(1) كذا في نسخنا الخطية: الفتيا، ووقع في رواية غير المصنّف: حقَّه.
Note / Clarification: (1) Our manuscripts have "al-futya" thus, whereas in the narration of others than the author (al-Hakim) it reads "haqqahu".
(2) حديث صحيح لكن من مسند عبد الله بن الزبير، وليس من مسند أبيه الزبير، وهذا إسناد ضعيف لضعف ضرار بن صُرَدٍ، لكنه متابع.
Grading: (2) The hadith is "sahih", but it belongs to the "Musnad of 'Abdullah bin al-Zubayr", not to the Musnad of his father al-Zubayr. This particular chain is "da'if" (weak) because of the weakness of Dirar bin Surad, but it is corroborated.
وأخرجه النسائي (5924) من طريق عبد الله بن وهب، عن يونس بن يزيد والليث بن سعد، عن ابن شهاب الزهري، بهذا الإسناد. قال أبو حاتم كما في "العلل" لابنه (1185): أخطأ ابن وهب في هذا الحديث، الليث لا يقول: عن الزبير، ونحوه قول البخاري فيما نقله عنه الترمذي في "العلل الكبير" (374).
Reference / Source: Al-Nasa'i (5924) narrated it via 'Abdullah bin Wahb, from Yunus bin Yazid and al-Layth bin Sa'd, from Ibn Shihab al-Zuhri, with this chain.
Technical note / Defect ('illah): Abu Hatim said (as in his son's "al-'Ilal" 1185): "Ibn Wahb erred in this hadith; al-Layth does not say 'from al-Zubayr'." Al-Bukhari said something similar, as quoted from him by al-Tirmidhi in "al-'Ilal al-Kabir" (374).
قلنا: مصداق قولهما ما أخرجه أحمد 26/ (16116) عن أبي النضر هاشم بن القاسم، والبخاري (2359) عن عبد الله بن يوسف، ومسلم (2357)، والترمذي (1363) و (3027)، والنسائي (5925) و (5936) و (11045) عن قتيبة بن سعيد، ومسلم (2357)، وابن ماجه (15) و (2480) عن محمد بن رُمْح، وأبو داود (3637)، وابن حبان (24) من طريق أبي الوليد هشام بن عبد الملك الطيالسي، خمستهم عن الليث بن سعد، عن ابن شهاب، عن عروة بن الزبير، عن عبد الله بن الزبير: أنَّ رجلًا خاصم الزبير، الحديث. فجعلوه من مسند عبد الله بن الزبير.
Corroborating chains and supporting reports: We say: what confirms their statement is what Ahmad 26/ (16116) narrated from Abu al-Nadr Hashim bin al-Qasim; al-Bukhari (2359) from 'Abdullah bin Yusuf; Muslim (2357), al-Tirmidhi (1363) and (3027), and al-Nasa'i (5925), (5936) and (11045) from Qutaybah bin Sa'id; Muslim (2357) and Ibn Majah (15) and (2480) from Muhammad bin Rumh; and Abu Dawud (3637) and Ibn Hibban (24) via Abu al-Walid Hisham bin 'Abd al-Malik al-Tayalisi.
Details of the narration: These five narrate it from al-Layth bin Sa'd, from Ibn Shihab, from 'Urwah bin al-Zubayr, from "'Abdullah bin al-Zubayr": that a man disputed with al-Zubayr (the hadith). So all of them made it part of the "Musnad of 'Abdullah bin al-Zubayr".
وأخرجه أحمد 3/ (1419)، والبخاري (2708) من طريق شعيب بن أبي حمزة، والبخاري (2361) و (4585) من طريق معمر بن راشد، و (2362) من طريق ابن جُريج، ثلاثتهم عن ابن شهاب الزهري، عن عروة بن الزبير؛ قال شعيب في روايته: أنَّ الزبير كان يحدِّثُ أنه خاصم رجلًا، وأرسله الآخران عن عروة، فلم يذكُرا الزبير، ولم يذكر أحدٌ منهم عبدَ الله بنَ الزبير في إسناده. وشِراج الحَرَّة: الحرة: الأرضُ ذات الحجارة السُّود، والشِّراج: جمع شَرْجة، وهي مَسيل الماء من الحَزْن إلى السَّهْل.
Reference / Source: Ahmad 3/ (1419) and al-Bukhari (2708) narrated it via Shu'ayb bin Abi Hamzah; al-Bukhari (2361) and (4585) via Ma'mar bin Rashid; and (2362) via Ibn Jurayj. These three narrate it from Ibn Shihab al-Zuhri, from 'Urwah bin al-Zubayr.
Details of the narration: Shu'ayb said in his narration: al-Zubayr used to relate that he disputed with a man; while the other two (Ma'mar and Ibn Jurayj) narrated it from 'Urwah as "mursal" and did not mention al-Zubayr. And none of them mentioned "'Abdullah bin al-Zubayr" in the chain.
Note / Clarification: In "shiraj al-harrah", "harrah" means black stony ground, and "shiraj" is the plural of "sharjah", meaning a water channel running from high rough ground to level ground.
والجَدْر: الحائط، وقيل: الجَدْر أصلُ الجدار، قال الخطابي: هكذا الرواية: الجدر، قال: والمُتقنون من أهل الرواية يقولون: حتَّى يبلغ الجذر، يعني بالذال المعجمة، وهو مبلغ تمام الشرب، ومنه: جذر الحساب.
Note / Clarification: "Al-jadr" means a wall (ha'it), and it is said that "jadr" is the base of a wall. Al-Khattabi said: the narration has it thus, "al-jadr" (with dal), but the precise experts of narration say: "until it reaches al-jadhr" (with dotted dhal), meaning the full extent of watering; and from this comes "jadhr al-hisab" (the root, in arithmetic).
(1) في قول المصنّف هذا نظر، فقد وافق ابنَ أخي الزهري على ذكر عبد الله بن الزبير في إسناده الليث بنُ سعد ويونسُ بنُ يزيد في روايتهما عن الزهري كما تقدم.
Technical note / Defect ('illah): (1) This statement of the author (al-Hakim) is open to question, since al-Layth bin Sa'd and Yunus bin Yazid, in their narration from al-Zuhri, agreed with Ibn Akhi al-Zuhri in mentioning "'Abdullah bin al-Zubayr" in the chain, as has passed.
