Mustadrak al-Hakim — Hadith 558

حدثنا أبو العباس محمد بن يعقوب، حدثنا بكَّار بن قُتيبة القاضي بمصر، حدثنا صفوان بن عيسى، حدثنا الحسن بن ذَكْوان عن مروان الأصفر قال: رأيتُ ابنَ عمر أناخَ راحلتَه مُستقبِلَ القِبْلةِ، ثم جلس يبول إليها، فقلت: يا أبا عبد الرحمن، أليس قد نُهِيَ عن هذا، قال: إنما نُهِيَ عن ذلك في الفَضَاء، فإذا كان بينك وبين القِبْلة شيءٌ يَستُرُك، فلا بأسَ (4).
هذا حديث صحيح على شرط البخاري، فقد احتجَّ بالحسن بن ذَكْوان (1)، ولم يُخرجاه. وله شاهد عن جابر صحيح علي شرط مسلم:

Marwan al-Asfar narrates: I saw Sayyiduna Ibn Umar (may Allah be pleased with them both) make his riding camel kneel facing the qiblah, then he sat down behind its cover and began to urinate. I said: "O Abu Abd al-Rahman! Has this not been forbidden?" He said: "It has only been forbidden in open ground; but when there is something between you and the qiblah that screens you, then there is no harm in it."
This hadith is sahih (authentic) on the condition of Imam Bukhari, because he used al-Hasan bin Dhakwan as evidence, but the two Shaykhs did not record it.

(4) قوله: "شيء يسترك فلا بأس" مكانه بياض في (ز) و (ب) و (ع)، ولم نتبينه في (ص) لطمس وقع فيها مكان هذا الحديث، وأثبتناه من "تلخيص الذهبي" ومن "سنن البيهقي" 1/ 92 حيث رواه عن أبي عبد الله الحاكم بإسناده ومتنه. ¤ ¤ والحديث إسناده ضعيف لضعف الحسن بن ذكوان، فقد اختُلف فيه، والراجح أنه ضعيف عند التفرد يعتبر به في المتابعات والشواهد.
Important point: The place of the sentence "something that screens you, then there is no harm" was blank in manuscripts (Z), (B) and ('A), and was unclear in manuscript (S) because it had been effaced; it has been completed from Imam al-Dhahabi's "Talkhis" and al-Bayhaqi's "al-Sunan" (1/ 92).
Grading: Its chain is weak because of the weakness of al-Hasan bin Dhakwan; he is weak when narrating alone, but he can be taken into consideration in corroborating chains.
وأخرجه أبو داود (11) عن محمد بن يحيى الذهلي، عن صفوان بن عيسى، بهذا الإسناد.
Reference / Source: Imam Abu Dawud narrated it (11) through the chain of Muhammad bin Yahya al-Dhuhli from Safwan bin 'Isa.

(1) قد أخرج له البخاري حديثًا واحدًا في الرِّقاق برقم (6566)، لكن له شواهد كثيرة.
Important point: Imam al-Bukhari narrated only one hadith from this narrator, in the book of "al-Riqaq" (6566); however, it has many supporting reports (shawahid).
