Mustadrak al-Hakim — Hadith 5367

It is narrated from Sayyiduna al-Aswad bin Khalaf (may Allah be pleased with him) that he saw the Prophet (peace and blessings be upon him) taking the pledge of allegiance from the people on the day of the Conquest of Makkah. He said that he (peace and blessings be upon him) was seated near a corner of the house of Ibn Samurah. Sayyiduna al-Aswad (may Allah be pleased with him) said: I saw that the Prophet (peace and blessings be upon him) sat down, and the young, the old and the women all came to him, and they all pledged allegiance to him on Islam and the testimony. I asked: What is meant by the testimony? He said: On belief in Allah and on bearing witness that "there is no true god except Allah".

Explanation & Benefits
Shaykh Adil Murshid et al.
Note / Clarification: (2) In the manuscripts it was "qurb", while in the sources that record it it is "Qarn Masqalah"; and this, as al-Fakihi said in "Akhbar Makkah", was a hillock (qarn) in upper Makkah behind the house of Ibn Samurah.

Grading: (3) This chain can possibly be graded "hasan" (good) because of "Muhammad bin al-Aswad bin Khalaf".
Technical note / Defect ('illah): He is a Tabi'i; two narrators narrated from him and Ibn Hibban mentioned him in "al-Thiqat".
Technical note / Defect ('illah): The last part of this narration, which explains the meaning of "the testimony" (shahadah), is the statement of Muhammad bin al-Aswad bin Khalaf, as the narration of others besides the author (al-Hakim) makes clear.
Reference / Source: Ahmad (24/ 15431 and 29/ 17534) recorded it from Abd al-Razzaq, with this same chain. Its wording at the end is: "I (Ibn Jurayj) said: What is the testimony? He said: Muhammad bin al-Aswad bin Khalaf informed me that he took their pledge on belief in Allah and testifying that there is no god but Allah and that Muhammad is His servant and His Messenger." More than one narrator likewise narrated it from Abd al-Razzaq.
