Mustadrak al-Hakim — Hadith 2900

حدثنا أبو بكر أحمد بن سلْمان بن الحسن الفقيه إملاءً ببغداد، حدثنا الحسن بن مُكرَم البَزّاز، حدثنا عثمان بن عمر، حدثنا علي بن المُبارك، عن يحيى بن أبي كثير، عن عِكرمة، عن ابن عباس، قال: قضَى رسولُ الله ﷺ في المكاتَب أن يُقتَلَ بدِيَةِ الحُرّ على قَدْر ما أَدَّى منه (1). قال يحيى: قال عِكْرمة عن ابن عباس: يُقام عليه حدُّ المَملُوك (1).
هذا حديث صحيح على شرط البخاري، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) ruled concerning the mukatab slave that (blood money) is to be paid for him according to the blood money of a free man, in proportion to what he has paid (of his contract price). Ikrimah (may Allah have mercy on him) narrated from Ibn Abbas (may Allah be pleased with them both) that the prescribed punishment (hadd) of a slave is to be carried out on (such a person).
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs (Bukhari and Muslim) did not record it.

Grading: Its narrators are "trustworthy", but there is disagreement over whether it is "mawsul or mursal" and whether it is "marfu' or mawquf", as we have explained in detail in our edition of "Sunan Abi Dawud" (4581). Abu Dawud also briefly pointed this out after hadith (4582).
وأخرجه النسائي (6983) من طريق وكيع، عن علي بن المبارك، بهذا الإسناد.
Reference / Source: Al-Nasa'i (6983) narrated it by way of Waki', from Ali bin al-Mubarak, with this same chain.
وأخرجه أحمد 3/ (1944) و (1984) و 4/ (2356)، وأبو داود (4581)، والنسائي (5000) من طريق هشام بن أبي عبد الله الدَّستُوائي، وأحمد 5/ (3423)، وأبو داود (4581)، والنسائي ¤ ¤ (6985) من طريق حجاج بن أبي عثمان الصوّاف، والنسائي (5001) و (6984) من طريق معاوية بن سلّام، ثلاثتهم عن يحيى بن أبي كثير، به. ولفظ هشام وحجاج بنحو لفظ أبان بن عبد العزيز بن يزيد الآتي عند المصنف بعده.
Reference / Source: Ahmad (3/ 1944, 1984, 4/ 2356), Abu Dawud (4581) and al-Nasa'i (5000) narrated it by way of Hisham bin Abi Abd Allah al-Dastuwa'i; Ahmad (5/ 3423), Abu Dawud (4581) and al-Nasa'i (6985) by way of Hajjaj bin Abi Uthman al-Sawwaf; and al-Nasa'i (5001, 6984) by way of Mu'awiyah bin Sallam; all three narrated it likewise from Yahya bin Abi Kathir. The wording of Hisham and Hajjaj is like the wording of "Aban bin Abd al-Aziz bin Yazid", which will come after it in the author's (al-Hakim's) work.
وسيأتي برقم (2902) بلفظ وسياق فيه مغايرة من طريق أيوب، عن عكرمة، عن ابن عباس، ويخالف فتوى ابن عباس التي أسندها المصنف بإثر الرواية هنا، كما نبَّه عليه البيهقي 10/ 326.
Details of the narration: And this narration will come later at number (2902) by way of Ayyub, from 'Ikrimah, from Ibn Abbas, with different wording and context.
Technical note / Defect ('illah): This narration contradicts the legal verdict (fatwa) of Ibn Abbas (may Allah be pleased with them both) which the author (al-Hakim) cited here after the narration, as al-Bayhaqi (10/ 326) pointed out.
وإذا ضُبط قوله في الحديث هنا: "أن يَقتُل" على البناء للفاعل، يعني أن يكون المكاتب هو الذي باشر القتل، لا أنه قتله غيره، فيوافق حينئذٍ روايةَ أيوب عن عكرمة، وتكون رواية أيوب فيها زيادة معنًى ليس في هذه الرواية، وهو ذكر الميراث، لكن رواية هشام وأبان وحجاج عن يحيي تدل على أنَّ الضبط هنا بالبناء للمفعول، وعلى أية حالٍ فليس في كلتا الروايتين تعارض، بل إذا انضمتا لبعضهما أفادت كلُّ واحدة معنًى زائدًا على الأخرى، وقد جمعهما الترمذي (1259) في روايته عن أيوب عن عكرمة، لكن تبقى مخالفة المرفوع لفتوى ابن عباس التي هنا، ويبقى الخلاف في الوصل والإرسال والرفع والوقف، والله أعلم.
Technical note (vocalization of the wording): If the word "an yaqtula" in this hadith is read in the active voice, it would mean that the mukatab slave himself committed the killing, not that someone else killed him. In that case this narration would agree with the narration of Ayyub from 'Ikrimah.
Details of the narration: The narration of Ayyub contains an additional meaning not found here, namely "the mention of inheritance". But the narrations of Hisham (al-Dastuwa'i), Aban (bin Yazid) and Hajjaj (bin Abi Uthman al-Sawwaf) from Yahya (bin Abi Kathir) indicate that the correct vocalization here is in the passive voice ("an yuqtala", i.e. the slave was killed).
Reconciliation: In any case, there is no contradiction between the two; rather, when combined, each narration adds a further meaning to the other.
Reference: Imam al-Tirmidhi (1259) combined both of these meanings by way of Ayyub from 'Ikrimah.
Important point: But the contradiction between the marfu' hadith and the fatwa of Ibn Abbas (may Allah be pleased with them both) mentioned here still remains, as does the disagreement over whether it is connected or mursal and marfu' or mawquf. And Allah knows best.

(1) هذا موصول بالإسناد الذي قبله، ولكنه موقوف على ابن عباس، ويخالف ظاهره رواية أيوب عن عكرمة عن ابن عباس المرفوعة الآتية برقم (2902).

Apparent contradiction: Outwardly, this narration contradicts the "marfu'" narration of Ayyub, from 'Ikrimah, from Ibn Abbas, which is coming later at number (2902).

وأخرجه ابن أبي شيبة 6/ 148 و 9/ 518، وابن أبي عاصم في "الديات" ص 99، والطحاوي في "أحكام القرآن" (2043)، وفي "شرح معاني الآثار" 2/ 461 من طريق وكيع بن الجراح، عن علي بن المبارك، به.
Reference / Source: Ibn Abi Shaybah narrated it (6/ 148 and 9/ 518), Ibn Abi 'Asim in "al-Diyat" (p. 99), and Imam al-Tahawi in "Ahkam al-Qur'an" (2043) and "Sharh Ma'ani al-Athar" (2/ 461), by way of Waki' bin al-Jarrah, from Ali bin al-Mubarak.
وقال البيهقي 10/ 326: هذا عن ابن عباس من قوله يخالف الحديث المرفوع في القياس، ويخالف ما رواه حماد بن سلمة في النص. قلنا: يعني ما رواه حماد عن أيوب عن عكرمة في الرواية الآتية برقم (2902).
Statement of a hadith scholar: Imam al-Bayhaqi (10/ 326) says: "This is Ibn Abbas's own statement (mawquf), which contradicts the marfu' hadith in analogy (qiyas), and it also contradicts what Hammad bin Salamah narrated as an explicit text."
Note / Clarification: We mean the narration that Hammad transmitted through Ayyub from 'Ikrimah, which is coming later at number (2902).
