Mustadrak al-Hakim — Hadith 5132

حدثنا أبو عبد الله الأصبَهاني، حدثنا الحسن بن الجَهْم، حدثنا الحسين، حدثنا محمد بن عمر، أنَّ أبا بكر بن عبد الله بن أبي سَبْرة حدّثَه عن (2) موسى بن عُقبة، عن أبي حَبِيبة مولى عبد الله بن الزُّبير، [عن عبد الله بن الزُّبَير] (3) قال: فلما كان يومُ فَتْح مكةَ هرب عِكْرمةُ بن أبي جهل، وكانت امرأتُه أمُّ حكيم بنتُ الحارث بن هشام امرأةً عاقلةً أسلمتْ، ثم سألتْ رسولَ الله ﷺ، فأمَرَها بردِّه، وقالتْ له: جِئتُك من عند أَوصَلِ الناسِ وأبرِّ الناسِ وخَيرِ الناس، وقد استأمَنتُ لك فأمَّنَك، فرجع معها، فلما دنا من مكة قال رسولُ الله ﷺ لأصحابه: "يأتيكُم عِكْرمة بن أبي جَهل مُؤمِنًا مُهاجرًا، فلا تَسبُّوا أباه، فإِنَّ سَبَّ الميتِ يُؤذي الحيَّ ولا يَبلُغُ الميتَ"، فلما بلغ بابَ رسول الله ﷺ استَبْشَر ووَثَبَ له رسولُ الله ﷺ قائمًا على رجليه فَرَحًا بقُدومِه (4).

It is narrated from Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with them both) that when Makkah was conquered, Ikrimah bin Abi Jahl fled (out of fear). His wife, Umm Hakim bint al-Harith bin Hisham, was a very intelligent woman. She accepted Islam and then sought protection (for her husband) from the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) instructed her to bring Ikrimah back. She went to Ikrimah and said: "I have come to you from the one who is the most devoted of people to kinship, the most righteous of people, and the best of people. I have sought protection for you, and he has granted you protection." So Ikrimah returned with her. When they drew near to Makkah, the Messenger of Allah (peace and blessings be upon him) said to his Companions: "Ikrimah bin Abi Jahl is coming to you as a believer and an emigrant, so do not revile his father, for reviling the dead hurts the living and does not reach the dead." When he reached the door of the Messenger of Allah (peace and blessings be upon him), he (peace and blessings be upon him) was delighted, and, rejoicing at his arrival, stood up on his feet to receive him.

Addendum: The word "'an" had dropped out of manuscripts (Z), (B) and the printed edition.

(3) سقط من نسخنا الخطية، وقد أثبتناه من رواية البيهقي في "المدخل" (710) عن أبي عبد الله الحاكم، وهو ثابت في رواية محمد بن عمر الواقدي كما في "المغازي" له 2/ 850، و"طبقات ابن سعد" 6/ 85 عن الواقدي بإسناده هذا الذي هنا.
Addendum: (This part) had dropped out of our manuscripts; we have restored it from al-Bayhaqi's "al-Madkhal" (710) (narrated from Abu 'Abdullah al-Hakim). It is also present in al-Waqidi's narration (see "al-Maghazi" 2/850 and "Tabaqat Ibn Sa'd" 6/85), narrated from al-Waqidi with the same chain as here.

