(1) رجاله لا بأس بهم، لكنه اختُلف في وصلِه وإرسالِه عن محمد بن عَمرو اللَّيثي - وهو ابن علقمة - فقد رواه عنه حماد بن سلمة وعبّاد بن العوام موصولًا بذكر أبي هريرة، ورواه عنه خالد بن عبد الله الطحّان وجعفر بن عون، فأرسله لم يذكر فيه أبا هريرة.
Grading: (1) Its narrators are acceptable (la ba'sa bihim).
Technical note / Defect ('illah): There is disagreement over Muhammad bin 'Amr al-Laythi (Ibn 'Alqamah) about narrating it as connected or as mursal. Hammad bin Salamah and 'Abbad bin al-'Awwam made it "mawsul" by mentioning Abu Hurayrah, whereas Khalid bin 'Abd Allah al-Tahhan and Ja'far bin 'Awn narrated it as "mursal" and did not name Abu Hurayrah.
وقد روي هذا الخبر عن أبي هريرة من وجه آخر صحيح، لكن ليس فيه ذكر قتله ﷺ مَن سمَّه، بل قد روي من طريق سفيان بن حُسين، عن الزهري، عن أبي سلمة وسعيد بن المسيب عن أبي هريرة: أن رسول الله ﷺ لم يعرض لليهودية. يعني لم يقتلها، لكن سفيان بن حسين على ثقته تُضعَّف روايتُه عن الزهري خاصةً.
Corroborating chains and supporting reports: This incident is also narrated from Abu Hurayrah through another "sahih" chain, but it does not mention the killing of the woman who gave the poison.
Technical note / Defect ('illah): Via Sufyan bin Husayn it is narrated that the Messenger of Allah (peace and blessings be upon him) did not take any action against that Jewish woman (i.e. he did not kill her). Bear in mind that although Sufyan bin Husayn is thiqah, his narration from Imam al-Zuhri specifically is considered weak.
وأخرجه ابن حزم في "المحلى" 11/ 27، والبيهقي في "الكبرى" 8/ 46 من طريق عباد بن العوام، عن محمد بن عمرو، به. مختصرًا: أنَّ النَّبِيّ ﷺ قتلها، يعني التي سمّتْه.
Reference / Source: Ibn Hazm narrated it in "al-Muhalla" (11/27) and al-Bayhaqi in "al-Kubra" (8/46) with the chain of 'Abbad bin al-'Awwam from Muhammad bin 'Amr, in abridged form: "The Prophet (peace and blessings be upon him) killed her", meaning the one who had poisoned him.
وأخرجه أبو داود بطوله (4511) و (4512/ 2) من طريق خالد بن عبد الله الطحان، عن محمد بن عمرو، عن أبي سلمة، مرسلًا.
Reference / Source: Imam Abu Dawud recorded it in full (4511 and 4512/2) with the chain of Khalid bin 'Abd Allah al-Tahhan from Muhammad bin 'Amr from Abu Salamah, as "mursal".
وقد روى هذا الخبر القاضي عياض في "الشفا" 1/ 316 من طريق أحمد بن سعيد بن حزم، عن أبي سعيد بن الأعرابي، عن أبي داود، فوصله بذكر أبي هريرة وابن الأعرابي هذا أحدُ رواة "السنن" عن أبي داود، لكنَّ وصلَه من طريقه غريب جدًّا، فإنَّ هذا الخبر لم يروه عن أبي داود أصلًا غير ابن الأعرابي كما في هامش نسخة (هـ) التي عندنا من "سنن أبي داود" حيث أثبتنا الحديث من هامشها، وأشار الناسخ إلى أنه في رواية أحمد بن سعيد بن حزم عن ابن الأعرابي، ووقع فيه قوله: عن أبي سلمة ولم يذكر أبا هريرة؛ كذلك نصَّ على عدم ذكر أبي هريرة فيه، فلعله سقط من أصل القاضي عياض عبارة: "لم يذكر" فصار الحديث موصولًا، والله أعلم.
Reference / Source: Qadi 'Iyad narrated it in "al-Shifa" (1/316) with the chain of Ahmad bin Sa'id bin Hazm from Ibn al-A'rabi from Abu Dawud as "mawsul" (mentioning Abu Hurayrah).
Technical note / Defect ('illah): Its being connected from Ibn al-A'rabi is very "gharib" (strange), because according to the margin of manuscript (H) of Sunan Abi Dawud, Ibn al-A'rabi narrated it without mentioning Abu Hurayrah (as mursal). It is possible that the phrase "lam yadhkur" (he did not mention) dropped out of the copy that Qadi 'Iyad had, because of which it appeared to him as connected. And Allah knows best.
ومما يؤيده أنَّ غير أحمد بن سعيد بن حزم قد رواه عن ابن الأعرابي مرسلًا، كما أخرجه ابن بشكوال في "غوامض الأسماء المبهمة" ص 162 من طريق أحمد بن عون الله عن أبي سعيد بن الأعرابي، عن أبي داود، به، فقال: عن أبي سلمة، ولم يذكر أبا هريرة، فوافق ما نقلناه من هامش (هـ) لـ "سنن أبي داود"، والله أعلم.
