حدثني محمد بن صالح بن هانئ، حدثنا السَّرِيّ بن خُزيمة، حدثنا سعيد ابن سليمان الواسطي، حدثنا عبَّاد بن العوَّام، حدثنا سفيان بن حسين، عن الحَكَم، عن مجاهد، عن ابن عبَّاس قال: آيتانِ منسوختانِ من سورة المائدة: ﴿فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ﴾ [المائدة:42]، فأنزل الله ﷿: ﴿وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ﴾ [المائدة: 49] … (2). صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that two verses of Surah al-Ma'idah are abrogated. One is: "So judge between them or turn away from them (as you wish)" [Surah al-Ma'idah: 42]. Then Allah, the Mighty and Majestic, revealed (in its place) this verse: "And judge between them by what Allah has revealed and do not follow their desires" [Surah al-Ma'idah: 49].
Its chain is authentic (sahih), but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) هنا بياض في النسخ الخطية قدر نصف سطر، وقد جاء في هذا الحديث عند غير المصنف: أنَّ الآية الثانية المنسوخة من سورة المائدة هي آية القلائد.
Note / Clarification: Here there is a blank space in the manuscripts about half a line long. In this hadith as recorded by others than the author (al-Hakim), it has come that the second abrogated verse of Surat al-Ma'idah is the verse of the garlands (al-qala'id).
والخبر إسناده صحيح. الحكم: هو ابن عُتيبة.
Grading: The chain of this report is sahih.
Technical note / Defect ('illah): Al-Hakam is Ibn Utaybah.

وأخرجه الطبري في "تفسيره" 6/ 246 عن محمد بن عمار، عن سعيد بن سليمان، به -إلّا أنه لم يذكر فيه ابن عبَّاس، ووقفه على مجاهد. وهذا طريق شاذّ في رواية سعيد بن سليمان الواسطي. وأخرجه النسائي (6336) و (7181)، والضياء (129) من طريقين آخرين عن عباد بن العوام، بذكر ابن عبَّاس فيه.
Reference / Source: Al-Tabari recorded it in his "Tafsir" (6/ 246) from Muhammad bin Ammar, from Sa'id bin Sulayman, with the same chain - except that he did not mention Ibn Abbas in it and made it mawquf on Mujahid. This is a shadh route in the narration of Sa'id bin Sulayman al-Wasiti. Al-Nasa'i recorded it (6336) and (7181), and al-Diya' (129), by two other routes from Abbad bin al-Awwam, with mention of Ibn Abbas in it.

وكذلك رواه منصور بن زاذان عن الحكم عند أبي عبيد (244) والطبري 6/ 245 والنحاس ص 398، من قول مجاهد.
Reference / Source: Likewise Mansur bin Zadhan narrated it from al-Hakam (with Abu Ubayd 244, al-Tabari 6/ 245 and al-Nahhas p. 398) as a statement of Mujahid.
وأخرجه أبو عبيد (243) من طريق عطاء بن أبي مسلم الخراساني، وأبو داود (3590) من طريق يزيد النحوي عن عكرمة، كلاهما عن ابن عبَّاس. ورواه السُّدي عند عبد الرزاق في "مصنفه" (10010) وأبي عبيد (245) والطبري 6/ 245 والبيهقي 8/ 249 عن عكرمة من قوله.
