Mustadrak al-Hakim — Hadith 3610

فحدَّثنا أبو علي وأبو الحسين بن المظفَّر الحافظان وأبو حامد بن شارَكَ (3) الفقيه وأبو أحمد الشُّعَيبي وأبو إسحاق البُزَاري (1) في آخرين، قالوا: حدثنا يحيى بن محمد بن صاعد، حدثنا محمد بن يحيى القُطَعي، حدثنا عاصم بن هلال، حدثنا أيوب، عن نافع، عن ابن عمر قال: قال رسول الله ﷺ: "لا طلاق إلَّا بعدَ نِكاحٍ" (2). وأما حديث عائشة:
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Divorce (takes effect) only after marriage."

(3) في (ص) و (ب): شريك، وهو تحريف، وفي (ز): شرك، والمثبت من مصادر ترجمته كـ "سير أعلام النبلاء" 16/ 273، وهو أبو حامد أحمد بن محمد الهروي الحافظ مفتي هَراة وشيخها. وقد يكون ما في (ز) صحيحًا على تحريك الشين والراء بقَصْر الألف، والله أعلم.
Note / Clarification: Manuscripts (S) and (B) have "Sharik", which is a corruption, and manuscript (Z) has "Shrk". What is adopted comes from the sources of his biography, such as "Siyar A'lam al-Nubala'" (16/ 273); he is Abu Hamid Ahmad bin Muhammad al-Harawi, the hafiz, the mufti and shaykh of Herat. What is in (Z) may be correct if the shin and the ra' are voiced and the alif is shortened. And Allah knows best.

(1) البُزَاري: نسبة إلى قرية بنيسابور يقال لها: أبزار وبُزَار كما في "الأنساب" للسمعاني. وانظر ترجمته في "سير النبلاء" 16/ 152.
Note / Clarification: "Al-Buzari": an attribution to a village of Naysabur called "Abzar" or "Buzar", as in al-Sam'ani's "al-Ansab". See his biography in "Siyar al-Nubala'" (16/ 152).

