Mustadrak al-Hakim — Hadith 4888

حدثنا أبو علي الحسين بن علي الحافظ، أخبرنا يحيى بن محمد بن صاعد، حدثنا سعيد بن عبد الرحمن المخزومي، حدثنا حسين بن زيد العَلَوي، عن جعفر بن محمد، عن أبيه، عن جده، عن علي: أنَّ رسول الله ﷺ أمرَ فاطمةَ فقال: "زِني شعرَ الحُسين وتَصدّقي بوزِنه فضةً، وأَعطي القابلةَ رِجْلَ العَقيقةِ" (3)
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) commanded Sayyidah Fatimah (may Allah be pleased with her), saying: "Give in charity silver equal to the weight of Husayn's hair, and give the midwife a leg of the aqiqah animal."
This hadith has a sahih (authentic) chain of narration, and the two Shaykhs did not record it.

(3) إسناده ضعيف، حسين بن زيد وهو ابن علي بن الحسين بن علي بن أبي طالب - في حديثه لين ونكارة، كما تقدَّم بيانه برقم (4783)، وقد خالفه في هذا الخبر الثقاتُ من أصحاب جعفر بن محمد - وهو ابن علي بن الحسين بن علي بن أبي طالب - فرووا هذا الخبر عن جعفر عن أبيه مرسلًا، ليس فيه ذكر جده ولا ذكر علي بن أبي طالب.
Grading of the chain: This chain is "da'if". The hadith of Husayn bin Zayd (Ibn 'Ali bin al-Husayn) has "lin" (weakness) and nakarah (objectionable content), as explained at number (4783).
Contradiction: In this report the thiqah students of Ja'far bin Muhammad (al-Sadiq) contradicted Husayn bin Zayd. They narrated it from Ja'far, from his father, in "mursal" form, with no mention in it of his grandfather or of 'Ali bin Abi Talib.
كما خالفوا حسين بن زيد أيضًا في رفع الخبر، إذ جعلوه من فعل فاطمة، ليس فيه أنَّ النبي ﷺ أمرها بذلك.
Technical note (mawquf vs marfu'): They also contradicted Husayn bin Zayd in narrating the report as marfu', since they made it an act of Fatimah (i.e. mawquf), and it does not state that the Prophet (peace and blessings be upon him) commanded her to do so.
وكذلك رواه عن أبي جعفر محمد بن علي بن الحسين مرسلًا من فعل فاطمة: ابن جريج وعمرو بن دينار وربيعةُ بن أبي عبد الرحمن وعبد الملك بن أعين وخالفهم عبدُ الله بن أبي بكر بن محمد بن عمرو بن حزم فرواه عن أبي جعفر محمد بن علي عن علي بن أبي طالب مرفوعًا، لكن راويه عن عبد الله بن أبي بكر هو محمد بن إسحاق بن يَسَار صاحب السيرة، وهو مدلس وقد عنعن، ولو فُرض صحةُ سماعه، يبقى فيه علة انقطاعه بل إعضاله بين أبي جعفر محمد بن علي وبين جد أبيه علي بن أبي طالب. ويبقى فيه كذلك علة رفعه.
Details of the narration: Among those who narrated it from Abu Ja'far Muhammad bin 'Ali bin al-Husayn in "mursal" form, as an act of Fatimah, are Ibn Jurayj, 'Amr bin Dinar, Rabi'ah bin Abi 'Abd al-Rahman and 'Abd al-Malik bin A'yan. They were contradicted by 'Abdullah bin Abi Bakr bin Muhammad bin 'Amr bin Hazm, who narrated it from Abu Ja'far Muhammad bin 'Ali, from 'Ali bin Abi Talib, as "marfu'".
Defect: But the narrator from 'Abdullah bin Abi Bakr is "Muhammad bin Ishaq bin Yasar" (the author of the Sirah), who is a "mudallis" and narrated with "'an". Even if his hearing were assumed to be sound, the defect of "inqita'" (break) - indeed "i'dal" - remains, between Abu Ja'far Muhammad bin 'Ali and his great-grandfather 'Ali bin Abi Talib. The defect of its being marfu' also remains.
