Mustadrak al-Hakim — Hadith 441

أخبرنا أبو محمد عبد الله بن محمد بن إسحاق الفاكِهي بمكة، حدثنا أبو يحيى بن أبي مَسَرّة، حدثنا أبو عبد الرحمن المقرئ، حدثنا سعيد بن أبي أيوب، عن بكر بن عَمْرو، عن مسلم بن يَسَار، عن أبي هريرة قال: قال رسول الله ﷺ: "مَن أَفتى الناسَ بغير عِلْم، كان إثمُه على من أَفتاه" (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه، ولا أعرفُ له عِلَّة.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever gives people a fatwa without knowledge, its sin will be upon the one who gave the fatwa."
This hadith is sahih on the condition of the two Shaykhs, but they did not record it, and I do not know of any hidden defect ('illah) in it.

(1) إسناده محتمل للتحسين كما سلف عند الحديث رقم (354)، وهذا الطريق قد اختلف فيه على أبي عبد الرحمن المقرئ - وهو عبد الله بن يزيد - فمن الرواة عنه من أسقط الواسطة في هذا الإسناد بين بكر بن عمرو ومسلم بن يسار، وهو عمرو بن أبي نعيمة، ومنهم من أثبتها، والصواب - والله أعلم - في حديث المقرئ إثباتها، فهو كذلك في كتابه كما رواه عنه أحمد في "مسنده" 14/ (8266)، فلعله كان إذا روى من حفظه أسقطه، حفظه أسقطه، والكتاب أيقن وأثبت من الحفظ، وقد تابعه غيره على إثبات هذه الواسطة كما سلف.
Grading: Its chain can possibly be graded "hasan", as stated under hadith (354).
Technical note / Defect ('illah): In this route there is disagreement among those narrating from Abu 'Abd al-Rahman al-Muqri' ('Abd Allah bin Yazid): some of them dropped the intermediary between Bakr bin 'Amr and Muslim bin Yasar, namely 'Amr bin Abi Nu'aymah, while others retained it.
Important point: The correct view is that in al-Muqri''s narration the intermediary is established, because it is recorded that way in his own book, as Imam Ahmad narrated from him in the "Musnad" (14/ 8266). Probably, when he narrated from memory, he would drop it, whereas a written book is more reliable than memory; and other narrators also corroborated him in retaining this intermediary.
وأخرجه كرواية المصنف هنا: أبو داود (3657) عن الحسن بن علي الحلواني، عن أبي عبد الرحمن المقرئ، بهذا الإسناد.
Reference / Source: Imam Abu Dawud narrated it in his Sunan (3657) through the route of al-Hasan bin 'Ali al-Hulwani, from Abu 'Abd al-Rahman al-Muqri' ('Abd Allah bin Yazid), with this same chain, just as in the narration of the author (al-Hakim) here.
