Mustadrak al-Hakim — Hadith 4873

It is narrated from al-Sha'bi that when Sayyiduna Hasan bin Ali (may Allah be pleased with them both) made peace with Mu'awiyah, he addressed us at al-Nukhaylah. He stood up, praised and extolled Allah, and then said: "Indeed, the greatest of wisdom is piety (taqwa), and the greatest of incapacity is sin and disobedience. And indeed this matter over which Mu'awiyah and I differed was either the right of a man who was more entitled to it than I, or it was my right which I gave up to Mu'awiyah for the sake of the welfare of the Muslims and to spare their blood. 'And I do not know; perhaps it is a trial for you and an enjoyment for a time' [Surah al-Anbiya: 111]. I say these words of mine, and I seek Allah's forgiveness for myself and for you."

Hadith Grading
Explanation & Benefits
Shaykh Adil Murshid et al.
Correction of the text / place: In manuscript (B) this word has been distorted into "al-Nakhlah", and in (S, M, 'A) into "al-Mukhaylah" (with mim). The correct word is "al-Nukhaylah", the diminutive of nakhlah, and it is the name of a place near Kufah.

Grading of the report: This report is "qawi" (strong). This chain is "da'if" because of the weakness of Mujalid bin Sa'id, but despite his weakness he is considered for corroboration (yu'tabaru bihi). The sermon of al-Hasan bin 'Ali on the occasion of his peace settlement with Mu'awiyah is narrated through several routes. Sufyan is "Ibn 'Uyaynah" and al-Sha'bi is "'Amir bin Sharahil".
Reference / Sources: Ibn Abi Shaybah (11/ 142 and 15/ 100), al-Tabarani in "al-Kabir" (2559), Abu Nu'aym al-Asbahani in "al-Hilyah" (2/ 37) and "Ma'rifat al-Sahabah" (1759), al-Bayhaqi in "al-Kubra" (8/ 173) and "Dala'il al-Nubuwwah" (6/ 444), and Ibn 'Asakir in "Tarikh Dimashq" (13/ 274) narrated it through various routes from Sufyan bin 'Uyaynah, with this chain.
Reference / Source: Ibn Sa'd (6/ 384), al-Bayhaqi in "al-Kubra" (8/ 173) and "al-Dala'il" (6/ 444), and Ibn 'Asakir (13/ 273, 274) narrated it by way of Hushaym bin Bashir, from Mujalid bin Sa'id, with this chain.
Reference and details: Al-Lalaka'i in "Sharh Usul al-I'tiqad" (2799) and Ibn 'Asakir (13/ 275) narrated something similar by way of 'Amr bin Dinar al-Makki. It contains an addition not found in al-Sha'bi's narration: al-Hasan bin 'Ali's consulting his cousin 'Abdullah bin Ja'far bin Abi Talib about the peace settlement; and that al-Hasan and his brother al-Husayn both agreed to the settlement, after an initial dispute between them, following which al-Husayn came round to the view of his brother al-Hasan. All of its narrators are thiqah. Similarly, Ibn Sa'd (6/ 383), and through his route Ibn 'Asakir (13/ 275), narrated it by way of 'Awf al-A'rabi; and Ma'mar in his "al-Jami'" (20980), and through his route al-Ajurri in "al-Shari'ah" (1661), al-Tabarani in "al-Kabir" (2748), and al-Bayhaqi in "al-Kubra" (8/ 173) and "al-Dala'il" (6/ 444), narrated it from Ayyub al-Sakhtiyani. Both of them ('Awf and Ayyub) narrate it from Muhammad bin Sirin, and mention the sermon in abridged form.
Reference / Source: Likewise Ahmad bin Hanbal narrated something similar in "Fada'il al-Sahabah" (1355), and through his route Ibn 'Asakir (13/ 272), via 'Abdullah bin 'Awn, from Anas bin Sirin (the brother of Muhammad bin Sirin), and he too mentioned the sermon in abridged form.
Linguistic explanation: "Al-kays": intelligence. And "al-'ajz": its opposite (foolishness/incapacity).
