Mustadrak al-Hakim — Hadith 3166

[عبد الله بن رجاء المكي، عن عبد الله بن عثمان] (3) بن خُثَيم، عن أبي الزُّبير، عن جابر قال: لما نَزَلَت ﴿الَّذِينَ يَأْكُلُونَ الرِّبَا لَا يَقُومُونَ إِلَّا كَمَا يَقُومُ الَّذِي يَتَخَبَّطُهُ الشَّيْطَانُ مِنَ الْمَسِّ﴾ [البقرة: 275] قال رسول الله ﷺ: "مَن لم يَذَرِ المُخابَرَةَ، فليُؤذَنْ بحرب من الله ورسوله" (4).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that when this verse was revealed: "Those who consume usury (riba) will not rise (on the Day of Resurrection) except as one rises whom Satan has driven to madness by his touch" [Surah al-Baqarah: 275], the Messenger of Allah (peace and blessings be upon him) said: "Whoever does not abandon al-mukhabarah (a sharecropping arrangement of land in which there is a suspicion of usury), let him take notice of a declaration of war from Allah and His Messenger."
This hadith is sahih (authentic) on the condition of Muslim, and the two Shaykhs (Bukhari and Muslim) did not record it.

Note / Clarification: What is between the square brackets we have taken from al-Dhahabi's "Talkhis al-Mustadrak"; in the manuscripts there is a blank space in its place, up to the author's shaykh.

(4) رجاله ثقات. أبو الزبير: هو محمد بن مسلم بن تَدرُس المكي.
Grading: Its narrators are trustworthy.
Technical note / Defect ('illah): Abu al-Zubayr is Muhammad bin Muslim bin Tadrus al-Makki.
وأخرجه أبو داود (3406) عن يحيى بن معين، عن عبد الله بن رجاء، بهذا الإسناد.
Reference / Source: Abu Dawud recorded it (3406) from Yahya bin Ma'in, from Abd Allah bin Raja', with this same chain.
وأخرجه ابن حبان (5200) من طريق يحيى بن سليم، عن ابن خثيم به.
Reference / Source: Ibn Hibban recorded it (5200) via Yahya bin Sulaym, from Ibn Khuthaym, with the same chain.
وقد أخرج أحمد 23/ (14876)، ومسلم (1536) (85)، وأبو داود (3404)، والترمذي (1313)، والنسائي (4592) من وجوه عن أبي الزبير وغيره عن جابر: أنَّ النبي ﷺ نهى عن المخابرة … وذكر أشياء أخرى معها. وأخرجه كذلك البخاري (2381) وغيره من طريق عطاء بن أبي رباح، عن جابر.
Reference / Source: Ahmad 23/(14876), Muslim (1536) (85), Abu Dawud (3404), al-Tirmidhi (1313) and al-Nasa'i (4592) recorded, via various routes from Abu al-Zubayr and others, from Jabir (may Allah be pleased with him): "The Prophet (peace and blessings be upon him) forbade mukhabarah …", and he mentioned other things along with it. Likewise al-Bukhari (2381) and others recorded it via 'Ata' bin Abi Rabah, from Jabir (may Allah be pleased with him).
والمخابرة: إجارة الأرض البيضاء لزراعتها على شيء مما تخرجه كالثلث أو الربع أو نحو ذلك، والبذر من العامل لا المالك.
Note / Clarification: "al-mukhabarah": leasing vacant (uncultivated) land for farming in return for a portion of what it produces, such as a third or a quarter or the like, with the seed provided by the worker, not the owner.
