Mustadrak al-Hakim — Hadith 2886

حدثنا أبو عبد الله محمد بن يعقوب، حدثنا علي بن الحسن الهِلالي، حدثنا عبد الله بن الوليد العَدَني، حدثنا سفيان، عن حبيب بن أبي ثابت، عن عطاء، عن عائشة، قالت: قال رجل: أُعتقُ عن أبي (2) يا رسول الله؟ قال: "نعم" (3).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from the Mother of the Believers, Sayyidah Aishah (may Allah be pleased with her), that a man said: O Messenger of Allah! May I free (a slave) on behalf of my father? He (peace and blessings be upon him) said: "Yes."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(2) تحرَّف في أُصولنا إلى: ابني، والمثبت على الصواب من رواية البيهقي في "سننه الكبرى" 6/ 79، عن أبي عبد الله الحاكم في كتاب "المستدرك"، وهو الموافق لعامة مصادر تخريج الحديث.
Note / Clarification: In our source manuscripts the word has been distorted into "ibni" (my son), whereas we have adopted the correct text according to al-Bayhaqi's narration from al-Hakim in "al-Sunan al-Kubra" (6/ 79), and this agrees with the general sources of the takhrij.

(3) حسن لغيره، وهذا إسناد رجاله ثقات، لكنه اختُلف فيه على سفيان - وهو الثَّوري - في ¤ ¤ وصله وإرساله، فروي عنه كما وقع في رواية المصنف هنا موصولًا، مع أنه جاء في "جامع الثَّوري" كما قال البيهقي 6/ 279 - وهو أيضًا من رواية علي بن الحسن الهلالي عن عبد الله بن الوليد العَدَني - عن عطاء بن أبي رباح مرسلًا، وكذلك رواه وكيع وعبد الرزاق عن سفيان الثَّوري عن حبيب، عن عطاء مرسلًا.
Grading: This hadith is "hasan li-ghayrihi" (sound due to supporting evidence). The narrators of this chain are trustworthy, but there is disagreement among those narrating from Sufyan al-Thawri as to whether it is "mawsul" (connected) or "mursal".
Technical note / Defect ('illah): In the author's (al-Hakim's) work it is narrated as connected, whereas in "Jami' al-Thawri" (as al-Bayhaqi said, 6/ 279) - which is the narration of Ali bin al-Hasan al-Hilali from Abd Allah bin al-Walid al-'Adani - it has come from 'Ata' bin Abi Rabah as "mursal". Likewise Waki' and Abd al-Razzaq narrated it from Sufyan al-Thawri, from Habib, from 'Ata', as "mursal".
ورواه عُبيد بن سعيد الأُموي وفردوس الأشعري كما في "أطراف الغرائب والأفراد" لابن طاهر المقدسي (2329) عن سفيان الثَّوري، عن حبيب، عن ابن عباس، فذكر ابن عباس بدل عائشة، ولم يذكرا عطاء بن أبي رباح، وحبيب قد سمع ابن عباس فيما نص عليه ابن معين والعجلي.
Technical note / Defect ('illah): 'Ubayd bin Sa'id al-Umawi and Firdaws al-Ash'ari narrated it (as cited in Ibn Tahir's "Atraf al-Ghara'ib", 2329) from Sufyan al-Thawri, from Habib, from Ibn Abbas. They mentioned "Ibn Abbas" in place of Aishah and did not mention 'Ata' bin Abi Rabah as an intermediary. Habib's hearing from Ibn Abbas is established, as Ibn Ma'in and al-'Ijli stated explicitly.
وأخرجه البيهقي 6/ 279 عن أبي عبد الله الحاكم، بهذا الإسناد. وقال: كذا أخبرنا به، وهو خطأ، إنما رواه علي بن الحسن الهلالي في "جامع الثَّوري" عن عبد الله بن الوليد، عن الثَّوري، عن حبيب بن أبي ثابت، عن عطاء بن أبي رباح: أنَّ رجلًا قال، فذكره.
Reference / Source: Al-Bayhaqi (6/ 279) narrated it from Abu Abd Allah al-Hakim with this same chain, and said: This is how he informed us of it, but it is a mistake. In fact, Ali bin al-Hasan al-Hilali narrated it in "Jami' al-Thawri" from Abd Allah bin al-Walid, from al-Thawri, from Habib bin Abi Thabit, from 'Ata' bin Abi Rabah, that: "A man said" (i.e. as mursal).
