Mustadrak al-Hakim — Hadith 4288

حدثني أبو بكر محمد بن داود بن سليمان الزاهد، حدثنا أبو علي محمد بن محمد بن الأشْعَث الكوفي بمصر، حدثني أبو الحسن موسى بن إسماعيلَ بن موسى بن جعفر بن محمد بن علي، حدثني أبي إسماعيلُ، عن أبيه موسى بن جعفر، عن أبيه جعفر بن محمد، عن أبيه، عن جده علي بن الحُسين، عن أبيه الحسين ابن علي، عن أبيه علي بن أبي طالب: أنَّ يَهوديًا كان يقال له: جُرَيجِرة، كان له على رسول الله ﷺ دنانيرُ، فتَقاضى النبيَّ ﷺ، فقال له: "يا يَهودِيُّ، ما عندي ما أُعطِيك" قال: فإني لا أُفارِقُك يا محمدُ حتى تُعطِيَني، فقال ﷺ: "إذًا أَجلِسَ معكَ" فجلسَ معه، فصلى رسولُ الله ﷺ في ذلك الموضِع الظهرَ والعصرَ والمغربَ والعشاءَ الآخِرةَ والغَداةَ، وكان أصحابُ رسول الله ﷺ يَتَهدَّدونه ويتَوعَّدونه، ففَطِن رسولُ الله ﷺ، فقال: "ما الذي تَصنَعون به؟ " فقالوا يا رسول الله، يَهوديٌّ يَحبِسُك؟!، فقال رسولُ الله ﷺ: "مَنَعَني ربِّي أن أَظْلِمَ معاهَدًا ولا غيره" فلما تَرجَّل النهارُ (1) قال اليهوديُّ: أشهد أن لا إله إلّا الله وأشهدُ أن محمدًا عبدُه ورسولُه، وشَطْرُ مالي في سبيل الله، أما والله ما فعلتُ الذي فعلتُ بك إلّا لأنظُرَ إلى نَعتِكَ في التوراة: محمدُ بن عبد الله مَولدُه بمكة، ومُهاجَرُه بطَيْبة، ومُلكُه بالشام، ليس بفَظٍّ ولا غَليظٍ ولا سَخّابٍ في الأسواق، ولا مُتَزيِّنٍ بالفُحْشِ ولا قولِ الخَنَا، أشهدُ أن لا إله إلّا الله وأنك رسول الله، هذا مالي فاحكُم فيه بما أراكَ اللهُ؛ وكان اليهوديُّ كثيرَ المالِ (2) [ومن كتاب الهجرة الأولى إلى الحبشة] تواترت الأخبارُ أنَّ رسولَ الله ﷺ لما مات عمُّه أبو طالبٍ لقيَ هو والمُسلِمون أذًى من المشركين بعد موتِه، فقال لهمُ النبيُّ ﷺ حين ابتُلُوا وشَطَّتْ بهم عشائرهم: "تَفَرَّقُوا" وأشارَ قِبَل أرضِ الحبشة، وكانت أرضًا دَفِيئَة تَرحَلُ إليها قريش رحلةَ الشتاء، فكانت أولَ هجرةٍ في الإسلام، وإنما أمرَ رسولُ الله ﷺ أصحابَه بالخُروج إلى النجاشيِّ لِعَدْلِه.

It is narrated from Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) that a Jew who was called Jurayjirah was owed some dinars (as a debt) by the Messenger of Allah (peace and blessings be upon him). He demanded payment from the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said to him: "O Jew! I have nothing with me to give you." He said: O Muhammad! I will not leave you until you give me my due. So he (peace and blessings be upon him) said: "If that is so, then I will sit with you." So he (peace and blessings be upon him) sat with him, and the Messenger of Allah (peace and blessings be upon him) prayed the Zuhr, Asr, Maghrib, Isha and morning (Fajr) prayers in that very place. The Companions of the Messenger of Allah (peace and blessings be upon him) were threatening and intimidating him. The Messenger of Allah (peace and blessings be upon him) became aware of this and said: "What are you doing to him?" They said: O Messenger of Allah! Should a Jew hold you back?! The Messenger of Allah (peace and blessings be upon him) said: "My Lord has forbidden me to wrong anyone under covenant (mu'ahad) or anyone else." When the day had risen, the Jew said: 'Ashhadu an la ilaha illallah wa ashhadu anna Muhammadan 'abduhu wa rasuluh' (I bear witness that there is no god but Allah, and I bear witness that Muhammad is His servant and His Messenger), and half of my wealth is in the way of Allah. By Allah! I did all this with you only so that I could see your attributes that are mentioned in the Torah: "Muhammad bin Abdullah, whose birth will be in Makkah, his place of emigration in Taybah (Madinah), and his dominion in Sham. He is neither harsh nor hard-hearted, nor one who shouts in the marketplaces, nor one given to obscenity and foul speech." I bear witness that there is no god but Allah and that you are indeed the Messenger of Allah. This is my wealth; now judge concerning it as Allah shows you. And that Jew was very wealthy. Chapter on the emigration to Abyssinia: It is established through successive reports that when Abu Talib, the uncle of the Messenger of Allah (peace and blessings be upon him), died, he (peace and blessings be upon him) and the Muslims suffered great harm from the polytheists after his death. So when they were put to trial and their clans cut them off, the Prophet (peace and blessings be upon him) said to them: "Disperse," and he (peace and blessings be upon him) pointed towards the land of Abyssinia. It was a warm land to which Quraysh used to travel in winter. This was the first emigration in Islam, and the Messenger of Allah (peace and blessings be upon him) ordered his Companions to go to the Negus only because of his justice.

