Mustadrak al-Hakim — Hadith 570

أخبرنا أبو العباس عبد الله بن الحسين القاضي بمَرْو، حدثنا الحارث بن أبي أسامة، حدثنا رَوْح بن عُبادة، حدثنا أبو عامر الخزَّاز، عن عطاء، عن أبي هريرة، أنَّ النبي ﷺ قال: "إذا استَجمَر أحدُكم فليُوتِرْ، فإنَّ الله وترٌ يحبُّ الوترَ، أمَا تَرى السماوات سبعًا، والأَرَضِينَ سبعًا والطوافَ" وذكر أشياءَ (3).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه بهذه الألفاظ، إنما اتَّفقا على "من استجمر فليُوتر" فقط (1).

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "When one of you uses stones for cleansing (istinja), let him use an odd number, for Allah is Witr (One) and loves what is odd. Do you not see that the heavens are seven, the earths are seven, and the circumambulation (tawaf) too (is of seven circuits)?" And he (peace and blessings be upon him) mentioned several things.
This hadith is sahih (authentic) on the condition of Imam Bukhari and Imam Muslim, but the two Shaykhs did not record it with this wording. They agreed only on "Whoever uses stones, let him use an odd number."

(3) أبو عامر الخزاز - وهو صالح بن رستم - مختلف فيه، وهو في الجملة حسن الحديث إلّا إذا خالف أو أتى بما ينكر، وقد تفرَّد في حديث أبي هريرة بهذا اللفظ.
Technical note / Defect ('illah): There is disagreement about Abu 'Amir al-Khazzaz (Salih bin Rustam); in general he is "hasan al-hadith", provided he does not contradict a thiqah narrator or bring something munkar.
Important point: He is alone in narrating this hadith of Abu Hurayrah with these specific words.
أما الذهبي في "تلخيص المستدرك" فقد قال: منكر، والحارث ليس بعمدة. قلنا: لم ينفرد به الحارث بن أبي أسامة، فقد تابعه عليه محمدُ بن معمر عند ابن حبان في "صحيحه" (1437) ¤ ¤ عن روح بن عبادة بهذا الإسناد. وانظر تتمة تخريجه فيه.
Technical note / Defect ('illah): Imam al-Dhahabi called it munkar in "al-Talkhis" and considered al-Harith unreliable; but in fact al-Harith bin Abi Usamah is not alone, for Muhammad bin Ma'mar corroborated him in Ibn Hibban (1437).
وفي الباب عن جابر عند مسلم (1300) مرفوعًا: "الاستجمار توٌّ، ورمي الجمار توّ، والسعي بين الصفا والمروة توّ، والطواف توّ، وإذا استجمر أحدكم فليستجمر بتوٍّ". والتوُّ: الوِتر.
Corroborating chains and supporting reports: On this topic there is the marfu' narration of Jabir (Muslim 1300) that cleaning with stones (istijmar), stoning the Jamarat, the sa'y and the tawaf are "taww" (odd).
Note / Clarification: "Al-taww" means witr, i.e. an odd number (1, 3, 5, and so on).