Important point: This is supported by the fact that narrators other than Ahmad bin Sa'id bin Hazm narrated it from Ibn al-A'rabi as "mursal", as Ibn Bashkuwal recorded it in "Ghawamid al-Asma'" (p. 162) with the chain of Ahmad bin 'Awn Allah, saying that it is narrated from Abu Salamah and "he did not mention Abu Hurayrah". This agrees exactly with the margin of manuscript (H) of Sunan Abi Dawud.
وقد تابع خالدًا الواسطيَّ على إرساله جعفر بن عون عند الدارمي (68).
Corroborating chains and supporting reports: Khalid al-Wasiti's narrating it as "mursal" is corroborated by Ja'far bin 'Awn as well, as narrated by Imam al-Darimi (68).
وأرسله سعيد بن محمد الثقفي مرة كما وقع عند ابن سعد 1/ 145، ووصله مرة أخرى كما وقع عند الطبراني (1202)، وسعيد بن محمد هذا ضعيف الحديث.
Details of the narration: Sa'id bin Muhammad al-Thaqafi narrated this report once as "mursal", as found in Ibn Sa'd (1/145), and another time as "mawsul", as found in al-Tabarani (1202).
Technical note / Defect ('illah): This Sa'id bin Muhammad (al-Warraq) is "da'if" (weak) in hadith.
وأخرجه أبو داود (4509) من طريق سفيان بن حُسين، عن الزهري، عن سعيد وأبي سلمة، عن أبي هريرة: أنَّ امرأة من اليهود أهدت إلى النَّبِيّ ﷺ شاةً مسمومة، قال: فما عَرَض لها النَّبِيّ ﷺ. كذا قال! ولكن سفيان بن حسين هذا ضعيف الحديث في الزهري خاصةً، وإن كان ثقةً في غيره.
Reference / Source: Abu Dawud (4509) narrated it via Sufyan bin Husayn, from al-Zuhri, from Sa'id bin al-Musayyab and Abu Salamah bin 'Abd al-Rahman, from Abu Hurayrah (may Allah be pleased with him), that a Jewish woman gave the Prophet (peace and blessings be upon him) a poisoned sheep as a gift, and the Prophet (peace and blessings be upon him) took no action against her (i.e. did not punish her).
Technical note / Defect ('illah): Although Sufyan bin Husayn is thiqah in himself, his narration from Imam al-Zuhri specifically is "weak", and here too he has narrated it from al-Zuhri.
وأخرجه أحمد 15/ (9827)، والبخاري (3169) و (4249) و (5777)، والنسائي (11291) من طريق سعيد المقبري، عن أبي هريرة، قال: لما فُتحت خيبر أُهديتْ لرسول الله ﷺ شاة فيها سُمٌّ، فقال رسول الله ﷺ: "اجمعوا لي من كان هاهنا من اليهود" فجُمعوا له، فقال لهم رسولُ الله ﷺ: "إني سائلكم عن شيءٍ فهل أنتم صادقيَّ عنه؟ قالوا: نعم يا أبا القاسم، فقال لهم رسول الله ﷺ: "هل جعلتم في هذه الشاة سمًّا" فقالوا: نعم، فقال: "ما حملكم على ذلك؟ " فقالوا: أردنا إن كنت كذابًا نستريح منك، وإن كنت نبيًّا لم يَضرَّك.
Reference / Source: Imam Ahmad (15/9827), al-Bukhari (3169, 4249, 5777) and al-Nasa'i (11291) narrated it via Sa'id bin Abi Sa'id al-Maqburi from Abu Hurayrah.
Details of the narration: Abu Hurayrah said that when Khaybar was conquered, a poisoned sheep was given to the Messenger of Allah (peace and blessings be upon him) as a gift. He (peace and blessings be upon him) ordered the Jews who were present there to be gathered and asked them whether they had put poison in it. They admitted it and said: Our aim was that if you were (Allah forbid) a liar, we would be rid of you, and if you were a prophet, this poison would not harm you.
وفي الباب عن أنس بن مالك عند أحمد 21/ (13285)، والبخاري (2617)، ومسلم (2190)، وأبي داود (4508)، غير أنه قال في حديثه: فقيل: ألا نقتُلُها؟ قال: "لا".
Corroborating chains and supporting reports: On this topic there is also a narration from Anas bin Malik (may Allah be pleased with him), which is found in Ahmad (21/13285), al-Bukhari (2617), Muslim (2190) and Abu Dawud (4508).
Details of the narration: In the narration of Anas the wording is that it was asked: "Should we not kill her?" and he (peace and blessings be upon him) said: "No."
وعن جابر بن عبد الله عند أبي داود (4510)، وفيه: فعفا عنها رسول الله ﷺ ولم يعاقبها. ورجاله ثقات لكنه منقطع.
Corroborating chains and supporting reports: From Jabir bin 'Abd Allah (may Allah be pleased with him) there is a narration in Abu Dawud (4510), which mentions that the Messenger of Allah (peace and blessings be upon him) forgave her and did not punish her.
