Mustadrak al-Hakim — Hadith 5626

أخبرنا حمزة بن العباس العَقَبي ببغداد، حَدَّثَنَا إبراهيم بن الهَيثم البَلَدي، حَدَّثَنَا محمد بن كثير المِصِّيصي، حَدَّثَنَا عبد الله بن واقِد، عن عبد الله (1) ابن عثمان بن خُثَيم، عن أبي الزُّبَير، عن جابر، عن عُبادة بن الصامت: أنه دَخَل على عثمانَ بن عَفّان، فقال: سمعتُ رسول الله ﷺ يقول: "سَيَلِيكُم أمراءُ بَعدِي، يُعرِّفُونُكم ما تُنكِرُون، ويُنكِرون عليكم ما تَعرِفُون، فمن أدركَ ذلكَ منكم فلا طاعَةَ لمن عَصَى الله" (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه. وقد رواه زهيرُ بن معاوية ومسلمُ بن خالد الزَّنْجي عن عبد الله بن عُثمان بن خُثَيم عن إسماعيل بن عُبيد بن رِفاعة (1)، بزياداتٍ فيه:
Sayyiduna Jabir (may Allah be pleased with him) narrates from Ubadah bin al-Samit (may Allah be pleased with him) that he went to Sayyiduna Uthman bin Affan (may Allah be pleased with him) and said: I heard the Messenger of Allah (peace and blessings be upon him) say: "After me, rulers will be in authority over you who will tell you things that you consider wrong, and will condemn the things that you know (to be right). So whoever of you reaches that time (should remember that) there is no obedience to one who disobeys Allah."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it. It has also been narrated by Zuhayr bin Mu'awiyah and Muslim bin Khalid al-Zanji from Abdullah bin Uthman bin Khuthaym, from Isma'il bin Ubayd bin Rifa'ah, with some additions:

Note / Clarification: (1) In manuscripts (Z) and (B) this name is corrupted into "Abd al-Rahman".

(2) حديث حسن، وهذا إسناد ضعيف محمد بن كثير المِصِّيصي ضعيف عند التفرد، وقد تفرد بهذا الإسناد، وشيخه عبد الله بن واقد هو أبو رجاء الخراساني، وهو ثقة، وليس هو بعبد الله ابن واقد أبي قتادة الحَرّاني الضعيف كما ظنّه الذهبي في "تلخيصه" فقال: تفرَّد به عبد الله بن واقد، وهو ضعيف. وإنما العلة فيه تفرد ابن كثير المِصِّيصي به، وهو ضعيف.
Grading: (2) This hadith is in itself "hasan", but this particular chain is "weak".
Technical note / Defect ('illah): The reason is that Muhammad bin Kathir al-Missisi is weak when he is alone in a narration, and here he is alone with this chain. His shaykh "Abd Allah bin Waqid" is in fact "Abu Raja' al-Khurasani", who is thiqah; he is not "Abd Allah bin Waqid Abu Qatadah al-Harrani", who is weak, as Imam al-Dhahabi assumed in his "Talkhis", saying: "Abd Allah bin Waqid is alone in narrating it, and he is weak."
Important point: In fact, the real defect in it is the solitary narration of "Ibn Kathir al-Missisi", and it is he who is weak.
وقد اختلف عليه في إسناده كذلك، فقد رواه محمد بن أحمد بن الوليد الأنطاكي عند العُقيلي في "الضعفاء" (868)، وأبو الأحوص محمد بن الهيثم القاضي عند ابن بَطَّة العُكبَري في "الإبانة" 1/ 213 - 214، كلاهما عن محمد بن كثير المِصِّيصي، عن عبد الله بن واقد، عن أبي الزبير - وهو محمد بن مسلم بن تَدرُس المكي - عن جابر، عن عبادة. هكذا ليس فيه ذكر عبد الله بن عثمان بن خُثيم، والظاهر أنَّ الصحيح ذكره.
Technical note / Defect ('illah): There is also disagreement over this chain among those narrating from him (Muhammad bin Kathir).
Reference / Source: Al-'Uqayli narrated it in "al-Du'afa'" (868) through Muhammad bin Ahmad bin al-Walid al-Antaki, and Ibn Battah al-'Ukbari in "al-Ibanah" 1/ 213 - 214 through Abu al-Ahwas Muhammad bin al-Haytham al-Qadi.
Details of the narration: Both of these narrators narrate it from Muhammad bin Kathir al-Missisi, from Abd Allah bin Waqid, from Abu al-Zubayr (Muhammad bin Muslim bin Tadrus al-Makki), from Jabir, from 'Ubadah (may Allah be pleased with him). This chain does not mention "Abd Allah bin 'Uthman bin Khuthaym", while it appears that mentioning him is correct.
