Mustadrak al-Hakim — Hadith 3675

حدثني إبراهيم بن عِصْمة بن إبراهيم العَدْل، حدثنا السَّرِي بن خُزَيمة، حدثنا موسى بن إسماعيل، حدثنا وُهَيب، حدثني ابن جُرَيج في قول الله ﷿: ﴿لَا يَحِلُّ لَكَ النِّسَاءُ مِنْ بَعْدُ وَلَا أَنْ تَبَدَّلَ بِهِنَّ﴾ [الأحزاب: 52]، قال ابن جُرَيج: فحدثني عطاءٌ، عن عُبيد بن عُمير، عن عائشة قالت: ما تُوفِّي النبيُّ ﷺ حتى أحلَّ الله له أن يَتزوَّج (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه. ﷽ [40 - ومن تفسير سورة (حم) المؤمن]

It is narrated from Sayyidah Aishah (may Allah be pleased with her) that she said: The Prophet (peace and blessings be upon him) did not pass away until Allah Almighty had made it lawful for him to marry (further).
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) خبر ضعيف - وإن كان رجاله ثقات - من أجل ما وقع فيه من اختلافات على عطاء بن أبي رباح في وصله وإرساله وتشكُّكه عمَّن رواه. وهيب: هو ابن خالد بن عجلان.
Grading: This report is "da'if" (weak) (even though its narrators are thiqah), because of the disagreement over Ata' bin Abi Rabah as to whether it is connected or mursal, and his doubt about whom he narrated it from. Wuhayb is Ibn Khalid bin Ajlan.
وأخرجه أحمد (42/ 25467)، والنسائي (5295) و (11351) من طريقين عن وهيب بن خالد، بهذا الإسناد.
Reference / Source: It was recorded by Ahmad and al-Nasa'i through two routes via Wuhayb bin Khalid, with this chain.
وأخرجه أحمد (42/ 25652) عن عبد الرزاق، وابن حبان (6366) من طريق عبد الله بن رجاء المكي، كلاهما عن ابن جريج، به. لكن وقع في رواية عبد الرزاق تفصيل، فقد روى عن ابن جريج قال: وزعم عطاء أنَّ عائشة قالت … فذكره، قلت (أي: ابن جريج): عمَّن تأثُرُ هذا؟ قال: لا أدري، حسبتُ أني سمعت عبيد بن عمير يقول ذلك. زاد عبد الرزاق في "مصنفه" (14001) عن ابن جريج قال: وقال لي عمرو (يعني ابن دينار): سمعتُ عطاءً منذ حينٍ يقول: ما مات رسول الله ﷺ حتى أُحلَّ له أن ينكح ما شاء. فأرسله.
Reference / Source: It was recorded by Ahmad (42/ 25652) and Ibn Hibban (6366) from Ibn Jurayj.
Technical note / Defect ('illah): But the narration of Abd al-Razzaq has more detail: Ibn Jurayj asked Ata': From whom are you reporting this? He said: I do not know; I think I heard Ubayd bin Umayr say it. Abd al-Razzaq added in (al-Musannaf 14001) that Amr bin Dinar said: Some time ago I heard Ata' saying (the rest of the report), and he narrated it as mursal.
وأخرجه أحمد (40/ 24137)، والترمذي (3216)، والنسائي (5294) من طريق سفيان بن عيينة، عن عمرو بن دينار، عن عطاء قال: قالت عائشة … فذكره، فأسقط الواسطة بين عطاء وعائشة، وذكر ابن هانئ عن أحمد بن حنبل أنه قال: رواية عطاء عن عائشة لا يُحتجُّ بها إلّا أن يقول: سمعتُ. وقال الترمذي: حديث حسن صحيح.
Reference / Source: It was recorded by Ahmad, al-Tirmidhi and al-Nasa'i from Sufyan bin Uyaynah, from Amr bin Dinar, from Ata', who said: A'ishah said (the rest of the report); he dropped the intermediary between Ata' and A'ishah.
Technical note / Defect ('illah): Imam Ahmad said: Ata''s narration from A'ishah is not proof unless he says "sami'tu" (I heard).
وروى الحديث أبو عاصم النبيل عن ابن جريج عند الطبراني في "التفسير" 22/ 32، والطحاوي في "مشكل الآثار" (523)، فذكر عن ابن جريج قال: وقال أبو الزبير: سمعتُ رجلًا يخبر به عطاءً. فأبهمه ولم يسمِّه.
Reference / Source: Abu Asim al-Nabil narrated it from Ibn Jurayj (al-Tabarani, al-Tahawi), in which Ibn Jurayj said: Abu al-Zubayr said: I heard a man informing Ata' of it. (He left him unnamed.)
ورُوي على العموم كحديث عائشة عن أم سلمة أيضًا عند ابن سعد في "الطبقات" 10/ 185، وابن أبي حاتم في "تفسيره" كما في "تفسير ابن كثير" 6/ 438، وعند الطحاوي في "المشكل" (524)، وفي إسناده عند ابن سعد شيخه محمد بن عمر الواقدي، وهو متروك الحديث عند كثير من جمهور أهل الحديث، وفي إسناد ابن أبي حاتم والطحاوي عمر بن أبي بكر الموصلي، وهو متروك الحديث أيضًا.
Reference / Source: Like the hadith of A'ishah, it is also narrated from Umm Salamah (Ibn Sa'd, Ibn Abi Hatim, al-Tahawi).
Technical note / Defect ('illah): The chain of Ibn Sa'd contains "al-Waqidi", who is matruk (abandoned), and the chain of Ibn Abi Hatim and al-Tahawi contains "Umar bin Abi Bakr al-Mawsili", who is also matruk.