هذا، ولم يذكُر إعطاء القابلة رِجْلَ العقيقة أحدٌ من أصحاب جعفر بن محمد الثقات الذين رووا الخبر مرسلًا غير حفص بن غياث، ورواه أيضًا خارجة بن مصعب عن جعفر بن محمد عن أبيه مرسلًا: أنَّ النبي ﷺ هو من فعل ذلك، ولكن خارجةَ هذا متروك. وكذلك لم يذكر هذا الحرفَ أحدٌ ممن رواه عن أبي جعفر محمد بن عليّ.
Technical note (isolated wording in the text): Furthermore, none of the thiqah students of Ja'far bin Muhammad who narrated the report in mursal form mentioned giving the midwife (al-qabilah) a leg of the 'aqiqah animal, except "Hafs bin Ghiyath". Kharijah bin Mus'ab also narrated it from Ja'far bin Muhammad, from his father, in mursal form, that "the Prophet (peace and blessings be upon him) himself did that", but this Kharijah is "matruk". Likewise none of those who narrated it from Abu Ja'far Muhammad bin 'Ali mentioned this detail (giving the leg to the midwife).

Reference / Source: Al-Bayhaqi recorded it in (9/ 304) from Abu 'Abdullah al-Hakim, with this chain.
وأخرجه الدُّولابي في "الذرية الطاهرة" (149) من طريق علي بن الحسن بن علي بن عمر العلوي، عن حسين بن زيد بن علي، عن جعفر بن محمد، عن أبيه مرسلًا. فوافق الثقات من أصحاب جعفر بن محمد وأصحاب أبيه أبي جعفر محمد بن علي في إرساله.
Reference / Source: Al-Dulabi narrated it in "al-Dhurriyyah al-Tahirah" (149) by way of 'Ali bin al-Hasan bin 'Ali bin 'Umar al-'Alawi, from Husayn bin Zayd bin 'Ali, from Ja'far bin Muhammad, from his father, in "mursal" form.
Agreement: In this way he agreed with the thiqah students of Ja'far bin Muhammad and of his father Abu Ja'far Muhammad bin 'Ali in its being "mursal".
وأخرجه البيهقي 9/ 304 من طريق عبد الله بن مسلمة القعنبي، عن سليمان بن بلال، عن جعفر بن محمد، عن أبيه، عن جده: أنَّ فاطمة بنت رسول الله ﷺ ذَبحت عن حسن وحسين حين ولدتهما شاة، وحلقت شعورهما، ثم تصدقت بوزنه فضة. فوافق حسين بن زيد في ذكر جد جعفر بن محمد فقط، ولكن الظاهر أن ذكره وهمٌ:
Reference / Source: Al-Bayhaqi (9/ 304) narrated it by way of 'Abdullah bin Maslamah al-Qa'nabi, from Sulayman bin Bilal, from Ja'far bin Muhammad, from his father, from his "grandfather": "Fatimah, the daughter of the Messenger of Allah (peace and blessings be upon him), slaughtered a sheep for each of Hasan and Husayn when she gave birth to them, shaved their hair, and then gave its weight in silver in charity."
Technical note / Error: Here he agreed with Husayn bin Zayd in mentioning the "grandfather" of Ja'far bin Muhammad, but it appears that mentioning him is an "error" (wahm).
فقد أخرجه ابن سعد في "الطبقات" 6/ 354 عن خالد بن مخلد، عن سليمان بن بلال، عن جعفر بن محمد، عن أبيه مرسلًا، كلفظ القعنبي، فلم يذكر فيه جدَّ جعفر بن محمد ولا عليَّ بن أبي طالب.
Proof (of the error): For Ibn Sa'd narrated it in "al-Tabaqat" (6/ 354) from Khalid bin Makhlad, from Sulayman bin Bilal, from Ja'far bin Muhammad, from his father, in "mursal" form, in the same wording as al-Qa'nabi, but he did not mention in it the grandfather of Ja'far bin Muhammad or 'Ali bin Abi Talib.
