حدثنا علي بن حَمْشَاذَ، حدثنا محمد بن عيسى بن السَّكَن الواسطي، حدثنا عَمْرو بن عَوْن، حدثنا سفيان، عن عبيد الله بن أبي يزيد قال: كان ابن عباس إذا سُئِلَ عن شيءٍ فكان في كتاب الله، قال به، فإن لم يكن في كتاب الله وكان من رسول الله ﷺ فيه شيءٌ، قال به فإن لم يكن عن رسول الله ﷺ فيه شيءٌ، قال بما قال به أبو بكر وعمر، فإن لم يكن لأبي بكر وعمر فيه شيء، قال برأْيةِ (4). هذا حديث صحيح على شرط الشيخين وفيه توقيف، ولم يُخرجاه. It is narrated from Ubaydullah bin Abi Yazid that when Sayyiduna Ibn Abbas (may Allah be pleased with them both) was asked about something and it was in the Book of Allah, he would give his ruling according to it; if it was not in the Book of Allah but something was narrated about it from the Messenger of Allah (peace and blessings be upon him), he would state that; if it was not found there either, he would tell what Abu Bakr and Umar (may Allah be pleased with them both) had said; and if nothing was found from them either, he would answer with his own opinion (ijtihad).
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), and it is mawquf (a statement of the Companion himself), but they did not record it.

Technical note / Defect ('illah): "Sufyan" mentioned in the chain here is Sufyan bin 'Uyaynah. وأخرجه البيهقي في "المدخل إلى السنن الكبرى" (73) عن أبي عبد الله الحاكم، بهذا الإسناد. Reference / Source: Imam al-Bayhaqi narrated it in "al-Madkhal ila al-Sunan al-Kubra" (73) from Abu 'Abd Allah al-Hakim with this same chain. وأخرجه ابن أبي شيبة 7/ 242، والدارمي (168)، والبيهقي في "السنن الكبرى" 10/ 115، والخطيب البغدادي في "الفقيه والمتفقه" (542) و (543)، وابن عبد البر في "بيان العلم وفضله" (1601) و (1602) من طرق عن سفيان بن عيينة، به.
