Mustadrak al-Hakim — Hadith 2876

أخبرنا أبو بكر إسماعيل بن محمد الفقيه بالرَّيّ، حدثنا محمد بن الفَرَج الأزرق، حدثنا حجّاج بن محمد، قال: وأخبرني [ابن جُرَيج] (1) حدثنا أبو الزُّبَير، أنه سمع جابر بن عبد الله يقول: جاء مِسكينٌ لبعض الأنصار، فقال (2): إِنَّ سيِّدي يُكرِهُني على البِغاء، فنَزَل في ذلك: ﴿وَلَا تُكْرِهُوا فَتَيَاتِكُمْ عَلَى الْبِغَاءِ﴾ [النور: 33] (3).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه (1). ﷽ أول كتاب العِتق

It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that a poor (slave or slave girl) belonging to a man of the Ansar came and said: My master forces me into prostitution. Upon this, the verse was revealed: "And do not force your slave girls into prostitution" [Surah al-Nur: 33].
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs did not record it.

(1) سقط من أصولنا الخطية اسم ابن جُرَيج من الإسناد، والصحيح إثباته، وقد ثبت على الصواب في الرواية الآتية برقم (3544)، وثبت أيضًا في "إتحاف المهرة" (3517)، وهو ثابت لجميع من خرَّج هذا الحديث من طريق حجاج بن محمد، هو المعروف لأنَّ حجاجًا مشهور بإسناد روايات أبي الزُّبَير بواسطة ابن جُرَيج.
Note / Clarification: The name "Ibn Jurayj" has dropped out of the chain in our handwritten manuscripts, and the correct view is to include it. It is correctly present in the later narration number (3544) and in "Ithaf al-Maharah" (3517). It is present for all those who recorded this hadith by way of Hajjaj bin Muhammad, and this is the well-known form, because Hajjaj is well known for narrating the narrations of Abu al-Zubayr through "Ibn Jurayj".

(2) كذا جاء في رواية الحاكم وحده هنا بأنَّ السائل عن ذلك رجل، وهو مخالف لسائر من روى الحديث أنَّ السائل عن ذلك امرأة، وهو المناسب لنص الآية، وسيأتي على الصواب في الرواية الآتية.
Technical note / Defect ('illah): Only here in al-Hakim's narration does it appear that the one who asked was a "man", and this contradicts all the other narrators, according to whom the one who asked was a "woman", and this is what fits the text of the verse. It will come correctly in the next narration.

(3) حديث صحيح، وهذا إسناد حسن من أجل محمد بن الفرج، وقد توبع. ابن جُرَيج: هو عبد الملك بن عبد العزيز المكي، وأبو الزُّبَير: هو محمد بن مسلم بن تَدرُس المكي. ¤ ¤ وأخرجه أبو داود (2311) عن أحمد بن إبراهيم الدورقي، والنسائي (11301) عن الحسن بن محمد بن الصبّاح، كلاهما عن حجاج بن محمد، بهذا الإسناد. بلفظ: جاءت مُسَيكة لبعض الأنصار، فقالت ....
Grading: This hadith is "sahih", and this chain is "hasan" because of Muhammad bin al-Faraj, and he has been corroborated. (In the chain) Ibn Jurayj is "Abd al-Malik bin Abd al-Aziz al-Makki", and Abu al-Zubayr is "Muhammad bin Muslim bin Tadrus al-Makki".
Reference / Source: And Abu Dawud (2311) recorded it from Ahmad bin Ibrahim al-Dawraqi; and al-Nasa'i (11301) from al-Hasan bin Muhammad bin al-Sabbah. Both narrate it from Hajjaj bin Muhammad with this same chain. The wording is: "Musaykah, who was the (slave girl) of one of the Ansar, came and said".
وأخرجه مسلم (3029) من طريق أبي سفيان طلحة بن نافع، عن جابر، وسمَّى الأنصاري عبد الله بن أبيّ بن سَلُول.
Reference / Source: Muslim (3029) narrated it by way of Abu Sufyan Talhah bin Nafi', from Jabir (may Allah be pleased with him), and he named the Ansari as "Abd Allah bin Ubayy bin Salul".
وسيأتي برقم (3544) من طريق محمد بن إسحاق الصغاني عن حجاج.
Details of the narration: And this narration will come later at number (3544) by way of Muhammad bin Ishaq al-Saghani, from Hajjaj.
والبِغاء: هو الزِّنى.
Note / Clarification: "Al-bigha'" means: fornication (zina).

Note / Clarification: Rather, Muslim did record it, as we have mentioned, but through another route from Jabir with a more complete wording.