وخولف محمد بن كثير فيه، فقد رواه زهيرُ بنُ معاوية ومسلمٌ الزنجي كما سيأتي في الطريقين التاليتين - وكذلك رواه غيرهما - عن ابن خُثيم، عن إسماعيل بن عُبيد بن رفاعة، عن أبيه، عن عبادة بن الصامت؛ في قصة مطولةٍ منذ كان في الشام ثم قدومه المدينة ودخوله على عثمان بن عفان.
Technical note / Defect ('illah): Muhammad bin Kathir was contradicted in this narration. Zuhayr bin Mu'awiyah and Muslim al-Zanji (as will come in the next two routes), and others besides them, narrated it from Ibn Khuthaym, from Isma'il bin 'Ubayd bin Rifa'ah, from his father, from 'Ubadah bin al-Samit.
Details of the narration: It is a long story about 'Ubadah's stay in Syria, then his arrival in Medina and his going in to 'Uthman bin 'Affan (may Allah be pleased with him).
وخالفهم إسماعيلُ بنُ زكريا عند أحمد (6/ 3790) وغيره، ويحيى بنُ سُليم الطائفي وإسماعيلُ ابن عيّاش عند ابن ماجه (2865) وغيره، وداودُ بنُ عبد الرحمن المكي عند أبي محمد الفاكهي في "فوائده" (131)، والطبراني في "الكبير" (10361)، والبيهقي في "سننه الكبرى" 3/ 124، فرووه جميعًا عن ابن خُثيم، عن القاسم بن عبد الرحمن بن عبد الله بن مسعود، عن أبيه، عن ابن مسعود قال: قال رسول الله ﷺ: "إنه سيلي أمركم من بعدي رجال يُطفؤون السُّنَّة ويُحدِثون بدعة، ويؤخرون الصلاة عن مواقيتها" قال ابن مسعود: يا رسول الله، كيف بي إذا أدركتُهم؟ قال: "ليس يا ابن أم عبدٍ طاعةٌ لمن عصى الله" قالها ثلاث مراتٍ.
Technical note / Defect ('illah): All of them were contradicted by Isma'il bin Zakariyya in Ahmad (6/ 3790) and elsewhere, by Yahya bin Sulaym al-Ta'ifi and Isma'il bin 'Ayyash in Ibn Majah (2865) and elsewhere, and by Dawud bin Abd al-Rahman al-Makki in Abu Muhammad al-Fakihi's "Fawa'id" (131), al-Tabarani's "al-Kabir" (10361) and al-Bayhaqi's "al-Sunan al-Kubra" 3/ 124.
Details of the narration: All of them narrated it from Ibn Khuthaym, from al-Qasim bin Abd al-Rahman bin Abd Allah bin Mas'ud, from his father, from Abd Allah bin Mas'ud, that the Messenger of Allah (peace and blessings be upon him) said: "After me, men will be in charge of your affairs who will extinguish the Sunnah, introduce innovations and delay the prayer from its times." Ibn Mas'ud said: O Messenger of Allah! What should I do if I meet them? He (peace and blessings be upon him) said: "O son of Umm 'Abd! There is no obedience to one who disobeys Allah." He (peace and blessings be upon him) said this three times.
وكذلك رواه معمر بن راشد عن ابن خُثيم عند أحمد 6 / (3889) لكنه أسقط منه عبد الرحمن بن عبد الله بن مسعود.
Corroborating chains and supporting reports: Likewise, Ma'mar bin Rashid narrated it from Ibn Khuthaym in Musnad Ahmad 6/ (3889), but he dropped "Abd al-Rahman bin Abd Allah bin Mas'ud" from the chain.
فقد جعله هؤلاء من مسند عبد الله بن مسعود مع اختلاف في لفظه كما هو ظاهر، وهذا يدلُّ على أنَّ هذا الطريق وطريق إسماعيل بن عُبيد بن رفاعة كلاهما محفوظ، قد حفظهما ابن خُثيم جميعًا، وإسناده بذكر القاسم عن أبيه عن جده حسن على رأي ابن المديني والبخاري في صحة سماع عبد الرحمن بن عبد الله بن مسعود من أبيه، وإسناده بذكر إسماعيل بن عبيد عن أبيه عن عبادة حسنٌ إن شاء الله، وله عن عُبادة أصلٌ إذ قد رُوي عنه من وجه آخر سيأتي عند المصنّف برقم (5629).
Technical note / Defect ('illah): These narrators made it part of "the Musnad of Abd Allah bin Mas'ud", with a difference in its wording as well, as is evident.