(4) إسناده ضعيف جدًّا من أجل أبي بكر بن عبد الله بن أبي سَبْرة، فهو متروك الحديث، واتهمه بعضُهم، وقد انفرد بالخبر بهذا الإسناد، ومحمد بن عمر - وهو الواقدي - لا يُعتبر بما ينفرد به أيضًا. على أنَّ خبر عكرمة بن أبي جهل وامرأته هذا مشهور عند أهل المغازي والسير.
Grading: Its chain is "very weak" (da'if jiddan) because of Abu Bakr bin 'Abdullah bin Abi Sabrah. He is "matruk al-hadith", some even accused him (of lying), and he is "alone" (munfarid) in narrating this report with this chain. The isolated narrations (tafarrudat) of Muhammad bin 'Umar (al-Waqidi) are also not given consideration.
Important point: However, this story of 'Ikrimah bin Abi Jahl and his wife is "well known" (mashhur) among the scholars of the maghazi and the biographers.
وأخرجه البيهقي في "المدخل إلى السنن الكبرى" (710) و (711) عن أبي عبد الله الحاكم بهذا الإسناد مختصرًا.
Reference / Source: Al-Bayhaqi narrated it in "al-Madkhal ila al-Sunan al-Kubra" (710 and 711) from Abu 'Abdullah al-Hakim with this same chain in abridged form.
وهو عند الواقدي في "المغازي" 2/ 850 - 851، ومن طريق رواية "المغازي" أخرجه ابن عساكر في "تاريخ دمشق" 41/ 62 - 63.
Reference / Source: It is in al-Waqidi's "al-Maghazi" (2/850-851), and by this same route Ibn 'Asakir recorded it in "Tarikh Dimashq" (41/62-63).
وأخرجه ابن سعد في "الطبقات الكبرى" 6/ 85، ومن طريقه ابن عساكر 41/ 64 و 70/ 255، وابن الجوزي في "المنتظم" 4/ 155 عن محمد بن عمر الواقدي، به.
Reference / Source: Ibn Sa'd narrated it in "al-Tabaqat al-Kubra" (6/85), and by way of him Ibn 'Asakir (41/64 and 70/255) and Ibn al-Jawzi in "al-Muntazam" (4/155), from Muhammad bin 'Umar al-Waqidi.
وسيأتي هذا الخبر عند المصنف بنحوه من رواية عروة بن الزبير مرسلًا بالرقمين الآتيين بعده، لكن دون ذكر النهي عن سبِّ الأموات.
Details of the narration: This report will come later with the author (al-Hakim) in a similar form from the "mursal" narration of 'Urwah bin al-Zubayr at the next two numbers, but without mention of the prohibition of reviling the dead.
ومثله عن الزهري مرسلًا عند ابن إسحاق كما في "سيرة ابن هشام" 2/ 418، ومالك في "الموطأ" 2/ 545، وعبد الرزاق (12646)، وابن سعد 6/ 86، وغيرهم، دون ذكر النهي عن سبِّ الأموات كذلك.
Details of the narration: A similar narration is reported from al-Zuhri as "mursal", recorded by Ibn Ishaq (as cited in Ibn Hisham 2/418), Imam Malik in "al-Muwatta'" (2/545), 'Abd al-Razzaq (12646), Ibn Sa'd (6/86) and others, but these narrations likewise do not mention "the prohibition of reviling the dead".
وقد روي هذا الحرفُ مفردًا في قصة عكرمة بن أبي جهل حبيبُ بن أبي ثابت مرسلًا عند هناد في "الزهد" (1170)، ورجاله لا بأس بهم.
Technical note: In the story of 'Ikrimah bin Abi Jahl, this particular wording (the command not to revile the dead) was narrated on its own (mufrad) by Habib bin Abi Thabit as "mursal", found in Hannad's "al-Zuhd" (1170), and its narrators are "la ba'sa bihim" (acceptable).
وعن عمرو بن دينار مرسلًا عند ابن عساكر 41/ 67، ورجاله لا بأس بهم كذلك.
Technical note: Likewise it is reported from 'Amr bin Dinar as "mursal" (see Ibn 'Asakir 41/67), and its narrators too are "la ba'sa bihim".
وقد صحَّ عن النبي ﷺ النهيُ عن سبِّ الأموات كما سلف عند الحديث المتقدم برقم (1435) وما بعده.
Important point: However, the prohibition of reviling the dead is established from the Prophet (peace and blessings be upon him) with a "sahih" chain, as has passed at the earlier hadith number (1435) and what follows it.
