Mustadrak al-Hakim — Hadith 3609

حدثنا أبو عبد الله محمد بن يعقوب الحافظ، حدثنا حامد بن أبي حامد المقرئ، حدثنا إسحاق بن سليمان الرازي قال: سمعتُ فِطْر بن خَليفة يحدِّث عن الحسن بن مسلم بن يَنَّاق، عن طاووس، عن ابن عبَّاس: أنه تلا قولَ الله ﷿: ﴿يَاأَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ﴾ [الأحزاب: 49]، قال: فلا يكون طلاقٌ حتى يكونَ نكاحٌ (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه. قال الحاكم: أنا متعجِّبٌ من الشيخين الإمامين كيف أهمَلا هذا الحديثَ ولم يُخرجاه في "الصحيحين"، فقد صحَّ على شرطهما حديثُ ابن عمر وعائشة وعبد الله بن عبَّاس ومعاذ بن جَبَل وجابر بن عبد الله (2). فأمَّا حديثُ عبد الله بن عمر:

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that he recited this saying of Allah, the Mighty and Majestic: "O you who believe, when you marry believing women and then divorce them before you have touched them" [Surah al-Ahzab: 49], and said: "Divorce only takes place when marriage has already taken place before it."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it. Imam al-Hakim says: I am astonished at these two Imams (Bukhari and Muslim), how they overlooked this hadith and did not record it in their two Sahihs, whereas on the condition of both of them this hadith is authentically established from Ibn Umar, Aishah, Ibn Abbas, Mu'adh bin Jabal and Jabir bin Abdullah (may Allah be pleased with them).

Technical note / Defect ('illah): Rather, these are defective (mu'allal) hadiths, as will be explained, so there is no cause for surprise at what the two Shaykhs (al-Bukhari and Muslim) did (in leaving them out).