Important point: This shows that this route (that of Ibn Mas'ud) and the route of Isma'il bin 'Ubayd bin Rifa'ah are both "preserved" (mahfuz), and that Ibn Khuthaym retained both of them.
Grading: The chain of al-Qasim from his father from his grandfather is "hasan" according to the view of Ibn al-Madini and al-Bukhari (who accept that Abd al-Rahman bin Abd Allah bin Mas'ud heard from his father). Likewise, the chain of Isma'il bin 'Ubayd from his father from 'Ubadah is also "hasan", if Allah wills. And the narration of 'Ubadah has a "basis" (asl), since it is also narrated from him through another route, which will come with the author (al-Hakim) at no. (5629).
وقد رُوي المرفوع منه عن عبادة بن الصامت بلفظٍ آخر بمعناه عند أحمد 37 / (22737)، والبخاري (7056)، ومسلم (1840) (42) عن عبادة بن الصامت، قال: بايعنا على السمع والطاعة … وأن لا نُنازع الأمرَ أهلَه، قال: "إلّا أن تروا كفرًا بَوَاحًا، عندكم من الله فيه بُرهان". هذا لفظ الشيخين، ولفظ أحمد: "ما لم يأمروك بإثم بَوَاحًا".
Corroborating chains and supporting reports: Its marfu' part is narrated from 'Ubadah bin al-Samit with different wording but the same meaning in Musnad Ahmad 37/ (22737), al-Bukhari (7056) and Muslim (1840) (42): 'Ubadah said: We pledged allegiance to hear and obey, and that we would not dispute the authority of those in charge. He (peace and blessings be upon him) said: "Unless you see open disbelief (kufran bawahan) for which you have clear proof from Allah." This is the wording of the two Shaykhs (al-Bukhari and Muslim), while the wording of Ahmad is: "As long as they do not command you to an open sin (ithman bawahan)."
وهو عند ابن حبان (4566) عن عبادة أيضًا لكن بلفظ: "اسمَعْ وأطِعْ في عُسْرك ويُسْرك، ومَكْرهِك وأَثَرةٍ عليك، وإن أكَلُوا مالَكَ وضربوا ظَهْرَك، إلّا أن تكون معصيةٌ الله بَوَاحًا".
Details of the narration: This narration is also reported from 'Ubadah by Ibn Hibban (4566), but with the wording: "Hear and obey, in your hardship and your ease, in what you dislike and when others are preferred over you, even if they consume your wealth and beat your back, unless it is open disobedience to Allah (ma'siyat Allah bawahan)."
وسندُه حسن.
Grading: Its chain is "hasan".

(1) وقع اسم عبد الله بن عثمان بن خُثيم في نسخنا الخطية مؤخرًا بعد ذكر إسماعيل بن عُبيد بن رِفاعة، وهو خطأ صَريح يُوهم أنَّ إسماعيل بن عُبيد قد تابع فيه عبد الله بن واقد الخراساني على إسناده المذكور في روايته السابقة، وإنما أراد الحاكم ﵀ أن يأتي بالحديث بوجه آخر عن عبادة بن الصامت كما توضحه الرواية الآتية برقم (5628)، فكلٌّ من زهير بن معاوية ومسلم بن خالد الزنجي قد روى هذا الخبر عن عبد الله بن عثمان بن خُثَيم عن إسماعيل بن عُبيد بن رفاعة عن أبيه عن عبادة بن الصامت، كذلك روى هذا الخبر جماعةٌ عن زهير بن معاوية كما سيأتي تخريجه، وكذلك رواه غير واحدٍ عن ابن خُثيم.
Note / Clarification: (1) In our manuscripts the name "Abd Allah bin 'Uthman bin Khuthaym" has been displaced to after the mention of Isma'il bin 'Ubayd bin Rifa'ah, which is a clear error. It creates the false impression that Isma'il bin 'Ubayd corroborated Abd Allah bin Waqid al-Khurasani in this narration (as in the chain of the previous narration).
Technical note / Defect ('illah): In fact, al-Hakim (may Allah have mercy on him) intended to bring this hadith from 'Ubadah bin al-Samit through another route, as the next narration, no. (5628), makes clear. Thus both Zuhayr bin Mu'awiyah and Muslim bin Khalid al-Zanji narrated this report from Abd Allah bin 'Uthman bin Khuthaym, from Isma'il bin 'Ubayd bin Rifa'ah, from his father, from 'Ubadah bin al-Samit. Likewise, a group narrated this report from Zuhayr bin Mu'awiyah (as its documentation will come), and more than one narrator narrated it from Ibn Khuthaym.
