Mustadrak al-Hakim — Hadith 3543

أخبرنا أبو زكريا العَنبَري، حدثنا محمد بن عبد السلام، حدثنا إسحاق بن إبراهيم، أخبرنا عبد الرزاق، أخبرنا ابن جُرَيج، حدثني عطاء بن السائب، أنَّ عبد الله بن حبيب أخبره عن علي بن أبي طالب، عن النبي ﷺ أنه قال: ﴿وَآتُوهُمْ مِنْ مَالِ اللَّهِ الَّذِي آتَاكُمْ﴾ [النور: 33]، قال: "يُترَكُ للمُكاتَبِ الرُّبعُ" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه. وعبد الله بن حبيب: هو أبو عبد الرحمن السُّلَمي، وقد أوقَفَه أبو عبد الرحمن عن عليٍّ في روايةٍ أخرى.

It is narrated from Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said concerning this saying of Allah Almighty, "And give them from the wealth of Allah which He has given you" [Surah al-Nur: 33]: "A quarter (of the agreed sum) should be left for the mukatab (a slave who has made a contract to buy his freedom)."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it. Abdullah bin Habib is Abu Abd al-Rahman al-Sulami, and in another narration he has made this saying mawquf (stopping) at Sayyiduna Ali (may Allah be pleased with him).

(1) صحيح موقوفًا على علي بن أبي طالب، عطاء بن السائب كان قد اختلط ورواية ابن جريج عنه بعد الاختلاط، ولذلك رفعه له فيما أخبر ابن جريج كما سيأتي.
Grading: (1) It is "sahih" as "mawquf" on Ali bin Abi Talib (may Allah be pleased with him).
Technical note / Defect ('illah): Ata' bin al-Sa'ib had become "mukhtalit" (his memory deteriorated), and Ibn Jurayj's narration from him is from after the deterioration; that is why he made it marfu' (in error).
وأخرجه النسائي (5017) عن إسحاق بن إبراهيم - وهو ابن راهويه - بهذا الإسناد.
Reference / Source: It was recorded by al-Nasa'i (5017) from Ishaq bin Ibrahim (Ibn Rahawayh) with this chain.
وأخرجه أيضًا (5018) من طريق حجاج المصيصي الأعور، عن ابن جريج، به. قال ابن جريج: وأخبرني غير واحد عن عطاء أنه كان يحدِّث بهذا الحديث لا يذكر النبيَّ ﷺ.
Reference / Source: It was recorded by al-Nasa'i (5018) through Hajjaj al-Missisi al-A'war, from Ibn Jurayj. Ibn Jurayj said: "More than one person told me that Ata' used to narrate this hadith without mentioning the Prophet (peace and blessings be upon him)."
قلنا: وممّن رواه عن عطاء موقوفًا معمر عند عبد الرزاق في "المصنف" (15590)، وجرير بن عبد الحميد عند النسائي (5019)، وهشام بن أبي عبد الله الدستوائي عند البيهقي في "السنن" 10/ 329. وهشام ممّن نصُّوا أنه سمع من عطاء بن السائب قبل اختلاطه.
Corroborating chains and supporting reports: We say: among those who narrated it from Ata' as "mawquf" are Ma'mar (Abd al-Razzaq: 15590), Jarir bin Abd al-Hamid (al-Nasa'i: 5019) and Hisham al-Dastuwa'i (al-Bayhaqi: 10/ 329).
Technical note / Defect ('illah): And Hisham is one of those who heard from Ata' before his deterioration.
قال البيهقي: هذا هو الصحيح موقوف، وكذلك رواه ورقاء بن عمر وخالد بن عبد الله وأسباط بن محمد عن عطاء بن السائب موقوفًا، وكذلك رواه غير عطاء عن أبي عبد الرحمن عبد الله بن حبيب السلمي عن علي ﵁ موقوفًا. ثم ساقه من طرق عن عبد الأعلى الثعلبي عن أبي عبد الرحمن السلمي.
Grading: Imam al-Bayhaqi said: What is correct is that this narration is "mawquf". Corroborating chains and supporting reports: Likewise Warqa' bin Umar, Khalid bin Abd Allah and Asbat bin Muhammad narrated it from Ata' bin al-Sa'ib as mawquf. Details of the narration: Also, narrators other than Ata' narrated it from Abu Abd al-Rahman Abd Allah bin Habib al-Sulami, from Ali (may Allah be pleased with him), as mawquf. Then Imam al-Bayhaqi brought it through several routes via Abd al-A'la al-Tha'labi from Abu Abd al-Rahman al-Sulami.
وهو من طريق عبد الأعلى كذلك عند عبد الرزاق (15591)، وابن أبي شيبة 6/ 369، والطحاوي في "مشكل الآثار" 11/ 165، وعبد الأعلى وهو ابن عامر الثعلبي - ليس بالقوي.
Reference / Source: This narration is found likewise through Abd al-A'la in the Musannaf of Abd al-Razzaq (15591), the Musannaf of Ibn Abi Shaybah (6/ 369) and al-Tahawi's "Mushkil al-Athar" (11/ 165). Technical note / Defect ('illah): And Abd al-A'la (who is Ibn Amir al-Tha'labi) is not a strong narrator (i.e. he is weak).
وذكر الدارقطني في كتابه "العلل" (488) آخرين رووه عن عطاء موقوفًا ثم قال: وهو الصواب. ومعنى قوله: "يترك له الربع" أي: من قيمة المكاتَبة التي كاتبه عليه.
Reference / Source: Imam al-Daraqutni mentioned in his book "al-'Ilal" (488) other narrators who narrated it from Ata' as mawquf. Grading: Then he said: And this is what is correct (sawab). Note / Clarification: And the meaning of the statement (in the hadith) "يترك له الربع" is: a quarter of the contract price (the amount) on which the master made the manumission contract (mukatabah) with the slave is to be left for him.
