Mustadrak al-Hakim — Hadith 522

حدثنا علي بن حَمْشاذ، حدثنا إسماعيل بن إسحاق القاضي، حدثنا عارِمُ بن الفضل. وحدثني محمد بن صالح بن هانئ، حدثنا يحيى بن محمد بن يحيى، حدثنا عبد الله بن عبد الوهاب الحَجَبي؛ قالا: حدثنا حماد بن زيد حدثنا عبد الرحمن السَّرّاج، عن سعيد بن أبي سعيد المَقْبُري، عن أبي هريرة قال: قال رسول الله ﷺ: "لولا أن أشُقَّ على أمَّتي، لَفَرضتُ عليهم السِّواكَ مع الوضوء، ولَأخَّرتُ صلاةَ العشاء إلى نصف الليل" (1). ...... (2) عن أبي هريرة في هذا الباب ولم يُخرجا لفظ الفَرْض فيه، وهو صحيح على شرطهما جميعًا، وليس له عِلَّة. وله شاهد بهذا اللفظ:
[التعليق - من تلخيص الذهبي] ترقيم العلميه 516 - لم يخرجا لفظ فرضت وهو على شرطهما وليس له علة
Sayyiduna Abu Hurayrah (may Allah be pleased with him) relates that the Messenger of Allah (peace and blessings be upon him) said: "Were it not that I would burden my Ummah, I would have made the miswak obligatory upon them along with ablution, and I would have delayed the Isha prayer until midnight."
This hadith is sahih (authentic) on the condition of Bukhari and Muslim, and there is no hidden defect ('illah) in it. The two Shaykhs recorded narrations from Sayyiduna Abu Hurayrah (may Allah be pleased with him) on this topic, but they did not record the word "obligatory" in it.

(1) إسناده صحيح. عارم بن الفضل: هو محمد بن الفضل أبو النعمان، وعارم لقبه.
Grading: Its chain is sahih.
Technical note / Defect ('illah): "'Arim bin al-Fadl" refers to Muhammad bin al-Fadl Abu al-Nu'man al-Sadusi; "'Arim" is his nickname.
وأخرجه النسائي (3020) عن إبراهيم بن يعقوب، عن أبي النعمان، بهذا الإسناد. ولم يذكر الشطر الثاني من الحديث.
Reference / Source: Imam al-Nasa'i narrated it (3020) through Ibrahim bin Ya'qub, from Abu al-Nu'man ('Arim), with this same chain.
Details of the narration: This narration of al-Nasa'i does not mention the second part of the hadith.
وأخرجه بنحوه أحمد 12/ (7412)، وابن ماجه (287) و (691)، والترمذي (167)، والنسائي (3021 - 3026)، وابن حبان (1531) و (1538) و (1539) من طريق عبيد الله بن عمر، عن سعيد المقبري به - بلفظ: "لأمرتهم بالسواك"، ولم يذكر النسائي قصة تأخير الصلاة، واقتصر عليها ابن حبان في الموضعين (1538) و (1539).
Reference / Source: Imam Ahmad narrated this in 12/ (7412), Ibn Majah (287) and (691), al-Tirmidhi (167), al-Nasa'i (3021 - 3026) and Ibn Hibban (1531), (1538) and (1539), through 'Ubayd Allah bin 'Umar, from Sa'id al-Maqburi.
Details of the narration: Its wording is: "I would have commanded them to use the siwak." Imam al-Nasa'i did not mention the incident of delaying the prayer, while Imam Ibn Hibban, in two places, (1538) and (1539), confined himself to the incident of delaying the prayer alone.
وأخرجه أحمد 12/ (7399) و 15/ (9194)، والبخاري (887) و (7240)، ومسلم (252)، وأبو داود (46)، والنسائي (6) و (3034)، وابن حبان (1068) من طريق عبد الرحمن الأعرج، عن أبي هريرة - واقتصر فيه على قصة الأمر بالسواك غير أبي داود والنسائي في الموضع الثاني فذكراه بشطريه.
Reference / Source: Imam Ahmad narrated it in 12/ (7399) and 15/ (9194), al-Bukhari (887) and (7240), Muslim (252), Abu Dawud (46), al-Nasa'i (6) and (3034) and Ibn Hibban (1068), through 'Abd al-Rahman al-A'raj, from Abu Hurayrah (may Allah be pleased with him).
Details of the narration: All these hadith scholars confined themselves to the incident of the command to use the siwak, except Abu Dawud and al-Nasa'i (in the second place), who mentioned it in full with both parts (the siwak and the prayer).
