Mustadrak al-Hakim — Hadith 37

حدثنا أبو العباس محمد بن يعقوب، حدثنا محمد بن عبد الله بن عبد الحَكَم أخبرنا ابن وهب، أخبرني سفيان الثَّوْري وأخبرنا أبو العباس محمد بن أحمد المحبوبي بمَرْو، حدثنا أحمد بن سَيّار (1). وحدثنا أبو بكر أحمد بن إسحاق، أخبرنا يوسف بن يعقوب؛ قالا: حدثنا محمد بن كثير، حدثنا سفيان، عن ابن أبي نَجِيح، عن أبيه، عن ابن عباس قال: ما قاتلَ رسولُ الله ﷺ قومًا حتى دعاهم (2).
هذا حديث صحيح من حديث الثوري، ولم يُخرجاه، وقد احتجَّ مسلم بأبي نَجِيح والد عبد الله واسمه يسار، وهو من الموالي المكيين، وقد رُوِيَ عن علي بن أبي طالب عن رسول الله ﷺ بهذا اللفظ (3)، واتَّفقا جميعًا على إخراج حديث عبد الله بن عَوْن: كتبتُ إلى نافع مولى ابن عمر أسألُه عن القتال قبلَ الدعاء، فكَتَبَ إليَّ: أنَّ رسول الله ﷺ أغارَ على بني المُصطَلِق … الحديث، وفيه: وكان الدعوةُ قبل القتال (4).

It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) never fought any people until he (peace and blessings be upon him) had (first) invited them (to Islam).
This is a sahih hadith through the narration of Imam al-Thawri, but both of them did not report it, although Imam Muslim used Abu Najih (who is the father of Abdullah, and whose name is Yasar) as evidence; he is one of the Makkan freedmen (mawali). This same hadith is also narrated with these very words from Sayyiduna Ali bin Abi Talib (may Allah be pleased with him). Both of them (Imam Bukhari and Muslim) agreed on recording the hadith of Abdullah bin Awn in which (he says): I wrote to Nafi', the freedman of Ibn Umar, asking him about (giving) the invitation to Islam before fighting, and he wrote to me that the Messenger of Allah (peace and blessings be upon him) raided Banu al-Mustaliq (the rest of the hadith), and in it is the mention that the invitation was given before fighting.

(1) تحرَّف في (ب) إلى: سنان.
Technical note / Defect ('illah): (1) In manuscript (B) it was distorted into "Sinan".

(2) إسناده صحيح.
Grading: (2) Its chain is "sahih".
وأخرجه أحمد 4/ (2105) عن بشر بن السَّرِيّ، عن سفيان الثوري، بهذا الإسناد.
Reference / Source: Ahmad (4/ 2105) narrated it from Bishr bin al-Sari, from Sufyan al-Thawri, with this same chain.

(3) لم نقف عليه عن علي بهذا اللفظ، لكن أخرج الطحاوي في "شرح معاني الآثار" 3/ 207، والطبراني في "الأوسط" (8265) من حديث إسحاق بن عبد الله بن أبي طلحة عن عمه أنس بن مالك: أن رسول الله ﷺ بعث عليًّا إلى قوم يقاتلهم … قال: وأمر رسول الله ﷺ عليًّا أن لا يقاتلهم حتى يدعوهم. وهو عند عبد الرزاق (9424) من حديث يحيى بن إسحاق بن أبي طلحة مرسلًا.
Technical note / Defect ('illah): (3) We did not find it from 'Ali (may Allah be pleased with him) with this wording. However, al-Tahawi in "Sharh Ma'ani al-Athar" 3/ 207 and al-Tabarani in "al-Awsat" (8265) recorded, from the hadith of Ishaq bin Abd Allah bin Abi Talhah from his paternal uncle Anas bin Malik, that the Messenger of Allah (peace and blessings be upon him) sent 'Ali to a people to fight them; he said: And the Messenger of Allah (peace and blessings be upon him) commanded 'Ali not to fight them until he had invited them (to Islam). It is with Abd al-Razzaq (9424) from the hadith of Yahya bin Ishaq bin Abi Talhah as "mursal".

(4) هو في البخاري (2541) ومسلم (1730) بنحوه، وانظر "مسند أحمد" 8/ (4857).
