Mustadrak al-Hakim — Hadith 3632

حدثنا علي بن حَمْشاذَ، حدثنا إسماعيل بن إسحاق القاضي، حدثنا أبو الوليد، حدثنا عبيد الله بن إياد بن لَقِيط، حدثني إياد بن لَقِيط، عن أبي رِمْثةَ قال: انطلقتُ مع أَبي نحوَ رسول الله ﷺ فَسَلَّمَ عليه أَبي، وجلسنا ساعةً فتحدَّثنا، فقال رسول الله ﷺ لأَبي: "ابنُكَ هذا؟ " قال: إي وربِّ الكعبة، قال: "حقًّا؟ " قال: أَشْهَدُ به، قال: فتبسَّمَ رسولُ الله ﷺ ضاحكًا من ثَبَتِ شَبَهي بأبي ومن حَلِفِ أَبي على ذلك، قال: ثم قال: "أمَا إنَّ ابنَك هذا لا يَجْني عليك ولا تَجْني عليه"، قال: وقرأ رسولُ الله ﷺ: ﴿وَلَا (1) تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى﴾ إلى قوله: ﴿هَذَا نَذِيرٌ مِنَ النُّذُرِ الْأُولَى﴾ (2). صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Rimthah (may Allah be pleased with him) that he said: I came with my father to the Prophet (peace and blessings be upon him). My father greeted him (peace and blessings be upon him) with peace, and we sat for a while talking. Then the Messenger of Allah (peace and blessings be upon him) asked my father: "Is this your son?" He said: Yes, by the Lord of the Ka'bah! He (peace and blessings be upon him) asked again: "Really?" He said: I bear witness to it. The narrator says: The Messenger of Allah (peace and blessings be upon him) smiled because of the strength of the resemblance between me and my father and because of my father's firm oath upon it. Then he (peace and blessings be upon him) said: "Know that this son of yours will not be held responsible for any crime of yours, nor will you be held responsible for any crime of his." Then the Messenger of Allah (peace and blessings be upon him) recited these verses: "And no bearer of burdens shall bear the burden of another" [Surah al-An'am: 164], up to this saying of his: "This (Messenger) is a warner among the warners of old." [Surah al-Najm: 56]
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) هكذا في أصولنا الخطية، وهذه الآية في الأنعام والإسراء وفاطر والزمر، وهكذا هي في المصادر التي خرَّجت الحديث، وليس في شيء منها ذكر بقيّته وهي: "إلى قوله: ﴿هَذَا نَذِيرٌ مِنَ النُّذُرِ الْأُولَى﴾ " فإنَّ هذه الآيات في سورة النجم (38 - 56)، والآية فيها بلفظ: ﴿أَلَّا تَزِرُ … ﴾، وهكذا رواه البيهقي في "السنن" 8/ 345 عن الحاكم.
Note / Clarification: This is how it is in our manuscripts (this verse occurs in al-An'am, al-Isra', Fatir and al-Zumar), and it is the same in the sources that recorded the hadith. None of them mentions the rest, "up to His words: 'This is a warner like the warners of old'", because these verses are in Surat al-Najm (38-56), where the verse has the wording "alla taziru". Al-Bayhaqi narrated it the same way in "al-Sunan" (8/ 345) from al-Hakim.

(2) إسناده صحيح. أبو الوليد: هو هشام بن عبد الملك الطَّيالسي.
Grading: Its chain is sahih. Abu al-Walid is Hisham bin Abd al-Malik al-Tayalisi.
وأخرجه أحمد (11/ 7109) عن هشام بن عبد الملك الطيالسي، بهذا الإسناد - بأطول ممّا هنا. وقرن بهشامٍ عفانَ بنَ مسلم.
Reference / Source: Ahmad (11/ 7109) recorded it from Hisham bin Abd al-Malik al-Tayalisi, with this same chain, at greater length than here, and paired "Affan bin Muslim" with Hisham.
وأخرجه ابن حبان (5995) عن الفضل بن الحباب الجُمحي، عن أبي الوليد الطيالسي، به.
Reference / Source: Ibn Hibban (5995) recorded it from al-Fadl bin al-Hubab al-Jumahi, from Abu al-Walid al-Tayalisi, with this same chain.
وأخرجه أبو داود (4495) عن أحمد بن يونس، عن عبيد الله بن إياد، به.
Reference / Source: Abu Dawud (4495) recorded it from Ahmad bin Yunus, from Ubayd Allah bin Iyad, with this same chain.
وأخرجه أحمد (7106) و (7107)، وأبو داود (4208)، والنسائي (7007) من طريقين عن إياد بن لقيط، به مختصرًا.
Reference / Source: Ahmad (7106, 7107), Abu Dawud (4208) and al-Nasa'i (7007) recorded it in abridged form via two routes from Iyad bin Laqit.
وأخرجه أحمد (7108) من طريق عاصم بن أبي النجود، عن أبي رمثة. مختصرًا أيضًا.

وفي باب لا يجني أحدٌ على أحدٍ غيرُ ما حديثٍ، انظرها عند حديث عمرو بن الأحوص من "مسند أحمد" (25/ 16064).
Corroborating chains and supporting reports: On the topic "no one bears the offence of another" there are several hadiths; see them under the hadith of Amr bin al-Ahwas in "Musnad Ahmad" (25/ 16064).
قوله: "أَشهَدُ به" على صيغة المتكلِّم، أي: أقرُّ وأعترف بذلك، أو على صيغة الأمر: اشهَدْ به، أي: كن شاهدًا على اعترافي بأنه ابني.
Note / Clarification: The words "ashhadu bihi" in the first-person form mean: I affirm and acknowledge that. Or it is in the imperative form, "ishhad bihi", meaning: be a witness to my acknowledgement that he is my son.
وقوله: "لا يجني عليك ولا تجني عليه" أي: لا يُؤاخَذ بذنبك ولا تُؤاخَذ بذنبه، وكان من عادة الجاهلية ضمانُ الجنايات بينهما، فردَّه النبي ﷺ بقوله هذا. والجناية: الذَّنْب، أو ما يفعله الإنسان مما يوجب عليه العقابَ أو القِصاص.
Note / Clarification: "He will not bear your offence and you will not bear his" means: he will not be held liable for your sin and you will not be held liable for his. In the Jahiliyyah it was customary for each to be liable for the other's offences, and the Prophet (peace and blessings be upon him) rejected that with these words. "Jinayah" means a sin, or any act a person commits that makes him liable to punishment or retaliation (qisas).
