufayl 'Amir bin Wathilah from Hudhayfah bin al-Yaman; it is sahih through this route and is in Muslim.