وأخرجه مالك 2/ 501، ومن طريقه ابن سعد 6/ 354 و 355، وأبو داود في "المراسيل" (380)، والبيهقي في "الكبرى" 9/ 403، وفي "شعب الإيمان" (8262)، وفي "معرفة السنن والآثار" (19142)، وأبو محمد البغوي في "شرح السنة" (2819)، وأخرجه ابن سعد 6/ 354، والدولابي في "الذُّرّية الطاهرة" (146) من طريق أبي ضمرة أنس بن عياض، وابن أبي الدنيا في "العيال" (49) من طريق يحيى بن سعيد القطان، وأبو طاهر السِّلَفي في "معجم السَّفَر" (1134) من طريق سفيان الثوري، كلهم (مالك وأنس بن عياض ويحيى القطان والثوري) عن جعفر بن محمد، عن أبيه، مرسلًا، من فعل فاطمة. أما مالك فلفظه: وزنت فاطمة بنت رسول الله ﷺ شعر حسن وحسين وزينب وأم كلثوم، فتصدقت بزنة ذلك فضة. ولفظ أنس بن عياض: أنَّ فاطمة حلقت حسنًا وحسينًا يوم سابعهما، فوزنت، شعرهما، فتصدقت بوزنه فضة. ونحوه لفظ الثوري غير أنه لم يذكر يوم السابع، ولفظ يحيى القطان: أنَّ فاطمة كانت تعقُّ عن كل ولد لها شاة، وتحلق رأسه يوم السابع، وتتصدق بوزنه ذهبًا. كذا وقع في رواية يحيى القطان بذكر الذهب بدل الفضة، وهو مخالفٌ لسائر روايات الخبر فلا اعتداد به.
Reference / Routes: This narration was narrated by Imam Malik (2/ 501), and through his route by Ibn Sa'd (6/ 354, 355), Abu Dawud in "al-Marasil" (380), al-Bayhaqi in "al-Kubra" (9/ 403), "Shu'ab al-Iman" (8262) and "Ma'rifat al-Sunan wa al-Athar" (19142), and Abu Muhammad al-Baghawi in "Sharh al-Sunnah" (2819). Also Ibn Sa'd (6/ 354) and al-Dulabi in "al-Dhurriyyah al-Tahirah" (146) narrated it by way of Abu Damrah Anas bin 'Iyad; Ibn Abi al-Dunya in "al-'Iyal" (49) by way of Yahya bin Sa'id al-Qattan; and Abu Tahir al-Silafi in "Mu'jam al-Safar" (1134) by way of Sufyan al-Thawri. All of them (Malik, Anas, Yahya and al-Thawri) narrate it from Ja'far bin Muhammad, from his father, in "mursal" form, as an act of Fatimah.
Difference in the text: Malik's wording is: "Fatimah, the daughter of the Messenger of Allah (peace and blessings be upon him), weighed the hair of Hasan, Husayn, Zaynab and Umm Kulthum, and gave its weight in silver in charity." Anas bin 'Iyad's wording is: "Fatimah shaved Hasan and Husayn on their seventh day, then weighed their hair and gave its weight in silver in charity." Al-Thawri's wording is similar, except that he did not mention the seventh day. Yahya al-Qattan's wording is: "Fatimah used to offer a sheep as 'aqiqah for each child of hers, shave its head on the seventh day, and give its weight in gold in charity."
Defect: In Yahya al-Qattan's narration "gold" is mentioned in place of silver, which goes against all the other narrations of the report, so no weight is given to it.
وأخرج ابن أبي الدنيا (51) من طريق خارجة بن مصعب عن جعفر بن محمد، عن أبيه: أنَّ النبيَّ ﷺ عن الحسن والحُسين بكبش كبش وحلق رؤوسهما يوم السابع، وتصدق بوزن شعرهما وَرِقًا، فأعطى الرّجُلَ القابلة. فوافق حسين بن زيد في رفع الخبر، بل جعله من فعل النبي ﷺ نفسه، مع موافقته السائر أصحاب جعفر في إرساله، ولكن خارجة هذا متروك واهٍ.
