ما أخبرني عبد الله بن محمد بن موسى، أخبرنا محمد بن أيوب، أخبرنا إبراهيم بن موسى ويحيى بن المغيرة قالا: حدثنا جَرِير، عن عبد الملك بن عُمَير، عن عبد الرحمن بن أبي ليلى، عن معاذ بن جَبَل: أنه كان قاعدًا عند النبي ﷺ، فجاءَه رجل فقال: يا رسول الله، ما تقول في رجلٍ أصابَ من امرأةٍ لا تَحِلُّ له، فلم يَدَعْ شيئًا [يصيبه الرجلُ من امرأته إلّا وقد أصابه منها، إلّا أنه لم يُجامِعْها، فقال: "توضَّأْ] (1) وضوءًا حَسَنًا، ثمَّ قُمْ فَصَلِّ"، قال: وأنزل الله ﷿: ﴿وَأَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ﴾ الآية [هود: 114] قال: فقال: هي لي خاصةً أم للمسلمين عامةً؟ قال: "بل هي للمسلمين عامّةً" (2). هذه الأحاديث والتي ذكرتها أنَّ الشيخين اتفقا عليها غيرَ أنها مخرَّجة في الكتابين بالتفاريق وكلُّها صحيحة، دالَّةٌ على أنَّ اللَّمسَ الذي يُوجِبُ الوضوءَ دون الجِماع.
It is narrated from Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) that he was sitting with the Prophet (peace and blessings be upon him) when a man came and said: O Messenger of Allah! What is the ruling regarding a man who did with a woman who was not lawful for him (physically) everything that a man does with his wife, except intercourse? He (peace and blessings be upon him) said: "Perform ablution well, then stand and pray." The narrator says that upon this Allah, the Mighty and Majestic, revealed this verse: "And establish prayer at the two ends of the day and in some hours of the night" [Surah Hud: 114]. The man asked: Is this ruling for me specifically or for all Muslims? He (peace and blessings be upon him) said: "Rather, it is general for all the Muslims."
All these hadiths are sahih (authentic) and indicate that the "lams" (touching) which makes ablution obligatory is physical touching other than intercourse.

Note / Clarification: The text between these square brackets was a blank space in the original manuscripts; we have completed it from "Sunan al-Bayhaqi" 1/ 125, where Imam al-Bayhaqi recorded it from the author (al-Hakim) with his chain and text.
(2) صحيح لغيره، وهذا إسناد رجاله ثقات إلّا أنه منقطع، عبد الرحمن بن أبي ليلى لم يدرك معاذًا. جرير: هو ابن عبد الحميد. Grading: This narration is "sahih li-ghayrihi" on the strength of its supporting reports; although the narrators of the present chain are thiqah (trustworthy), it is "munqati'" (broken). Technical note / Defect ('illah): 'Abd al-Rahman bin Abi Layla did not meet Mu'adh bin Jabal (may Allah be pleased with him). "Jarir" in the chain refers to Jarir bin 'Abd al-Hamid. وأخرجه أحمد 36/ (22112)، والترمذي (3113) من طريق زائدة بن قُدامة، عن عبد الملك بن عمير، بهذا الإسناد. وأعلَّه الترمذي بالانقطاع. Reference / Source: It was recorded by Imam Ahmad at 36/ (22112) and Imam al-Tirmidhi at (3113) through Za'idah bin Qudamah, from 'Abd al-Malik bin 'Umayr, with this same chain. Technical note / Defect ('illah): Imam al-Tirmidhi declared this chain defective (weak) on account of the break (inqita'). وأخرجه النسائي (7287) من طريق شعبة، عن عبد الملك بن عمير، عن ابن أبي ليلى، عن النبي ﷺ مرسلًا. Reference / Source: Imam al-Nasa'i recorded it at (7287) through Shu'bah, from 'Abd al-Malik bin 'Umayr, from Ibn Abi Layla, from the Prophet (peace and blessings be upon him) as "mursal". وفي الباب عن ابن مسعود عند البخاري (526)، ومسلم (2763)، وهو في "مسند أحمد" 6/ (3653)، وانظر تتمة شواهده هناك. Corroborating chains and supporting reports: On this topic there is a narration from Ibn Mas'ud (may Allah be pleased with him) in Imam al-Bukhari (526) and Imam Muslim (2763), and it is also in "Musnad Ahmad" 6/ (3653); refer there for the rest of its supporting reports.
