Mustadrak al-Hakim — Hadith 569

وسمعت عليَّ بن حَمْشاذ يقول: سمعت موسى بن هارون يقول: رواه الأوزاعي مرتين فقال مرة: عن يحيى عن هلال بن عياض. وقد حدَّثَناه (1) محمد بن الصَّبّاح، حدثنا الوليد عن الأوزاعي، عن يحيى بن أبي كثير، عن رسول الله ﷺ مرسلًا. وقد كان عبد الرحمن بن مَهدِيّ يحدِّث به عياض بن هلال ثم شكَّ فيه فقال: أو هلال بن عياض، رواه عن عبد الرحمن بن مهدي عليُّ بن المَدِيني وعُبيدُ الله بن عمر القواريري ومحمد بن المثنَّى، فاتفقوا على عياض بن هلال، وهو الصواب. قال الحاكم: وقد حَكَمَ به إمامان من أئمَّتنا مثل البخاري وموسى بن هارون بالصحة لقول من أقام هذا الإسنادَ عن عياض بن هلال الأنصاري، وذكر البخاريُّ فيه شواهد فصحَّ به الحديث، وقد خرَّج مسلم معنى هذا الحديث عن أبي كُريب وأبي بكر بن أبي شَيْبة عن زيد بن الحُبَاب عن الضَّحّاك بن عثمان عن زيد بن أسلم عن عبد الرحمن بن أبي سعيد عن أبيه عن النبي ﷺ قال: "لا يَنظُرُ الرجلُ إلى عورة الرجل، ولا تَنظُرُ المرأةُ إلى عورة المرأة" الحديث (2).
The scholars differ concerning the chain of this narration as to whether the narrator's name is Iyad bin Hilal or Hilal bin Iyad, but Imam Bukhari and Musa bin Harun have declared the name Iyad bin Hilal to be correct.
Imam al-Hakim says: Imam Bukhari and Musa bin Harun have declared it sahih (authentic), and Imam Muslim has also recorded in his Sahih a narration with the same meaning as this hadith: that a man should not look at the private parts of another man.

(1) القائل: وقد حدثناه، هو موسى بن هارون الحافظ. وهذا المرسل أخرجه البيهقي في "السنن" 1/ 100 عن أبي عبد الله الحاكم، بهذا الإسناد. والوليد فيه: هو ابن مسلم.
Technical note / Defect ('illah): The one who says "and he narrated it to us" in the text is al-Hafiz Musa bin Harun.
Reference / Source: This mursal narration was transmitted by Imam al-Bayhaqi in "al-Sunan" (1/100) from Imam al-Hakim. "Al-Walid" in it refers to al-Walid bin Muslim.

(2) أخرجه مسلم في "صحيحه" برقم (338). وهذا يشهد للنهي عن كشف العورات.
Reference / Source: Imam Muslim narrated it at (338).
General principle: This narration is a supporting report (shahid) for the prohibition of exposing one's private parts.
ويشهد للنهي عن التحدث أثناء قضاء الحاجة، حديثُ ابن عمر عند مسلم أيضًا (370): أنَّ رجلًا مرَّ ورسول الله ﷺ يبول فسلَّم، فلم يردَّ عليه. وهذا في ردّ السلام مع كونه واجبًا، فكيف في غيره.
Corroborating chains and supporting reports: The narration of Ibn 'Umar (Muslim 370) is a supporting report for the prohibition of talking while relieving oneself: a man greeted the Prophet (peace and blessings be upon him) with salam while he was urinating, but he (peace and blessings be upon him) did not reply.
Important point: When an obligatory act such as returning the salam was left in this state, ordinary conversation is all the more prohibited.