Reference / Marfu': Ibn Abi al-Dunya (51) narrated by way of Kharijah bin Mus'ab, from Ja'far bin Muhammad, from his father: "The Prophet (peace and blessings be upon him) offered a ram each as 'aqiqah for al-Hasan and al-Husayn, shaved their heads on the seventh day, gave the weight of their hair in silver in charity, and gave the leg (of the animal) to the midwife."
Technical note: He agreed with Husayn bin Zayd in narrating the report as "marfu'", indeed he made it an act of the Prophet (peace and blessings be upon him) himself, although, like the rest of Ja'far's students, he kept it "mursal". But this Kharijah (bin Mus'ab) is "matruk and wahin" (extremely weak).
وأخرجه مالك 2/ 501، ومن طريقه ابن سعد 6/ 354، والبيهقي في "الكبرى" 9/ 299 عن ربيعة بن أبي عبد الرحمن وعبد الرزاق (7974)، وابن سعد 6/ 355، وابن أبي الدنيا في "العيال" (80) من طريق عمرو بن دينار، وعبد الرزاق (7973) عن ابن جريج، وابن أبي شيبة 8/ 241 من طريق عبد الملك بن أعين أربعتهم عن أبي جعفر محمد بن علي بن الحسين، مرسلًا. أما لفظ عمرو بن دينار فهو: كانت فاطمة إذا وَلَدَت حلقت شعره، ثم تصدقت بوزنه وَرقًا. ونحوه لفظ ابن جريج، وأما ربيعة فقال: وزَنت فاطمة بنت رسول الله ﷺ شعر حسن وحسين، فتصدقت بوزنه فضة. وأما ابن أعين فلفظه: كانت فاطمة تعقُّ عن ولدها يوم السابع، وتسميه، وتختنه، وتحلق رأسه، وتتصدق بوزنه وَرِقًا. وزاد ابن جريج في روايته: قالت يعني فاطمة: وكان أبي يفعل ذلك. تعني أن النبي ﷺ كان يفعل ذلك في ولده.
Reference / Corroborations: Malik (2/ 501) narrated it (and through his route Ibn Sa'd 6/ 354 and al-Bayhaqi in "al-Kubra" 9/ 299) from Rabi'ah bin Abi 'Abd al-Rahman; 'Abd al-Razzaq (7974), Ibn Sa'd (6/ 355) and Ibn Abi al-Dunya in "al-'Iyal" (80) by way of 'Amr bin Dinar; 'Abd al-Razzaq (7973) from Ibn Jurayj; and Ibn Abi Shaybah (8/ 241) by way of 'Abd al-Malik bin A'yan. All four of them (Rabi'ah, 'Amr, Ibn Jurayj and Ibn A'yan) narrate it from Abu Ja'far Muhammad bin 'Ali bin al-Husayn in "mursal" form.
Difference in wording: 'Amr bin Dinar's wording is: "When Fatimah gave birth, she would shave the child's hair and then give its weight in silver in charity." Ibn Jurayj's wording is similar. Rabi'ah said: "Fatimah, the daughter of the Messenger of Allah (peace and blessings be upon him), weighed the hair of Hasan and Husayn and gave its weight in silver in charity." Ibn A'yan's wording is: "Fatimah used to offer the 'aqiqah for her child on the seventh day, name it, circumcise it, shave its head and give its weight in silver in charity." Ibn Jurayj added in his narration that Fatimah said: "And my father (the Prophet, peace and blessings be upon him) used to do that," meaning that the Prophet used to do that for his children.
وخالفهم عبدُ الله بن أبي بكر عند الترمذي (1519) وغيره من طريق محمد بن إسحاق، عنه، عن محمد بن علي بن الحسين، عن عليّ بن أبي طالب قال: عَقَّ رسولُ الله عن الحَسَن بشاةٍ، وقال: يا فاطمة احلِقي رأسَه، وتصدقي بزِنَةِ شعره فضة" قال: فوزنته، فكان وزنه درهمًا أو بعض درهم. كذا رفعه وجعله من فعل رسول الله ﷺ في الحَسَن بن علي فقط، وذكر في إسناده عليّ بن أبي طالب، ورجاله لا بأس بهم، لكن قال الترمذي بعد أن حَسَّنه: إسناده ليس بمتصل، وأبو جعفر محمد بن علي بن الحسين لم يدرك علي بن أبي طالب. قلنا: وفيه أيضًا عنعنةُ محمد ابن إسحاق - وهو ابن يَسَار المطلبي - فقد كان مدلسًا، ولم يقع لنا في شيء من طرقه تصريحه بالسماع.
