Mustadrak al-Hakim — Hadith 5458

أخبرنا محمد بن يعقوب الشَّيباني، حدَّثنا محمد بن عبد الوهاب، حدَّثنا جعفر بن عون، عن أبي العُمَيس، عن عامر بن عبد الله بن الزُّبير: ذكرُ ما أوصى به عبدُ الله بنُ مسعود إن حَدَثَ به حَدَثٌ في مرضِه هذا أن يَرجعَ وصيَّتَه إلى الله، ثم إلى الزُّبَير بن العوام وابنه عبد الله بن الزُّبير، وإنهما في حِلٌ وبِلٍّ فيما وَلِيا وقَضَيا، ولا تُزَوَّجُ بناتُ عبدِ الله إلا بإذنِهما، ولا يُخَصُّ ذلك عن زينب (1).

It is narrated from Amir bin Abdullah bin al-Zubayr that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him), during his illness, made this bequest: that his affair is entrusted to Allah; then he appointed Sayyiduna al-Zubayr bin al-Awwam and his son Sayyiduna Abdullah bin al-Zubayr as his executors, and said that the two of them have full authority in looking after his affairs and in their decisions; and that the daughters of Abdullah shall not be given in marriage without the permission of the two of them, and that in this matter Zaynab (his wife) is not exempt either.

(1) رجاله ثقات لكنه مرسل، فإنَّ عامر بن عبد الله بن الزبير لم يُدرك عبد الله بن مسعود، لكن وصية عبد الله هذه كانت مكتوبة كما في بعض روايات الخبر عند غير المصنف. أبو العُميس: هو عتبة بن عبد الله بن عتبة المسعودي.
Grading: (1) Its men are "thiqah", but this narration is "mursal", because 'Amir bin 'Abdullah bin al-Zubayr did not live in the time of 'Abdullah bin Mas'ud.
Note / Clarification: However, this will of 'Abdullah bin Mas'ud existed in written form, as mentioned in some narrations of others besides the author (al-Hakim). Abu al-'Umays is "'Utbah bin 'Abdullah bin 'Utbah al-Mas'udi".
وأخرجه ابن سعد 3/ 146، وابن أبي شيبة 11/ 175، والبَلاذُري في "أنساب الأشراف" 11/ 225، وابن المنذر في "الأوسط" (7065)، والبيهقي 6/ 282، وابن عساكر 33/ 183 من طريقين عن أبي العميس، به.
Reference / Source: It was narrated by Ibn Sa'd (3/ 146), Ibn Abi Shaybah (11/ 175), al-Baladhuri in "Ansab al-Ashraf" (11/ 225), Ibn al-Mundhir in "al-Awsat" (7065), al-Bayhaqi (6/ 282) and Ibn 'Asakir (33/ 183), through two routes from Abu al-'Umays, with this chain.
وأخرجه ابن عساكر 28/ 169 من طريق موسى بن عقبة، عن عامر بن عبد الله بن الزبير، لكن دون ذكر تزويج بنات عبد الله بن مسعود.
Reference / Source: Ibn 'Asakir (28/ 169) narrated it by way of Musa bin 'Uqbah, from 'Amir bin 'Abdullah bin al-Zubayr, but without mention of marrying off the daughters of 'Abdullah bin Mas'ud.
