Mustadrak al-Hakim — Hadith 2869

حدَّثَناه أبو عبد الله محمد بن يعقوب الشَّيباني، حدثنا إبراهيم بن عبد الله السَّعْدي، أخبرنا يزيد بن هارون، أخبرنا يحيى بن سعيد، أنَّ سعد بن إسحاق بن كعب بن عُجْرة أخبره، أنَّ عمته زينب بنت كعب بن عُجْرة أخبرته، أنها سمعت فُريعة بنت مالك أختَ أبي سعيد الخُدْري قالت: خرج زَوجي في طلب أعبُدٍ له فأدركهم بطَرَف القَدوم فقتلوه، فأتاني نَعْيُه وأنا في دارٍ شاسعةٍ من دُور أهلي، فأتيتُ رسول الله ﷺ فقلت: إنه أتاني نَعْيُ زوجي، وأنا في دارٍ شاسعةٍ من دُور أهلي، ولم يَدَعْ لي نفقةً ولا مالًا، وليس المسكنُ لي، ولو تحوّلْتُ إلى إخوتي وأهلي كان أرفَقَ بي في بعض شأني، فقال: "تَحوّلي"، فلما خرجتُ إلى المسجد - أو (1) الحُجرة - دعاني - أو أُمِر بي فدُعِيتُ له - فقال: "امكُثي في البيت الذي أتاكِ فيه نَعْيُ زوجِك، حتى يَبلُغَ الكتابُ أجلَه"، فاعتددتُ فيه أربعةَ أشهرٍ وعشرًا. قالت: فأرسل عثمانُ بن عفّان، فأتيتُه فحدَّثتُه فأخذَ به (2).
هذا حديث صحيح الإسناد من الوجهين جميعًا، ولم يُخرجاه. رواه مالك بن أنس في "الموطَّأ" (1) عن سعد بن إسحاق بن كعب بن عُجْرة. قال محمد بن يحيى الذُّهْلي:
هذا حديث صحيح محفُوظ، وهما اثنان سعد بن إسحاق، وهو أشهرُهما، وإسحاق بن سعد بن كعب (2)، وقد روى عنهما جميعًا يحيى بن سعيد الأنصاري، فقد ارتفعت عنهما جميعًا الجهالةُ.

It is narrated from Sayyidah Furay'ah bint Malik (may Allah be pleased with her), the sister of Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him), that she said: My husband went out in search of some of his runaway slaves and caught up with them at the edge of al-Qadum, and those slaves killed him. The news of his death reached me while I was living in a house far from the houses of my family. I came to the Messenger of Allah (peace and blessings be upon him) and said: The news of my husband's death has reached me while I am in a house far from the houses of my family; my husband has left me neither maintenance nor wealth, and this dwelling is not my own. If I moved to my brothers and my family, it would be easier for me in some of my affairs. He (peace and blessings be upon him) said: "Move." Then, when I reached the mosque or the (blessed) chamber, he (peace and blessings be upon him) called me (or ordered that I be called) and said: "Stay in the house in which the news of your husband's death reached you, until the prescribed term (the waiting period) is completed." So I spent the waiting period of four months and ten days there. She relates: Then Sayyiduna Uthman bin Affan (may Allah be pleased with him) (during his caliphate) sent for me; I narrated this hadith to him, and he acted upon it.
This hadith is sahih through both chains, but the two Shaykhs did not record it. Imam Malik bin Anas narrated it in the Muwatta from Sa'd bin Ishaq. Imam Muhammad bin Yahya al-Dhuhli said: This hadith is sahih and mahfuz (well-preserved). Sa'd bin Ishaq and Ishaq bin Sa'd are two separate narrators, of whom Sa'd is the better known, and Yahya bin Sa'id al-Ansari narrated from both of them, which removes the charge of being unknown (jahalah) from both.

(1) تحرَّف في النسخ الخطية إلى: والحجرة، بواو العطف، وإنما هو شك من الراوي كما في "السنن الصغرى" للبيهقي (2807) حيث رواه عن المصنف، وكذلك هو في مصادر التخريج.
Note / Clarification: In the handwritten manuscripts this word has been distorted into "wa-l-hujrah" (with the conjunctive waw), whereas it is actually a doubt on the part of the narrator (i.e. "al-hujrah" or something else), as in al-Bayhaqi's "al-Sunan al-Sughra" (2807), where he narrated it from the author (al-Hakim), and likewise in the sources of the takhrij.

Grading: Like the previous chain, the chain of this hadith is "sahih". (In the chain) Yahya bin Sa'id is "al-Ansari".
Reference / Source: And Ahmad (45/ 27087), al-Tirmidhi (after 1204) and al-Nasa'i (5692) narrated it by way of Abd Allah bin Idris, from Yahya bin Sa'id al-Ansari, with this same chain.

(2) كذا جزم بأنهما اثنان، مع أنَّ غيره قد جزم بأنه انقلب اسم سعد بن إسحاق على بعض من روى هذا الحديث وغيره، فسماه إسحاق بن سعد، فانقلب هنا على حماد بن زيد، مع أنه كان يروي عنه أحيانًا على الصواب كما قدَّمنا، وروى عبد الرحمن بن النعمان المدني عن سعد بن إسحاق حديثًا آخر فسماه إسحاق بن سعد خطأً كذلك، كما بينه الذهبي في "الميزان"، وابن حجر في "لسان الميزان"، والسخاوي في "التحفة اللطيفة في تاريخ المدينة الشريفة" (396)، والله تعالى أعلم.
Technical note / Defect ('illah): He stated firmly that they are two (separate) persons, whereas others have stated firmly that the name of Sa'd bin Ishaq got reversed (maqlub) for some narrators, so they said "Ishaq bin Sa'd". Here it got reversed for Hammad bin Zayd, although he sometimes narrated with the correct name as well, as we have shown. And Abd al-Rahman bin al-Nu'man al-Madani narrated another hadith from Sa'd bin Ishaq and likewise mistakenly called him "Ishaq bin Sa'd", as al-Dhahabi explained in "al-Mizan", Ibn Hajar in "Lisan al-Mizan", and al-Sakhawi in "al-Tuhfah al-Latifah" (396). And Allah knows best.