Technical note (variation): All of them were contradicted by 'Abdullah bin Abi Bakr, in al-Tirmidhi (1519) and elsewhere, by way of Muhammad bin Ishaq, from him, from Muhammad bin 'Ali bin al-Husayn, from 'Ali bin Abi Talib, who said: "The Messenger of Allah (peace and blessings be upon him) offered a sheep as 'aqiqah for al-Hasan and said: O Fatimah, shave his head and give the weight of his hair in silver in charity." He said: So I weighed it, and its weight was a dirham or part of a dirham. In this way he narrated it as "marfu'" and made it an act of the Prophet (peace and blessings be upon him) for al-Hasan alone, and mentioned 'Ali bin Abi Talib in its chain. Its narrators are "la ba'sa bihim", but al-Tirmidhi, after declaring it hasan, said: "Its chain is not connected; Abu Ja'far Muhammad bin 'Ali did not live in the time of 'Ali bin Abi Talib." We say: It also contains the "'an'anah" of Muhammad bin Ishaq (Ibn Yasar al-Muttalibi); he was a mudallis, and we have not found in any of its routes his explicit statement of having heard it.
وأخرج منه إعطاء القابلة رجلَ العقيقة: ابن أبي شيبة 8/ 242، وأبو داود في "المراسيل" (379)، والبيهقي 9/ 302 من طريق حفص بن غياث، عن جعفر بن محمد، عن أبيه مرسلًا: أنَّ رسول الله ﷺ أمر بالعقيقة التي عقَّتها فاطمة عن الحسن والحسين يبعثوا إلى القابلة منها برِجْلٍ، قال: "ولا يُكسر فيها عظم".
Reference (the midwife's share): The giving of the 'aqiqah leg to the midwife was narrated by Ibn Abi Shaybah (8/ 242), Abu Dawud in "al-Marasil" (379) and al-Bayhaqi (9/ 302) by way of Hafs bin Ghiyath, from Ja'far bin Muhammad, from his father, in "mursal" form: "The Messenger of Allah (peace and blessings be upon him) commanded that from the 'aqiqah which Fatimah offered for al-Hasan and al-Husayn a leg be sent to the midwife," and he said: "And no bone of it is to be broken."
ويشهد لرواية حسين بن زيد المرفوعة في أمر فاطمة بالتصدق بوزن شعر ولدها فضةً: حديثُ أبي رافع عند أحمد 39 / (23877)، و 45 / (27183) و (27196): أنَّ الحسن بن عليٍّ لما ولد أرادت أمُّه فاطمة أن تعُقَّ عنه بكبشين، فقال رسول الله ﷺ: "لا تعُقِّي عنه، ولكن احلِقي شعر رأسه، ثم تَصدَّقي بوزنه من الوَرِق في سبيل الله"، ثم وُلد حسين بعد ذلك، فصنعت مثل ذلك. وإسناده ضعيف.
Supporting reports: The marfu' narration of Husayn bin Zayd (in which Fatimah is commanded to give silver in charity equal to the weight of her child's hair) is supported by the hadith of Abu Rafi', which is in Ahmad (39/ 23877 and 45/ 27183, 27196): "When al-Hasan bin 'Ali was born, his mother Fatimah wanted to offer two rams as 'aqiqah for him, but the Messenger of Allah (peace and blessings be upon him) said: Do not offer an 'aqiqah for him; rather, shave the hair of his head, then give its weight in silver in charity in the way of Allah." Then when al-Husayn was born after that, she did the same.
Grading of the chain: Its chain is "da'if".
