حدثنا أبو بكر محمد بن عبد الله بن الجرَّاح العَدْل الحافظ بمَرْو، حدثنا عبد الله بن يحيى القاضي السَّرْخَسي، حدثنا رجاء بن مُرجَّى الحافظ قال: اجتمعنا في مسجد الخَيْف أنا وأحمدُ بن حنبل وعليُّ بن المَدِيني ويحيى بنُ مَعِين فتناظَرُوا في مسِّ الذَّكَر، فقال يحيى بن معين: يُتوضَّأ منه، وتقلَّد عليُّ بن المَدِيني قولَ الكوفيين وقال به، فاحتجَّ يحيى بن معين بحديث بُسْرة بنت، صفوان، واحتَجَّ علي بن المديني بحديث قيس بن طَلْق عن أبيه (2)، وقال ليحيى بن معين: كيف تتقلَّد إسنادَ بُسْرة ومروانُ إنما أرسَلَ شُرطيًّا حتى ردَّ جوابها إليه؟ فقال يحيى: ثم لم يُقنِعْ ذلك عروةَ حتى أَتى بسرةَ فسألها وشافَهَتْه بالحديث، ثم قال يحيى: ولقد أكثَرَ الناسُ في قيس بن طَلْق وأنه لا يُحتَجُّ بحديثه، فقال أحمد بن حنبل ﵁: كِلا الأمرين على ما قلتما، فقال يحيى: [عن مالك عن نافع عن ابن عمر: أنه توضَّأ من مسِّ الذَّكَر، فقال عليٌّ: كان ابن مسعود يقول] (3): لا يُتوضَّأُ منه، وإنما هو بَضْعة من جسدك، فقال يحيى: هذا عمَّن؟ فقال: عن سفيان عن أبي قيس عن هُزَيل عن عبد الله، وإذا اجتمع ابنُ مسعود وابنُ عمر واختَلفا، فابنُ مسعود أَولى أن يُتَّبَع، فقال له أحمد بن حنبل: نعم، ولكن أبو قيس الأَوْدي لا يُحتَجُّ بحديثه، فقال علي: حدثني أبو نُعيم، حدثنا مِسعَر، عن عُمَير بن سعيد [عن عمَّار قال: ما أُبالي مَسِستُه أو أنفي، فقال يحيى: بين عُمَير بن سعيد] (1) وعمَّار بن ياسر مَفَازةٌ.
Raja' bin Murajja says: I, Ahmad bin Hanbal, Ali bin al-Madini and Yahya bin Ma'in gathered in Masjid al-Khayf, and a debate took place about touching the private part (mass al-dhakar). Yahya bin Ma'in said that it breaks ablution and cited the hadith of Busrah bint Safwan as evidence, while Ali bin al-Madini adopted the view of the Kufans and cited the hadith of Qays bin Talq from his father (in which it is called a part of the body) as evidence. Ali bin al-Madini said to Yahya: How can you rely on the chain of Busrah when Marwan only sent a message through a guard? Yahya replied that Urwah was not satisfied with that, but went himself and heard it from Busrah; then Yahya criticised Qays, the narrator of the hadith of Talq bin Ali, saying that he is not used as proof. Ahmad bin Hanbal said that both points carry weight in their place. Then Yahya presented the report of Ibn Umar performing ablution (from it), and Ali bin al-Madini presented the saying of Ibn Mas'ud: "Ablution is not performed because of it; it is only a piece of your body." Yahya asked: From whom is this? He said: From Sufyan, from Abu Qays, from Huzayl, from Abdullah; and he said that when Ibn Mas'ud and Ibn Umar differ, following Ibn Mas'ud is more appropriate. Ahmad bin Hanbal said: Yes, but Abu Qays al-Awdi, who is in this chain, is not used as proof. Then Ali said: Abu Nu'aym narrated to me, from Mis'ar, from Umayr bin Sa'id, from Ammar, who said: "I do not mind whether I touch it or my nose." Yahya said: Between Umayr bin Sa'id and Ammar bin Yasir there is a desert (i.e. the chain is broken).

(2) طلق بن علي قال: سأل رجل رسولَ الله ﷺ: أيتوضأ أحدنا إذا مسَّ ذكره؟ قال: "إنما هو بَضْعة منك"، أخرجه أحمد 26/ (16286)، وهو حديث حسن، وانظر تتمة تخريجه هناك. Details of the narration: Talq bin 'Ali (may Allah be pleased with him) narrates that a man asked the Messenger of Allah (peace and blessings be upon him): Should one of us perform wudu' if he touches his private part? He (peace and blessings be upon him) said: "It is only a part of you." Grading: This narration of Imam Ahmad 26/ (16286) is hasan; see its full takhrij at that place.
(3) ما بين المعقوفين مكانه بياض في النسخ الخطية، واستُدرك من "السنن الكبرى" 1/ 136 و"الخلافيات" (598) كلاهما للبيهقي، حيث أخرجه فيهما عن أبي عبد الله الحاكم. Note / Clarification: The part between the brackets was blank in the manuscripts, and it was completed from Imam al-Bayhaqi's books "al-Sunan al-Kubra" 1/ 136 and "al-Khilafiyyat" (598), where he recorded it from Imam al-Hakim.
(1) ما بين المعقوفين سقط من النسخ الخطية، واستدركناه من كتابي البيهقي، وهو موافق لما في "سنن الدارقطني" (545) فقد أخرجه عن محمد بن الحسن النقَّاش، عن عبد الله بن يحيى السرخسي، به. Note / Clarification: The bracketed part had dropped out of the manuscripts; we have completed it from Imam al-Bayhaqi's two books, and this text agrees with "Sunan al-Daraqutni" (545), where he recorded it with the chain Muhammad bin al-Hasan al-Naqqash from 'Abd Allah bin Yahya al-Sarakhsi.
