Mustadrak al-Hakim — Hadith 3613

فحدَّثَناه أبو بكر محمد بن عبد الله الشافعي، حدثنا أبو إسماعيل محمد ابن إسماعيل، حدثنا سعيد بن أبي مريم، حدثنا عبد المجيد بن عبد العزيز، حدثنا ابن جُرَيج، عن عمرو بن دينار، عن طاووس، عن معاذ بن جَبَل قال: قال رسول الله ﷺ: "لا طلاقَ إلَّا بعد نكاحٍ، ولا عِتقَ إلَّا بعد مِلْكٍ" (1). وأما حديث جابر:
It is narrated from Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Divorce takes place only after marriage, and freeing (a slave) takes place only after ownership."

(1) إسناده ضعيف، ابن جريج مدلّس وقد عنعن في روايته هنا عن عمرو، وعمرو هذا قد وهمَ في تسميته أحدُ الرواة ممن دون ابن جريج، والصواب أنه عمرو بن شعيب، هكذا سمّاه عليُّ بن شعيب السِّمسار - وهو ثقة - عن عبد المجيد بن عبد العزيز عند المحاملي في "أماليه" رواية ابن مهدي الفارسي (158)، والدارقطني في "سننه" (3930).
Grading: Its chain is da'if.
Technical note / Defect ('illah): Ibn Jurayj is a mudallis and here narrates from Amr with 'an'anah. Also, one of the narrators below Ibn Jurayj erred in naming this "Amr"; the correct view is that he is "Amr bin Shu'ayb". That is how Ali bin Shu'ayb al-Simsar (who is thiqah) named him, from Abd al-Majid bin Abd al-Aziz, in al-Mahamili's "Amali" in the narration of Ibn Mahdi al-Farisi (158) and in al-Daraqutni's "Sunan" (3930).
وكذلك سمّاه عن ابن جريج عبدُ الرزاق في "مصنفه" (11455) وعند الطبراني في "الكبير" (20/ 349)، وتابع ابنَ جريج على ذلك عبدُ الرحمن بن الحارث بن عياش عن عمرو بن شعيب عند عبد بن حميد في "مسنده" (121)، وهو المحفوظ، وما وقع عند المصنف وعنه البيهقي في "السنن" 7/ 320 من الأوهام.
Reference / Source: Likewise Abd al-Razzaq named him (Amr bin Shu'ayb) from Ibn Jurayj in his "Musannaf" (11455) and in al-Tabarani's "al-Kabir" (20/ 349). Abd al-Rahman bin al-Harith bin Ayyash corroborated Ibn Jurayj in this from Amr bin Shu'ayb in Abd bin Humayd's "Musnad" (121).
Important point: That is the preserved (mahfuz) version, and what occurs in the author's work, and via him in al-Bayhaqi's "Sunan" (7/ 320), is among the errors.
ثم إنَّ هذا الإسناد منقطع بين طاووس ومعاذ بن جبل، فإنه لم يسمع منه.
Grading: Furthermore, this chain is munqati' (broken) between Tawus and Mu'adh bin Jabal, for Tawus did not hear from him.
والمحفوظ في هذا الحديث عن عمرو بن شعيب ما رواه جماعة من الثقات عنه عن أبيه عن جدِّه عبد الله بن عمرو بن العاص، كما سلف عند المصنف برقم (2856).
Important point: The preserved version of this hadith from Amr bin Shu'ayb is what a group of thiqah narrators narrated from him, from his father, from his grandfather Abd Allah bin Amr bin al-As, as has passed in the author's work at number (2856).
وأما طاووس فقد اختُلف عليه فيه أيضًا، فقد أخرجه عبد الرزاق (11457)، وابن أبي شيبة 5/ 16 و 14/ 224 من طريق سفيان الثوري، عن محمد بن المنكدر، عمَّن سمع طاووسًا يحدِّث عن النبي ﷺ، فذكره. وهذا على إرساله فيه راوٍ مبهم، فالإسناد ضعيف.
Technical note / Defect ('illah): As for Tawus, there was also disagreement over it from him: Abd al-Razzaq (11457) and Ibn Abi Shaybah (5/ 16 and 14/ 224) recorded it via Sufyan al-Thawri, from Muhammad bin al-Munkadir, from "someone who heard Tawus narrating from the Prophet (peace and blessings be upon him)", and he mentioned it. Besides being mursal, this has an unnamed narrator, so the chain is da'if.
ورواه بنحوه إسماعيل بن مسلم المكي - وهو أحد الضعفاء - عند البيهقي 8/ 65 عن محمد بن المنكدر، عن طاووس، عن النبي ﷺ.
Reference / Source: Isma'il bin Muslim al-Makki (one of the weak narrators) narrated something similar in al-Bayhaqi (8/ 65) from Muhammad bin al-Munkadir, from Tawus, from the Prophet (peace and blessings be upon him).
ووصله عن محمد بن المنكدر عبدُ الله بنُ لهيعة عند الطبراني في "الكبير" (11004)، وعبدُ الله بنُ زياد بن سمعان عند ابن عدي في "الكامل" 4/ 126 ومن طريقه الخطيب في "تاريخ بغداد" 11/ 123، فروياه عنه عن طاووس عن ابن عبَّاس مرفوعًا - زاد ابنُ سمعان فجعله من رواية ابن عباس عن علي مرفوعًا. وابن لهيعة سيئ الحفظ، وابن سمعان متهم بالكذب.
Technical note / Defect ('illah): Abd Allah bin Lahi'ah (in al-Tabarani's "al-Kabir" 11004) and Abd Allah bin Ziyad bin Sam'an (in Ibn Adi's "al-Kamil" 4/ 126, and via him al-Khatib in "Tarikh Baghdad" 11/ 123) narrated it from Muhammad bin al-Munkadir with a connected chain, from Tawus, from Ibn Abbas, as marfu'. Ibn Sam'an added more and made it a narration of Ibn Abbas from Ali, as marfu'.
Grading: Ibn Lahi'ah has poor memory, and Ibn Sam'an is accused of lying.
ورواه أيضًا عن طاووس عن ابن عبَّاس مرفوعًا: الحسن بن عمارة عن حميد الأعرج عنه عند ابن عدي 2/ 290، وسليمان بن أبي سليمان الزهري عن يحيى بن أبي كثير عنه عند الدارقطني (3938). والإسنادان ضعيفان، الأول فيه الحسن بن عمارة متروك الحديث عند جمهور المحدثين، والثاني فيه سليمان بن أبي سليمان الزهري وهو ضعيف الحديث في بعض ما يرويه مناكير. وأما المحفوظ عن طاووس فهو ما رواه عن ابن عبَّاس موقوفًا عليه من قوله، كما سلف عند المصنف برقم (3609)، والإسناد إليه صحيح.
Technical note / Defect ('illah): It was also narrated from Tawus, from Ibn Abbas, as marfu' by al-Hasan bin Umarah, from Humayd al-A'raj, from him (in Ibn Adi 2/ 290), and by Sulayman bin Abi Sulayman al-Zuhri, from Yahya bin Abi Kathir, from him (in al-Daraqutni 3938). Both chains are da'if: the first has al-Hasan bin Umarah, who is matruk al-hadith according to the majority of hadith scholars, and the second has Sulayman bin Abi Sulayman al-Zuhri, who is weak in hadith, with munkar reports in some of what he narrates.
Important point: What is preserved from Tawus is what he narrated from Ibn Abbas as mawquf, his own saying, as has passed in the author's work at number (3609), and the chain to him is sahih.
