مَنْ مَلَكَ ذَا رَحِمٍ مُحَرَّمٍ فَهُوَ حُرٌّ

حدثنا أبو علي الحسين بن علي الحافظ، حدثنا محمد بن الحسن بن قُتيبة وعبد الله بن محمد بن سَلْم، قالا: حدثنا إبراهيم بن محمد بن يوسف الفِرْيابي، حدثنا ضَمْرة بن ربيعة، عن سفيان، عن عبد الله بن دينار، عن ابن عمر، قال: قال رسول الله ﷺ: "مَن مَلَك ذا رَحِمٍ مَحْرَمٍ، فهو حُرٌّ" (1).

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever comes to own a relative within the prohibited degrees (a close blood relative), that relative is (automatically) free."

(1) حديث صحيح، وهذا إسناد رجاله ثقات لكن بعض أهل العلم أنكره على ضمرة، وأنه انفرد به بهذا الإسناد، منهم أحمد بن حنبل والترمذي والنسائي والبيهقي، ولم يعبأ بهذا الإعلال آخرون من أهل العلم فصحَّحوه، منهم ابن الجارود وأبو علي الحافظ وابن حزم وعبد الحق الإشبيلي وابن القطان الفاسي وابن التركماني، وقد روي من حديث سمرة بن جندب كما نبّه عليه المصنف وسيخرجه بعده.
Grading: This hadith is "sahih". The narrators of this chain are trustworthy, but some scholars (Ahmad, al-Tirmidhi, al-Nasa'i, al-Bayhaqi) rejected it from Damrah and said that he is alone in narrating it with this chain.
Technical note / Defect ('illah): Other scholars (Ibn al-Jarud, Abu Ali al-Hafiz, Ibn Hazm, Abd al-Haqq al-Ishbili, Ibn al-Qattan, Ibn al-Turkumani) paid no heed to this objection (i'lal) and declared it sahih. It is also narrated from the hadith of Samurah bin Jundub, as the author (al-Hakim) pointed out and will record later.
وأخرجه ابن ماجه (2525) عن راشد بن سعيد الرملي وعُبيد الله بن الجهم الأنماطي، والنسائي (4877) عن عيسى بن محمد الرملي وعيسى بن يونس الفاخوري، كلهم عن ضمرة بن ربيعة، بهذا الإسناد.
Reference / Source: Ibn Majah (2525) recorded it from Rashid bin Sa'id al-Ramli and Ubayd Allah bin al-Jahm al-Anmati; and al-Nasa'i (4877) from Isa bin Muhammad al-Ramli and Isa bin Yunus al-Fakhuri. All of them narrate it from Damrah bin Rabi'ah with this same chain.
وذو الرحم المحرَم: هم الأقارب، ويقع على كل من يجمع بينك وبينه نَسبٌ.
Note / Clarification: "Dhu al-rahim al-muharram": these are close relatives, and the term applies to everyone with whom you share a kinship by lineage.