وأخرجه البيهقي أيضًا من طريق سفيان بن محمد الجوهري، عن علي بن الحسن، عن عبد الله بن الوليد، عن سفيان الثَّوري، عن حبيب، عن عطاء مرسلًا.
Reference / Source: Al-Bayhaqi also narrated it by way of Sufyan bin Muhammad al-Jawhari, from Ali bin al-Hasan, from Abd Allah bin al-Walid, from Sufyan al-Thawri, from Habib, from 'Ata', as "mursal".
وأخرجه عبد الرزاق (16340)، وأخرجه ابن أبي شيبة 3/ 387 عن وكيع بن الجراح، كلاهما (عبد الرزاق ووكيع) عن سفيان الثَّوري، عن حبيب، عن عطاء، مرسلًا أيضًا.
Reference / Source: Abd al-Razzaq (16340) recorded it, and Ibn Abi Shaybah (3/ 387) by way of Waki' bin al-Jarrah. Both narrated it from Sufyan al-Thawri, from Habib, from 'Ata', as "mursal".
وأخرجه أبو إسحاق الهاشمي في الجزء الأول من "أماليه" (105)، والطبراني في "الكبير" (12683) من طريق عُبيد بن سعيد، عن سفيان الثَّوري، عن حبيب بن أبي ثابت، عن ابن عباس. وقد وافقه فردوس الأشعري كما قدَّمنا.
Reference / Source: Abu Ishaq al-Hashimi narrated it in his "Amali" (first part: 105), and al-Tabarani in "al-Kabir" (12683), by way of 'Ubayd bin Sa'id, from Sufyan al-Thawri, from Habib bin Abi Thabit, from Ibn Abbas. And Firdaws al-Ash'ari agreed with him, as we have mentioned.
ويشهد له حديث عمرو بن شعيب، عن أبيه، عن جده: أنَّ العاص بن وائل أوصى أن يُعتَقَ عنه مئة رقبة، فأعتق ابنه هشام خمسين رقبة، فأراد ابنه عمرو أن يُعتق عنه الخمسين الباقية، فقال: حتى أسأل رسولَ الله ﷺ، فأتى النبي ﷺ، فقال: يا رسول الله، إنَّ أبي أوصى بعتق مئة رقبة، وإنَّ هشامًا أعتق عنه خمسين، وبقيت عليه خمسون رقبة، أفأعتق عنه، فقال رسول الله ﷺ: "إنه لو كان مسلمًا فأعتقتم عنه، أو تصدقتم عنه، أو حججتم عنه، بلغه ذلك". أخرجه أحمد 11/ (6704)، وأبو داود (2883)، واللفظ له، وإسناده حسن.
Corroborating chains and supporting reports: It is supported (shahid) by the hadith of Amr bin Shu'ayb, from his father, from his grandfather, that al-'As bin Wa'il made a bequest that 100 slaves be freed on his behalf. His son Hisham freed 50, and his other son Amr intended to free the remaining 50, and said: Let me first ask the Messenger of Allah (peace and blessings be upon him). He came to him (peace and blessings be upon him) and asked. He (peace and blessings be upon him) said: "Had he been a Muslim and you freed slaves on his behalf, or gave charity on his behalf, or performed Hajj on his behalf, its reward would have reached him." Ahmad (11/ 6704) and Abu Dawud (2883) narrated it, and its chain is "hasan".
ويشهد له أيضًا ما أخرجه عبد الرزاق (16345)، وأبو عبيد في "الغريب" 4/ 309، والبيهقي 6/ 279 عن عائشة: أنَّ أخاها عبد الرحمن بن أبي بكر مات في منامه، فأعتقت عنه عائشة، تِلادًا من تلاده. والتِّلاد: كل مالٍ قَدُم. وإسناده صحيح موقوفًا.
Corroborating chains and supporting reports: It is also supported by what Abd al-Razzaq (16345), Abu 'Ubayd in "al-Gharib" (4/ 309) and al-Bayhaqi (6/ 279) narrated from Aishah (may Allah be pleased with her): that her brother Abd al-Rahman bin Abi Bakr died in his sleep, so Aishah freed slaves on his behalf from his long-held wealth (tilad). "Al-tilad" means old wealth. Its chain is "sahih mawquf".
