Mustadrak al-Hakim — Hadith 47

أخبرنا أبو عبد الله الحسين بن الحسن بن أيوب النَّوْقاني، حدثنا أبو يحيى عبد الله بن أحمد بن زكريا بن أبي مَسَرَّة (4) المكّي. وأخبرنا أبو عبد الله محمد بن عبد الله الصَّفّار وأبو بكر بن إسحاق الفقيه قالا: أخبرنا بِشْر بن موسى؛ قالا: حدثنا عبد الله بن يزيد المقرئ، حدثنا سليمان بن المغيرة، عن حُمَيد بن هلال قال: أتاني أبو العاليَةِ أنا وصاحبًا لي فقال: هَلُمَّا فأنتما أَشبُّ وأَوعى للحديث مني، فانطلقَ بنا حتى أَتينا نصرَ بن عاصم اللَّيثي، فقال: حَدِّثْ هذَينِ حديثَك، قال نصرٌ: حدثنا عُقْبةُ (1) بن مالك - وكان من رَهْطه - قال: بَعَثَ رسولُ الله ﷺ سَرِيَّةً فأَغاروا على قوم فشَذَّ رجل من القوم فأتبَعَه رجل من السَّرِيّة معه السيفُ شاهرٌ، فقال الشاذُّ من القوم: إني مسلم، فلم يَنظُرْ فيها، فضربه فقتله، فنُمِيَ الحديثُ إلى رسول الله ﷺ، فقال قولًا شديدًا، فبلغ القاتلَ، فبينما رسول الله ﷺ يَخطُبُ إذ قال القاتل: يا رسول الله، والله ما قالَ الذي قال إلّا تعوُّذًا من القتل، فأَعرَضَ عنه رسولُ الله ﷺ وعمَّن قِبَلَه من الناس، وأخذ في خُطْبته، ثم قال الثانيةَ: يا رسول الله، والله ما قال الذي قال إلَّا تعوُّذًا من القتل، فأعرضَ عنه رسولُ الله ﷺ وعمَّن قِبَلَه من الناس، وأَخذ في خُطْبته، ثم لم يَصبِرْ أن قال الثالثةَ: والله يا رسول الله ما قال الذي قال إلّا تعوُّذًا من القتل، فأقبلَ عليه رسول الله ﷺ تُعرَفُ المَسَاءةُ في وجهه، ثم قال: "إنَّ الله ﷿ أَبَى عليَّ من قتلَ مؤمنًا"؛ قالها ثلاثًا (2).
هذا حديث مخرَّج مثلُه في "المسند الصحيح" لمسلم، فقد احتجَّ بنصر بن عاصم الليثي وسليمان بن المغيرة، فأما عُقْبة بن مالك اللَّيثي فإنه صحابي مُخرَّج حديثه في كتب الأئمة في الوُحْدان، وقد بيَّنتُ شَرْطي في أول الكتاب بأني أُخرج حديث الصحابة عن آخرهم، إذا صحَّ الطريقُ إليهم. وقد تابع يونسُ بنُ عُبيد سليمانَ بن المغيرة على روايته عن حُميدٍ على شرط مسلم:

It is narrated from Sayyiduna Uqbah bin Malik (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) sent out a detachment, and they raided a people. A man fled from them (to save his life), and a man from the detachment pursued him with a drawn sword. The man said: I am a Muslim. But the pursuer paid no attention to it, struck him and killed him. News of this reached the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) expressed severe displeasure at it. This reached the killer, and while the Messenger of Allah (peace and blessings be upon him) was delivering a sermon, he said: O Messenger of Allah, by Allah, he only said what he said to save himself from being killed. The Messenger of Allah (peace and blessings be upon him) turned his blessed face away from him and from the people on his side, and continued his sermon. Then he said a second time: O Messenger of Allah, by Allah, he only said what he said to save himself from being killed. He (peace and blessings be upon him) again turned away from him and from the people on his side, and continued his sermon. Then he could not restrain himself and said a third time: By Allah, O Messenger of Allah, he only said what he said to save his life. Then the Messenger of Allah (peace and blessings be upon him) turned towards him, with signs of displeasure clearly visible on his (peace and blessings be upon him) blessed face, and said: "Indeed, Allah, the Mighty and Majestic, has refused me (any leniency on behalf of) whoever kills a believer." He (peace and blessings be upon him) said this three times.
A hadith like this is found in Imam Muslim's "al-Musnad al-Sahih"; he used Nasr bin Asim al-Laythi and Sulayman bin al-Mughirah as evidence. As for Uqbah bin Malik al-Laythi, he is a Companion, and his hadith is mentioned in the books of the Imams among the 'wuhdan' (Companions from whom only one narrator reports). I have already made clear my condition at the beginning of the book, that I will record the hadiths of all the Companions, provided the route reaching them is sound. Yunus bin Ubayd corroborated Sulayman bin al-Mughirah, narrating it from Humayd on the condition of Imam Muslim:

Grading: (2) Its chain is "sahih", provided that the author's narration (with the mention of Nasr bin 'Asim) is "mahfuz" (preserved).
فقد أخرجه أحمد 37/ (22490)، والنسائي (8539)، وابن حبان (5972) من طرق عن سليمان بن المغيرة، بهذا الإسناد - ووقع عندهم: بشر بن عاصم، بدل نصر بن عاصم، وهما أخوان، وكلاهما لا بأس به ونصر أوثقُهما.
Reference / Source: For Ahmad 37/ (22490), al-Nasa'i (8539) and Ibn Hibban (5972) narrated it through various routes from Sulayman bin al-Mughirah with this same chain, but in their versions it is "Bishr bin 'Asim" (in place of Nasr).
Grading: The two are brothers and both are "la ba'sa bihi" (unobjectionable), but Nasr is the more trustworthy of them.
قوله: "أبى عليَّ" أي: استغفرتُ للقاتل فأبى عليَّ مغفرته، وما استجاب لي فيه. قاله السندي في حاشيته على "مسند أحمد".
Note / Clarification: "Aba 'alayya": i.e. I sought forgiveness for the killer, but He refused me his forgiveness and did not answer me concerning him. Al-Sindi said this in his marginal notes on "Musnad Ahmad".
