أخبرَناه أبو جعفر محمد بن محمد بن عبد الله البغدادي، حدثنا يحيى بن عثمان بن صالح السَّهْمي، حدثني أبي، حدثنا يحيى بن أيوب، عن بكر بن عَمْرو، عن عَمرو بن أبي نُعَيمة رَضِيع عبد الملك بن مروان - وكان امْرأَ صِدقٍ - عن مسلم بن يَسَار قال: سمعت أبا هريرة يقول: قال رسول الله ﷺ: "مَن قال عليَّ ما لم أَقُلْ، فليتبوَّأْ ببِناءٍ في جهنَّم، ومن أُفتيَ بغير علمٍ، كان إثمُه على مَن أفتاه، ومَن أشار على أخيه بأمرٍ يَعلَمُ أَنَّ الرُّشدَ في غيره، فقد خانه" (1). هذا حديث قد احتجَّ الشيخان برواته غير عمرٍو هذا (2)، وقد وثَّقه بكر بن عمرو المَعافِري، وهو أحد أئمَّة أهل مصر، والحاجةُ بنا إلى لفظة التثبّت في الفتيا شديدة.
It is narrated from Muslim bin Yasar: I heard Sayyiduna Abu Hurayrah (may Allah be pleased with him) say that the Messenger of Allah (peace and blessings be upon him) said: "Whoever attributes to me what I did not say, let him prepare his dwelling in Hell. Whoever is given a fatwa without knowledge, its sin is upon the one who gave him the fatwa. And whoever advises his brother on a matter while knowing that the right course lies in something else has betrayed him."
The two Shaykhs used all of its narrators as evidence except Amr (bin Abi Nu'aymah), and Bakr bin Amr al-Ma'afiri, one of the imams of Egypt, declared him trustworthy. We are in great need of the wording about verification and care in giving fatwas.
(1) إسناده محتمل للتحسين كسابقه. Grading: Its chain too, like the previous chain, can possibly be "hasan". وأخرجه أبو داود (3657) من طريق عبد الله بن وهب، عن يحيى بن أيوب بهذا الإسناد. Reference / Source: Imam Abu Dawud narrated it in (3657) via Abd Allah bin Wahb from Yahya bin Ayyub with this same chain.
(2) وأبو عثمان مسلم بن يسار لم يخرج له البخاري في "صحيحه" شيئًا. Technical note / Defect ('illah): Abu Uthman Muslim bin Yasar is a narrator from whom Imam al-Bukhari narrated nothing in his "Sahih".