(2) خبر موضوع، آفته أبو علي محمد بن محمد بن الأشعث، فقد اتهمه ابن عدي والدارقطني بوضع هذه النسخة العَلَوية، وليس آفته موسى بن إسماعيل كما قال الذهبي في "تلخيصه"، ولا يُفهم من قول ابن عدي: فذكرنا روايته هذه الأحاديث عن موسى هذا لأبي عبد الله الحسين بن علي بن الحسن بن علي بن عمر بن علي بن الحسن بن علي بن أبي طالب، وكان شيخًا من أهل البيت بمصر، فقال لنا كان موسى هذا جاري بالمدينة أربعين سنةً ما ذكر قطُّ أن عنده شيئًا من الرواية، لا عن أبيه، ولا عن غيره لا يفهم منه أنَّ موسى هذا هو الذي وضع هذه النسخة كما قال سبط ابن العجمي في "الكشف الحثيث" (791)، قاله ردًّا على الذهبي، وقال: فلا ينبغي أن يكتب مع هؤلاء. يعني: مع من اتُّهم بوضع الحديث.
Grading: (2) This report is fabricated (mawdu').
Technical note / Defect ('illah): Its culprit is "Abu Ali Muhammad bin Muhammad bin al-Ash'ath", since Ibn Adi and al-Daraqutni accused him of fabricating this "Alawi manuscript (nuskhah)". Its culprit is not "Musa bin Isma'il" as al-Dhahabi said in "al-Talkhis". Nor should it be understood from the statement of Ibn Adi that Musa bin Isma'il fabricated this manuscript. Ibn Adi's statement is: "We mentioned these narrations of Musa (contained in this manuscript) to Abu Abd Allah al-Husayn bin Ali bin al-Hasan bin Ali bin Umar bin Ali bin al-Hasan bin Ali bin Abi Talib (who was an elderly shaykh of the Prophet's household in Egypt), and he told us: This Musa was my neighbour in Madinah for forty years, and he never once mentioned that he had any narrations, neither from his father nor from anyone else." Sibt Ibn al-Ajami, in "al-Kashf al-Hathith" (791), said in rebuttal of al-Dhahabi that this statement does not mean Musa fabricated this manuscript, and he said: "He (Musa) should not be listed alongside these people", meaning alongside those accused of fabricating hadith.
وأخرجه البيهقي في "دلائل النبوة" 6/ 280، ومن طريقه ابن عساكر في "تاريخ دمشق" 1/ 184 أبي عبد الله الحاكم بهذا الإسناد.
Reference / Source: Al-Bayhaqi narrated it in "Dala'il al-Nubuwwah" (6/280), and through his route Ibn Asakir in "Tarikh Dimashq" (1/184), via Abu Abd Allah al-Hakim, with this same chain.
وأخرجه أبو سعْد النيسابوري في "شرف المصطفى" كما في "الإصابة" للحافظ 2/ 148 من طريق أبي علي محمد بن محمد بن الأشعث، به.
Reference / Source: Abu Sa'd al-Naysaburi narrated it in "Sharaf al-Mustafa" (as mentioned in "al-Isabah" of al-Hafiz Ibn Hajar, 2/148) through the route of Abu Ali Muhammad bin Muhammad bin al-Ash'ath.
وقد روي نحو هذه القصة لليهودي الحبر زيد بن سَعْنة، كما سيأتي برقم (6692)، وتقدم بعض قصته برقم (2268)، وانظر كلامنا عليها هناك.
Corroborating chains and supporting reports: A similar story has also been narrated about the Jewish scholar Zayd bin Sa'nah, as will come later (no. 6692), and part of his story has already passed (no. 2268); see our discussion there.
وروي عن النبي ﷺ في المنع من ظلم المعاهد حديث صفوان بن سليم، عن عدة من أبناء في أصحاب رسول الله ﷺ، عن آبائهم دِنْيةً عن رسول الله ﷺ قال: "ألا من ظلم معاهدًا، أو انتقصه، أو كلَّفَه فوق طاقته، أو أخذ منه شيئًا بغير طيب نفس، فأنا حَجِيجُه يوم القيامة". أخرجه أبو داود (3052)، وإسناده حسن.
Corroborating chains and supporting reports: From the Prophet (peace and blessings be upon him), concerning the prohibition of wronging a "mu'ahad" (a non-Muslim under covenant), there is narrated the hadith of Safwan bin Sulaym, which he narrates from several sons of the Companions of the Messenger of Allah (peace and blessings be upon him), from their own fathers, that the Messenger of Allah (peace and blessings be upon him) said: "Beware! Whoever wrongs a mu'ahad, or diminishes (his right), or burdens him beyond his capacity, or takes anything from him without his willing consent, then I will be his advocate (pleading against the wrongdoer) on the Day of Resurrection."

Grading: Its chain is hasan.
وروي أيضًا وصفُ النبي ﷺ في التوراة كما جاء هنا في عدة أخبار كما تقدم بيانه برقم (4270)، لكن دون ذكر مولده ومهاجَره ومُلكه.
Details of the narration: Likewise, the description of the Prophet (peace and blessings be upon him) in the Torah, as it comes here, has been narrated in several reports, as explained earlier (no. 4270), but without mention of his birthplace, his place of emigration and his dominion.