Technical note / Defect ('illah): Its narrators are thiqah, but this chain is "munqati'" (broken).
وعن ابن عباس عند أحمد 5/ (2784) و (3547). وإسناده صحيح. لكن ليس فيه أنَّ النَّبِيّ ﷺ عاقبها أو عفا عنها.
Reference / Source: A narration is reported from Ibn 'Abbas (may Allah be pleased with them both) with Imam Ahmad (5/2784 and 3547).
Grading: Its chain is "sahih".
Note / Clarification: However, it does not state explicitly whether the Prophet (peace and blessings be upon him) punished her or forgave her.
وسيأتي عند المصنّف برقم (7267) عن أبي سعيد الخُدري، وليس فيه كذلك عقوبتها والعفو عنها.
Note / Clarification: This narration will come later with the author (al-Hakim) at number (7267) from Abu Sa'id al-Khudri (may Allah be pleased with him), and it too does not mention punishment or forgiveness.
وعن عبد الرحمن بن كعب بن مالك مرسلًا عند معمر في "جامعه" (19814)، وعبد الرزاق في "مصنفه" (10019)، والبيهقي في "الدلائل" 4/ 260، وسكت أيضًا عن مصير المرأة اليهودية، أعُفي عنها أم قُتِلت. لكن قال الزهري - وهو راويه عن ابن كعب -: فأسلمت فتركها النَّبِيّ ﷺ.
Reference / Source: From 'Abd al-Rahman bin Ka'b bin Malik this narration is reported by a "mursal" route in Ma'mar's "al-Jami'" (19814), 'Abd al-Razzaq's "al-Musannaf" (10019) and al-Bayhaqi's "Dala'il al-Nubuwwah" (4/260).
Note / Clarification: It too is silent about the fate of the woman; however, al-Zuhri (who narrates it from Ibn Ka'b) said that the woman accepted Islam, so the Prophet (peace and blessings be upon him) left her.
وقال معمر: وأما الناس فيقولون: قتلها النَّبِيّ ﷺ.
Note / Clarification: Ma'mar bin Rashid said that people in general say that the Prophet (peace and blessings be upon him) had her killed.
وقال البيهقي في "الدلائل" 4/ 262: يحتمل أنه لم يقتلها في الابتداء، ثم لما مات بشر بن البراء أمر بقتلها. ونحوه قال عياض في "الإكمال" 7/ 93 - 94 والسُّهيلي كما في "الروض الأُنف" له.
Important point: Imam al-Bayhaqi says in "Dala'il al-Nubuwwah" (4/262) that it is possible that at first he (peace and blessings be upon him) did not kill her, but when the Companion Bishr bin al-Bara' (may Allah be pleased with him) died (from that poison), he (peace and blessings be upon him) ordered her to be killed in retaliation. Something similar was said by Qadi 'Iyad in "al-Ikmal" and al-Suhayli in "al-Rawd al-Unuf".
وقال ابن ناصر الدين في "جامع الآثار" 6/ 390: الرواية مصرِّحة بما ظنه البيهقي في حديث ابن سعد الذي رواه عن الواقدي عن رجاله. قلنا: أخرجه ابن سعد 2/ 180، وفيه: أنه لما مات بشر بن البراء دفعها رسول الله ﷺ إلى ولاة بشر بن البراء، فقتلوها. قال الواقدي: وهو الثبت، ووافقه كاتبه وابن سعدٍ لما ساق قصة غزوة خيبر 2/ 102، فقال: وهو الثبت عندنا.
Reference / Source: Ibn Nasir al-Din said in "Jami' al-Athar" (6/390) that the narration of Ibn Sa'd, which he narrated from al-Waqidi from his narrators, states explicitly what al-Bayhaqi supposed. We say: Ibn Sa'd recorded it (2/180), and in it: when Bishr bin al-Bara' died, the Messenger of Allah (peace and blessings be upon him) handed her over to the heirs of Bishr, and they killed her. Al-Waqidi said: this is what is established; and his scribe Ibn Sa'd agreed with him when relating the story of the Battle of Khaybar (2/102), saying: this is what is established in our view.
(1) تحرَّف في نسخنا الخطية إلى: العَدَوي. وإنما هو الغَنَوي، نسبة لغنيّ بن أعصر من قيس عَيلان.
Technical note / Defect ('illah): (1) In the manuscripts this name has been corrupted into "al-'Adawi", whereas the correct name is "al-Ghanawi", an ascription to the tribe of "Ghani bin A'sur" of Qays 'Aylan.
(2) وقع في نسخنا الخطية: حُصين، مصغرًا، وقوله قبل ذلك: وقيل، يقتضي مغايرة ما قبلها لما بعدها. وهما روايتان في اسم والد أبي مرثد.
Technical note / Defect ('illah): (2) In the manuscripts it occurs as "Husayn" (in the diminutive form), whereas his saying before that, "and it is said", requires that what precedes it be different from what follows it. There are two narrations regarding the name of Abu Marthad's father (Hasin and Husayn).
(3) يعني مرتدًا لا أبا مرثد.
Note / Clarification: (3) What is meant here is "Marthad", not Abu Marthad.
