حدثنا أبو العباس محمد بن يعقوب، أخبرنا محمد بن عبد الله بن عبد الحَكَم، أخبرنا ابن وهب، أخبرني سعيد بن أبي أيوب، عن بكر بن عَمْرو، عن عَمرو بن أبي نُعَيمة، عن أبي عثمان مسلم بن يَسَار، عن أبي هريرة، أنَّ رسول الله ﷺ قال: "مَن قال عليَّ ما لم أقُلْ، فليَتبَوَّأْ مَقعَدَه من النار، ومَن استشاره أخوه فأشارَ عليه بغير رَشْدةٍ، فقد خانه، ومَن أُفتيَ بفُتْيا غيرِ ثَبَتٍ، فإنما إثمُه على مَن أفتاه" (1). تابعه يحيى بن أيوب عن بكر بن عمرو: [التعليق - من تلخيص الذهبي] ترقيم العلميه 349 - وتابعه يحيى بن أيوب عن بكر بن عمرو بنحوه احتجا برواته سوى عمرو وقد وثق
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever attributes to me what I did not say, let him take his seat in the Fire. Whoever is asked for advice by his brother and advises him wrongly has betrayed him. And whoever is given a fatwa without verification (by an unreliable means), its sin is upon the one who gave him the fatwa."

(1) إسناده محتمل للتحسين، عمرو بن أبي نعيمة - ويقال: نِعمة - روى عنه اثنان، وذكره ابن حبان في "الثقات"، وقال فيه بكر بن عمرو الراوي عنه - كما في الحديث التالي -: كان امرأَ صدقٍ، وتشدَّد فيه الدارقطني وابن القطان الفاسي فجهّلاه. Grading: This chain can possibly be declared hasan (tahsin). Technical note / Defect ('illah): Two narrators narrated from Amr bin Abi Nu'aymah (or Ni'mah), and Ibn Hibban mentioned him in "al-Thiqat"; also his student Bakr bin Amr called him "a truthful man"; although Imam al-Daraqutni and Ibn al-Qattan al-Fasi were strict and called him majhul (unknown). وأخرجه أحمد 14/ (8266) عن عبد الله بن يزيد المقرئ، عن سعيد بن أبي أيوب، به. Reference / Source: Imam Ahmad narrated it in (14/ 8266) with the chain Abd Allah bin Yazid al-Muqri' from Sa'id bin Abi Ayyub. وأخرجه أحمد (8776) من طريق رِشدين بن سعد، عن بكر بن عمرو، به - مرسلًا لم يذكر فيه أبا هريرة، ورشدين بن سعد ضعيف. Reference / Source: Imam Ahmad narrated it in (8776) via Rishdin bin Sa'd, but he narrated it as "mursal" (without mention of the Companion Abu Hurayrah); moreover, Rishdin bin Sa'd is himself a weak narrator. وأخرجه مختصرًا بقصة الفُتيا ابن ماجه (53) عن ابن أبي شيبة، عن عبد الله بن يزيد المقرئ، عن سعيد بن أبي أيوب، عن أبي هانئ حميد بن هانئ، عن أبي عثمان مسلم بن يسار، عن أبي هريرة. وهذا إسناد - إن كان محفوظًا - حسن، لكن رواه غير ابن أبي شيبة عن المقرئ فجعله من رواية سعيد بن أبي أيوب عن بكر بن عمرو، وهو المحفوظ، والله تعالى أعلم. Grading: This chain of Ibn Majah (53), if it is established as "mahfuz", is "hasan"; but narrators other than Ibn Abi Shaybah narrated it with the chain Sa'id bin Abi Ayyub from Bakr bin Amr, and that is the preserved (mahfuz) view. Reference / Source: Imam Ibn Majah narrated it in abridged form with the story of the fatwa. وسيأتي الحديث برقم (355) و (441). Note / Clarification: This hadith will come again later at numbers (355) and (441). وأول الحديث، وهو قوله: "من قال عليَّ ما لم أقل، فليتبوأ مقعده من النار" روي من غير وجه صحيح عن أبي هريرة في "الصحيحين" وغيرهما، وهو متواتر، انظر "مسند أحمد" 15/ (9316) و (9350) و 16/ (10513). Important point: The opening part of the hadith, "Whoever attributes to me what I did not say, let him take his seat in the Fire", is narrated from Abu Hurayrah (may Allah be pleased with him) in the two Sahihs and other books with several sahih chains, and this hadith is of the "mutawatir" level. Reference / Source: See Musnad Ahmad (15/ 9316, 9350) and (16/ 10513). قوله: "بغير رَشْده"، الرَّشْدة: ضدُّ الغَيّة. Important point: In the hadith's phrase "bi-ghayri rashdih", "rashdah" means guidance and soundness, which is the opposite of "ghayyah" (going astray). والثَّبَت، بفتحتين: الصواب، وبتسكين الباء: ثابتة. Important point: The word "al-thabat" (with fathah on both the tha' and the ba') means correctness and truth, while with a sukun on the ba' it means "established".