(2) حديث معلول، لا أصل له من حديث ابن عمر بهذا الإسناد كما سيأتي بيانه.
Technical note / Defect ('illah): This hadith is defective (ma'lul); it has no basis as a hadith of Ibn Umar with this chain, as will be explained.
وأخرجه ابن عدي في "الكامل" 5/ 232، وأبو طاهر المخلِّص في "المخلصيات" (2918) عن يحيى بن محمد بن صاعد، بهذا الإسناد والمتن.
Reference / Source: Ibn Adi recorded it in "al-Kamil" (5/ 232) and Abu Tahir al-Mukhallis in "al-Mukhallisiyyat" (2918) from Yahya bin Muhammad bin Sa'id, with this same chain and text.
وأخرجه ابن عدي أيضًا 4/ 73، والطبراني في "الأوسط" (3676) و"الصغير" (501) عن صالح بن أحمد بن أبي مقاتل، عن محمد بن يحيى القطعي، به. وصالح بن أبي مقاتل متروك واتهمه الدارقطني بالكذب، وقال ابن عدي: لا يعرف إلّا بابن صاعد، سرقه صالح من ابن صاعد حتى لا يفوته الحديث.
Reference / Source: Ibn Adi also (4/ 73) and al-Tabarani (in "al-Awsat" 3676 and "al-Saghir" 501) recorded it from Salih bin Ahmad bin Abi Muqatil, from Muhammad bin Yahya al-Qut'i, with this same chain.
Technical note / Defect ('illah): Salih bin Abi Muqatil is matruk, and al-Daraqutni accused him of lying. Ibn Adi said: It is known only through Ibn Sa'id; Salih stole it from Ibn Sa'id so that he would not miss out on the hadith.
قلنا: وهذا الحديث بهذا الإسناد قد وهمَ فيه ابن صاعد، فقد ذكر ابن عدي في "الكامل" 5/ 232 أنه ذكره من رواية ابن صاعد لأبي عروبة الحرّاني، فأخرج إليه أبو عروبة "فوائد القُطعي" فإذا فيها حديث عمرو بن شعيب عن أبيه عن جده - وقد رواه ابن صاعد عن القطعي عن محمد بن راشد عن حسين المعلم عن عمرو - أنَّ رسول الله ﷺ قال: "لا طلاق إلّا بعد نكاح"، وبعقبه: حدثنا عاصم بن هلال عن أيوب عن نافع عن ابن عمر عن النبي ﷺ: ﴿يَوْمَ يَقُومُ النَّاسُ لِرَبِّ الْعَالَمِينَ﴾ [المطففين: 6] … إلخ" (وهو في "أحاديث أبي عروبة" برواية أبي أحمد الكرابيسي الحاكم برقم 27)، قال ابن عدي: فعلى ما تبيَّن لنا في كتاب أبي عروبة أنه دخل لابن صاعد حديث في حديث، و ﴿يَوْمَ يَقُومُ النَّاسُ لِرَبِّ الْعَالَمِينَ﴾ مشهور عن أيوب، على أنَّ عاصم بن هلال يحتمل ما هو أنكر من هذا. انتهى، يعني أنَّ حفظه ليس بذاك المتين.
Technical note / Defect ('illah): We say: Ibn Sa'id erred in this hadith with this chain. Ibn Adi mentioned in "al-Kamil" (5/ 232) that he raised it with Abu Arubah al-Harrani as a narration of Ibn Sa'id, and Abu Arubah brought out to him "Fawa'id al-Qut'i". In it was the hadith of Amr bin Shu'ayb from his father from his grandfather (which Ibn Sa'id had narrated from al-Qut'i, from Muhammad bin Rashid, from Husayn al-Mu'allim, from Amr) that the Messenger of Allah (peace and blessings be upon him) said: "There is no divorce except after marriage", and directly after it: Asim bin Hilal narrated to us from Ayyub, from Nafi', from Ibn Umar, from the Prophet (peace and blessings be upon him): "The Day mankind will stand before the Lord of the worlds" [al-Mutaffifin: 6], etc. (It is in "Ahadith Abi Arubah" in the narration of Abu Ahmad al-Karabisi al-Hakim, number 27.) Ibn Adi said: From what became clear to us in Abu Arubah's book, one hadith got mixed into another for Ibn Sa'id (idkhal hadith fi hadith). The hadith "The Day mankind will stand before the Lord of the worlds" is well known from Ayyub; moreover, Asim bin Hilal could bear something even more munkar than this. End of quote; meaning that his memory is not that firm.
وذكر أبو يعلى الخليلي في "الإرشاد" 1/ 459 عن المصنف أبي عبد الله الحاكم أنه سمع الحافظ أبا أحمد الكرابيسي يقول: قال لي أبو عروبة: يا أبا أحمد، لو كان هذا الحديث عند أيوب عن نافع، لا يحتجُّ به الناس منذ مئتي سنة عن عمرو بن شعيب عن أبيه عن جده. ونحوه في "تاريخ دمشق" لابن عساكر 64/ 362. وحديث عمرو بن شعيب سلف عند المصنف برقم (2856).
Technical note / Defect ('illah): Abu Ya'la al-Khalili mentioned in "al-Irshad" (1/ 459) from the author, Abu Abd Allah al-Hakim, that he heard the hafiz Abu Ahmad al-Karabisi say: Abu Arubah said to me: "O Abu Ahmad, if this hadith were with Ayyub from Nafi', people would not have been using as proof, for two hundred years, the chain of Amr bin Shu'ayb from his father from his grandfather." Something similar is in Ibn Asakir's "Tarikh Dimashq" (64/ 362). The hadith of Amr bin Shu'ayb has passed in the author's work at number (2856).
أما الدارقطني فقد نسب الوهمَ فيه إلى القُطعي نفسه كما في "سؤالات حمزة السهمي" (107)، فقال: ثم رجع عنه القطعي.
Technical note / Defect ('illah): Al-Daraqutni, however, attributed the error to al-Qut'i himself, as in "Su'alat Hamzah al-Sahmi" (107), and said: Then al-Qut'i retracted it.
