Mustadrak al-Hakim — Hadith 3317

حدثني أبو بكر محمد بن أحمد بن بالَوَيهِ، حدثنا محمد بن شاذان الجَوهَري، حدثنا محمد بن سابق، حدثنا إسرائيل، عن أبي إسحاق، عن صِلَة بن زُفَر، عن حُذيفة: ﴿فَقَاتِلُوا أَئِمَّةَ الْكُفْرِ إِنَّهُمْ لَا أَيْمَانَ لَهُمْ﴾ [التوبة:12]، قال: لا عهدَ لهم، قال حذيفة: ما قُوتِلوا بعدُ (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Hudhayfah (may Allah be pleased with him) concerning the saying of Allah Almighty: "Then fight the leaders of disbelief; indeed, there are no oaths for them" [Surah al-Tawbah: 12], that he said: "There is no covenant for them." And he said: "They have not yet been fought (meaning this command concerns future trials)."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), and they did not record it.

(1) إسناده قوي من أجل محمد بن سابق. أبو إسحاق: هو عمرو بن عبد الله السبيعي. وأخرجه ابن أبي شيبة 15/ 22 و 108، والطبري في "تفسيره" 10/ 88، وكذا ابن أبي حاتم 6/ 1761 من طريقين عن زيد بن وهب، عن حذيفة -دون قوله: "لا عهد لهم"، وأخرج هذا الأخير الطبري 10/ 89 عن سفيان بن وكيع، عن أبيه، عن سفيان وإسرائيل، عن أبي إسحاق، عن صلة بن زفر موقوفًا عليه من تفسيره، وابن وكيع فيه ضعف.
Grading: Its isnad is strong (qawi) because of Muhammad bin Sabiq.
Note / Clarification: (In the chain) Abu Ishaq is Amr bin Abdullah al-Sabi'i.
Reference / Source: Ibn Abi Shaybah (15/ 22 and 108), al-Tabari in his "Tafsir" (10/ 88), and likewise Ibn Abi Hatim (6/ 1761) recorded it by two routes from Zayd bin Wahb, from Hudhayfah - without the words "they have no covenant".
Details of the narration: This last part was recorded by al-Tabari (10/ 89) from Sufyan bin Waki', from his father, from Sufyan and Isra'il, from Abu Ishaq, from Silah bin Zufar, as mawquf on him as his own interpretation,
Technical note / Defect ('illah): and (the narrator) Ibn Waki' has weakness in him.
