Mustadrak al-Hakim — Hadith 5163

فحدثني أبو الحسين بن يعقوب الحافظ، حدثنا محمد بن إسحاق بن إبراهيم، حدثنا سَلْم بن جُنادة، حدثنا إبراهيم بن يوسف بن مَعمَر بن حمزة بن عمر بن سعد بن أبي وقّاص، حدثني خالد بن سعيد بن عمرو بن سعيد، حدثني أبي: أنَّ أعمامَه خالدًا وأبانًا وعمرَو بن سعيد بن العاص رَجَعُوا عن أعمالهم حين بلغَهم وفاةُ رسولِ الله ﷺ، فقال أبو بكر: ما أحدٌ أحقَّ بالعملِ من عُمّال رسولِ الله ﷺ، ارجِعُوا إلى أعمالِكم، فقالوا: لا نَعملُ بعدَ رسولِ الله ﷺ لأحدٍ، فخرجوا إلى الشام، فقُتِلوا عن آخِرِهم (4).

Khalid bin Sa'id bin Amr bin Sa'id narrates from his father (Sa'id bin Amr) that when news of the passing of the Messenger of Allah (peace and blessings be upon him) reached his uncles Khalid, Aban and Amr (the sons of Sa'id bin al-As), they left their posts and came back. Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) said to them: "No one is more entitled to these posts than the governors appointed by the Messenger of Allah (peace and blessings be upon him); go back to your duties." But they replied: "We will not serve as governors for anyone after the Messenger of Allah (peace and blessings be upon him)." So they set out for Syria for jihad, and all of them were martyred there.

(4) رجاله لا بأس بهم، لكنه مرسلٌ من أجل أنَّ سعيد بن عمرو لم يدرك أحدًا من أعمامه المذكورين، وإبراهيم بن يوسف بن معمر المذكور يُعرف بالسَّعدي، روى عنه سَلْم بن جُنادة ومحمد بن عبيد الله بن يزيد المُنادي ومِنْجاب بن الحارث، وروى عنه هذا الأخيرُ كتاب "المبتدأ" لابن إسحاق، عن زياد البكائي عن ابن إسحاق، فيما قاله أبو بكر بن أبي داود في "المصاحف" (114)، وقال عنه أبو بكر: لا بأس به، وذكره ابن حِبّان في "الثقات".
Grading: (4) Its narrators are "unobjectionable", but this narration is "mursal".
Technical note / Defect ('illah): Because Sa'id bin 'Amr did not meet any of his paternal uncles mentioned. The "Ibrahim bin Yusuf bin Ma'mar" mentioned is known as "al-Sa'di". Salm bin Junadah, Muhammad bin 'Ubaydullah bin Yazid al-Munadi and Minjab bin al-Harith narrated from him. Minjab narrated from him Ibn Ishaq's book "al-Mubtada'", which he transmits from Ziyad al-Bakka'i from Ibn Ishaq (as Abu Bakr bin Abi Dawud said in "al-Masahif" (114)). Abu Bakr said about him: "La ba'sa bihi" (there is nothing wrong with him), and Ibn Hibban mentioned him in "al-Thiqat".
وهو في "المسند" لأبي العباس محمد بن إسحاق بن إبراهيم السرّاج كما في "الإصابة" لابن حجر 2/ 102، ومن طريقه أخرجه أبو نعيم في "معرفة الصحابة" (2428)، وابن عساكر في "تاريخ دمشق" 46/ 25.
Reference / Source: It is in the "al-Musnad" of Abu al-'Abbas Muhammad bin Ishaq bin Ibrahim al-Sarraj (as in Ibn Hajr's "al-Isabah" [2/ 102]). By way of him Abu Nu'aym narrated it in "Ma'rifat al-Sahabah" (2428) and Ibn 'Asakir in "Tarikh Dimashq" [46/ 25].
